{"id":799607,"date":"2026-07-14T11:40:14","date_gmt":"2026-07-14T11:40:14","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/799607\/"},"modified":"2026-07-14T11:40:14","modified_gmt":"2026-07-14T11:40:14","slug":"asic-moves-to-wind-up-capital-guard-alleging-it-pushed-fake-bonds","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/799607\/","title":{"rendered":"ASIC moves to wind up Capital Guard, alleging it pushed fake bonds"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">The financial watchdog is trying to shut down a formerly licensed Australian company accused of promoting fake bond investments and engaging in &#8220;serious misconduct&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The Australian Securities and Investments Commission (ASIC) says its investigations to date indicate Capital Guard had raised more than $17 million from around 80 investors across Australia, alleging only a &#8220;small proportion&#8221; of those funds remained in the firm&#8217;s accounts.<\/p>\n<p class=\"paragraph_paragraph___QITb\">ASIC has now lodged a winding-up application in the New South Wales Supreme Court against Capital Guard AU.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Do you know more about this or have a similar story? Email\u00a0<a class=\"Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-07-14\/asic-takes-capital-guard-to-supreme-court-alleging-fake-bonds\/mailto:turner-cohen.alex@abc.net.au\" data-component=\"Link\" rel=\"nofollow noopener\" target=\"_blank\">turner-cohen.alex@abc.net.au<\/a><\/p>\n<p class=\"paragraph_paragraph___QITb\">The financial regulator said it had &#8220;serious concerns&#8221; about the company and its handling of investor funds, and wanted a liquidator appointed to investigate its affairs and preserve whatever assets remain.\u00a0<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Investor funds appear to have been used in ways that are inconsistent with how Capital Guard told investors those funds would be invested,&#8221; a statement from ASIC said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">ASIC has accused the company of engaging in &#8220;serious misconduct&#8221; including promoting a fake Macquarie Bank bond, providing false documents to its auditor and making misleading statements.<\/p>\n<p class=\"paragraph_paragraph___QITb\">It also alleged there had been a &#8220;breakdown in the company&#8217;s governance and management&#8221; and that it had failed to comply with regulatory and reporting obligations.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The move follows regulatory action ASIC took against Capital Guard last week to cancel its financial services licence.<\/p>\n<p>Investors concerned for future of funds<\/p>\n<p class=\"paragraph_paragraph___QITb\">Gail MacDonald, 69, from regional NSW, feared what this latest development meant for the $250,000 she and her husband invested last year.\u00a0<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It&#8217;s been a very, very stressful time for us because\u00a0we&#8217;re not actually rich,&#8221; the Wollongong resident said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;This was our, sort of, safeguard for our retirement that we didn&#8217;t want to touch.&#8221;<\/p>\n<p><img decoding=\"async\" alt=\"Gail MacDonald, a 69-year-old woman from Wollongong, is a a Capital Guard victim. \" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/07\/82b06e2b11408ecd45b8d7655867a2ba.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Gail MacDonald fears for her retirement after investing $250,000 into Capital Guard. (Supplied: Gail MacDonald)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms MacDonald has since made reports to Scamwatch, ASIC and the Australian Financial Complaints Authority.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Capital Guard claimed on its now-defunct website that it would act as &#8220;your investment shield&#8221; and that some of its bonds had returns of up to 9 per cent.\u00a0<\/p>\n<p class=\"paragraph_paragraph___QITb\">The company held a financial services licence since August 15, 2017, however, the previous financial services business was sold in 2024 to its current management, according to ASIC.\u00a0<\/p>\n<p><img decoding=\"async\" alt=\"A prospectus investors were sent about Capital Guard's investment opportunities. \" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/07\/362d3b44cd404823d7d39ddf78a78829.png\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Capital Guard offered a number of bonds, including this one with 9.6 per cent returns.
