A Brisbane bus driver who was found guilty of driving without due care and attention when he struck and killed a woman on a CBD footpath more than two years ago has appealed his conviction.<\/p>\n

Last year Lindsay Francis Selby unsuccessfully challenged a single charge of careless driving causing the death of Tia Cameron in March 2024.<\/a><\/p>\n

During a trial before a magistrate, the court heard the 18-year-old suffered catastrophic injuries and died after a city council bus pinned her against a wall.<\/p>\n

The 72-year-old was handed a wholly suspended eight-month sentence and was disqualified from driving for a year.<\/p>\n

On Friday, Mr Selby appeared in the Brisbane District Court, where his lawyer argued the conviction should be overturned.<\/p>\n

Judge Bernard Porter KC told the court Selby was effectively challenging each of the principal decisions of the original magistrate.<\/p>\n

He said because of this, the appeal could be considered “a true rehearing” which he called rare.<\/p>\n

“I’m just going to go through all the evidence and decide it,” he said.<\/p>\n

“If I reach a view on my independent assessment \u2026 that his honour was wrong about rejecting Mr Selby’s evidence or anything else, that will establish the error.”\"a<\/p>\n

It was not in dispute during the trial that Selby had been travelling about 15 kilometres an hour when he was making a left turn from Ann Street, downhill into Edward Street.<\/p>\n

Video footage of the crash, captured from multiple angles including inside of the bus, were played during the trial and the appeal hearing.<\/p>\n

The internal vision showed as he was turning the corner, Selby continued to turn left to avoid traffic lined up in front of the bus.<\/p>\n

As the bus moved across lanes, Selby adjusted the steering wheel in an evasive manoeuvre before it mounted the curb.<\/p>\n

His lawyer Saul Holt KC told the court, the defence’s argument at trial and in the appeal, was that his client only had seconds to react to the banked cars and believed in that time he was applying the brakes.<\/p>\n

“He believes he’s pressing the brake and he’s not, it’s not slowing, and then a split-second later it’s the hard turn to the left.”<\/p>\n

The trial and appeal heard the brakes on the bus were never activated.<\/p>\n

Putting that aside, Judge Porter told the court “the real issue” to determine, was whether Selby was paying attention, and if so, could he have made a judgement “before the last moment”.<\/p>\n

“Was there time to, fairly, keeping a proper lookout, apply the brake, notice there was a problem, look down, and do a proper job of it?” he said.<\/p>\n

“Or did all this happen so quickly that \u2026 it’s artificial to assess his driving by reference to that kind of microscopic analysis of judgement making in a short period?”<\/p>\n

Part way through Mr Holt’s submissions, Ms Cameron’s father, who was in the gallery with other family members, interjected, calling out “why didn’t you press the air horn at any point”.<\/p>\n

He apologised after being told not to interrupt.<\/p>\n

Susan Hedge, who is representing the Queensland Police Service, told the court Selby appeared to have “a very relaxed demeanour” on the internal CCTV while turning the corner and had “no reaction” until the final seconds before the collision.<\/p>\n

She said he should have been able to see cars stopped before he turned, and he should have braked earlier.<\/p>\n

“When your honour is considering this time, that you know you need to brake \u2026 it would not be from the bottom-side of the Edwards Street pedestrian crossing, it would have been right back in Ann Street,” she said.<\/p>\n

Ms Hedge submitted there was never any attempt to brake because Selby “just wasn’t paying attention”.<\/p>\n
