(Supplied)<\/p>\n<p class=\"paragraph_paragraph___QITb\">The company also sought orders for the activists to be examined in court about those documents.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Supreme Court Justice Matthew Howard today dismissed that application, saying despite Woodside having &#8220;clearly devoted very considerable resources to their application&#8221;, it had not convinced the court that an order was needed to show who else was involved.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;I find that [Woodside&#8217;s] evidence and submissions do not rise above mere conjecture or speculation,&#8221; he wrote.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Justice Howard said it was clear WA Police had conducted a &#8220;significant investigation&#8221; into the incident, and that the identities of the two other activists who were not charged were already known.<\/p>\n<p>&#8216;Serious invasion of privacy\u2019<\/p>\n<p class=\"paragraph_paragraph___QITb\">Protesters aligned with the Disrupt Burrup Hub campaign group set off the stink bomb on June 1, 2023.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Last week, Woodside&#8217;s lawyers told the court the company intended to seek financial damages from everyone involved in the protest, arguing it needed the documents to identify all those responsible for the damage and loss of productivity.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2026-07-16\/woodside-pursues-stink-bomb-protesters-in-wa-supreme-court\/106923856\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Woodside&#8217;s bid to track down activists behind stink-bomb protest detailed in court<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Energy giant Woodside has taken climate activists to court in a bid to unmask the conspirators behind a stink-bomb protest that forced the evacuation of its Perth headquarters.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But Justice Howard rejected Woodside&#8217;s arguments, including that an online Disrupt Burrup Hub guide, which referred to protest activities involving groups of eight people, proved more people were involved in the stink-bomb stunt.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He noted the guide was published after the headquarters protest.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;With great respect, I simply do not understand the submission,&#8221; he wrote about the company&#8217;s suggestion that a separate protest coordinated by Disrupt Burrup Hub at the home of then-CEO Meg O&#8217;Neill indicated others may have been involved.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Even if he was wrong about those views, Justice Howard wrote, he said the court had discretion to grant orders in cases like these and would have declined to do so.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;[Woodside&#8217;s] application would, if granted, involve a very serious invasion of privacy and confidentiality and should only be made as would be required by the interests of justice,&#8221; he wrote.<\/p>\n<p>Caution against discouraging activism<\/p>\n<p class=\"paragraph_paragraph___QITb\">Later in his judgement, Justice Howard suggested the way Woodside approached the case could create a perception it was discouraging protests against its operations.<\/p>\n<p><img decoding=\"async\" alt=\"A wide shot of a crowd of protesters holding signs and placards during a rally outside Woodside Energy's AGM in Perth.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/07\/a3a8af5f6f0b5eacee37ef78227c9714.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Protesters rallied outside Woodside&#8217;s AGM at Crown Towers in Perth in April this year. (ABC News: Courtney Withers)<\/p>\n<p class=\"paragraph_paragraph___QITb\">He wrote that there was a &#8220;tendency&#8221; in the case for Woodside to &#8220;conflate the incident with the broader activities of the Disrupt Burrup Hub group&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The judge acknowledged Woodside took &#8220;exception&#8221; to those protests but said it was &#8220;not of assistance&#8221; in resolving this case.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;The apparent conflation in places may lead to an inference that this application is part of Woodside&#8217;s broader response to discourage protests against its projects,&#8221; he wrote.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;The possibility of such conflation suggests strongly to me that the court needs [to] be particularly careful that any order made not go beyond the incident itself.&#8221;<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2023-08-20\/climate-activism-woodside-abc-protest-four-corners\/102714892\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Climate activism has dominated headlines, but has the mayhem muddied the message?<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">While outrage over an ABC television crew filming a protest outside the Woodside CEO&#8217;s home dominated headlines, Kathryn Diss questions whether the chaos of climate action could be more harmful than helpful.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Justice Howard also revealed that prior to the hearing of the case, Woodside&#8217;s senior security adviser had contacted the court&#8217;s security team asking to meet with them about the matter.<\/p>\n<p class=\"paragraph_paragraph___QITb\">He said while that was not unusual in cases that attracted public attention, he indicated concern that &#8220;such a meeting may give rise to a perception that the court, broadly conceived, may be working or co-operating with the plaintiffs&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;I have no reason to infer that the plaintiffs&#8217; she said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;It&#8217;s one thing for that demand to come from the authorities, but for that to come from a private corporation is incredibly concerning.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms Partyka said she was &#8220;discombobulated&#8221; by the speed of Justice Howard&#8217;s ruling after just one week, but said it gave her a sense of vindication.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;I think it&#8217;s a hugely humiliating decision for Woodside,&#8221;
