{"id":825856,"date":"2026-07-26T23:55:12","date_gmt":"2026-07-26T23:55:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/825856\/"},"modified":"2026-07-26T23:55:12","modified_gmt":"2026-07-26T23:55:12","slug":"israeli-siblings-who-fear-breaking-law-in-gaza-under-idf-owed-protection-by-australia-tribunal-finds-australian-immigration-and-asylum","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/825856\/","title":{"rendered":"Israeli siblings who fear breaking law in Gaza under IDF owed protection by Australia, tribunal finds | Australian immigration and asylum"},"content":{"rendered":"<p class=\"dcr-1s160rg\">Three Israeli citizens facing conscription into the <a href=\"https:\/\/www.theguardian.com\/world\/israel\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Israel<\/a> Defense Forces have been granted the right to reapply for protection visas in Australia, after a government tribunal found they held a genuine fear they would be forced to break international humanitarian law in Gaza.<\/p>\n<p class=\"dcr-1s160rg\">The <a href=\"https:\/\/www.austlii.edu.au\/cgi-bin\/viewdoc\/au\/cases\/cth\/ARTA\/2025\/3075.html\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Administrative Review Tribunal<\/a> found the punishment the young adults could face from the state of Israel \u2013 including imprisonment as conscientious objectors \u2013 would amount to persecution.<\/p>\n<p class=\"dcr-1s160rg\">Part of a family group, three siblings faced mandatory national service if they were returned to Israel, and held a genuine belief they would be forced to \u201cengage in breaches of international humanitarian law\u201d.<\/p>\n<p class=\"dcr-1s160rg\">The tribunal found there were \u201ccredible allegations that Israel\u2019s military operations in the Gaza Strip are in breach of international humanitarian law\u201d and that international opinion was that the IDF\u2019s actions in Gaza were disproportionate. It found the three siblings were refugees facing persecution from the state of Israel, and Australia had a legal obligation to protect them.<\/p>\n<p><a data-link-name=\"standard link button Primary\" data-spacefinder-role=\"inline\" data-ignore=\"global-link-styling\" href=\"https:\/\/www.theguardian.com\/email-newsletters?CMP=copyembed&amp;CMP=emailbutton\" class=\"dcr-rh233e\" rel=\"nofollow noopener\" target=\"_blank\">Sign up for the Breaking News Australia email <\/a><\/p>\n<p class=\"dcr-1s160rg\">The family\u2019s case went before the tribunal in October last year. The <a href=\"https:\/\/www.austlii.edu.au\/cgi-bin\/viewdoc\/au\/cases\/cth\/ARTA\/2025\/3075.html\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">decision was published<\/a> in March.<\/p>\n<p class=\"dcr-1s160rg\">The family \u2013 a husband and wife and their children \u2013 arrived in Australia on the husband\u2019s working visa a decade ago.<\/p>\n<p class=\"dcr-1s160rg\">That visa expired, and the family applied for protection visas in 2024, six months after the Hamas-led attacks of 7 October 2023 sparked the current conflict in Gaza and Israel. Their application for protection was rejected by the government.<\/p>\n<p class=\"dcr-1s160rg\">On appeal to the tribunal, the family claimed they were not safe from terrorist attacks anywhere in Israel and had \u201clost faith in the ability of the state of Israel to protect its citizens\u201d, citing previous terrorist attacks by Hamas and being forced to live in bunkers for sustained periods.<\/p>\n<p class=\"dcr-1s160rg\">This argument was not accepted by the tribunal. While the tribunal found the family was at risk of being injured or killed by a Hamas rocket attack, it said any harm they suffered would not be the result of \u201cdiscriminatory conduct aimed at them\u201d.<\/p>\n<p class=\"dcr-1s160rg\">\u201cRather, it would be because they were a casualty of the armed conflict between Israel and Hamas. The applicants do not meet the refugee criterion in relation to this aspect of their claims.\u201d<\/p>\n<p class=\"dcr-1s160rg\">However, the couple\u2019s eldest child \u2013 who, along with two siblings, had reached the age of 18 \u2013 told the tribunal she and her siblings had vowed to refuse the national service compulsory for Israeli citizens.<\/p>\n<p class=\"dcr-1s160rg\">\u201cShe gave evidence that she and [her two siblings] had made a pact between themselves that they would refuse to serve in the Israel Defence Forces (the IDF).<\/p>\n<p class=\"dcr-1s160rg\">\u201cThe basis of their refusal to serve in the IDF was that they would be required to serve in the Israel-Palestinian conflict on the Gaza Strip, and as part of that conflict may be forced to engage in breaches of international humanitarian law. The tribunal accepts that these views are genuinely held.\u201d<\/p>\n<p class=\"dcr-1s160rg\">The tribunal said it accepted that the three adult siblings \u201cwould be liable to terms of imprisonment of up to two years for refusing to serve in the IDF\u201d.<\/p>\n<p class=\"dcr-1s160rg\">The tribunal noted <a href=\"https:\/\/www.theguardian.com\/world\/2024\/nov\/21\/why-did-icc-issue-netanyahu-arrest-warrant-and-what-are-the-implications\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">that arrest warrants had been issued by the international criminal court<\/a> against the Israeli prime minister, Benjamin Netanyahu, and the former defence minister Yoav Gallant on allegations of war crimes and crimes against humanity, including murder.<\/p>\n<p><a data-ignore=\"global-link-styling\" href=\"#EmailSignup-skip-link-17\" class=\"dcr-76akua\">skip past newsletter promotion<\/a>Free newsletter | When needed<\/p>\n<p class=\"dcr-vf9hps\">Sign up to Breaking News Australia<\/p>\n<p class=\"dcr-1r7my33\">Get the most important news as it breaks<\/p>\n<p><img src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/07\/2998.jpg\" alt=\"\" loading=\"lazy\" decoding=\"async\" class=\"dcr-xiq31o\"\/><\/p>\n<p id=\"EmailSignup-skip-link-17\" tabindex=\"0\" aria-label=\"after newsletter promotion\" role=\"note\" class=\"dcr-76akua\">after newsletter promotion<\/p>\n<p class=\"dcr-1s160rg\">The tribunal also noted the <a href=\"https:\/\/www.theguardian.com\/world\/2025\/sep\/16\/israel-committed-genocide-in-gaza-says-un-inquiry\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">United Nations Commission of Inquiry had reported<\/a> that \u201cIsrael authorities and Israeli security forces have committed and are continuing to commit genocide against the Palestinians in the Gaza Strip\u201d.<\/p>\n<p class=\"dcr-1s160rg\">\u201cThe International Criminal Court arrest warrant and the United Nations Commission of Inquiry report contain credible allegations that Israel\u2019s military operations in the Gaza Strip are in breach of international humanitarian law,\u201d the tribunal said.<\/p>\n<p class=\"dcr-1s160rg\">\u201cThis is a situation where Israel\u2019s military operations are not currently considered by the international community to be proportionate in the means used to achieve a legitimate national objective of Israel.\u201d<\/p>\n<p class=\"dcr-1s160rg\">The tribunal said it was not required to express any \u201cconcluded views\u201d as to whether Israel had engaged in acts of genocide and noted Netanyahu and Gallant were \u201centitled to a presumption of innocence\u201d before the ICC.<\/p>\n<p class=\"dcr-1s160rg\">The tribunal argued that the enforcement of Israel\u2019s national service laws \u2013 and the expected punishment for refusing to serve \u2013 \u201cwould amount to persecution\u201d of the adult siblings in the family.<\/p>\n<p class=\"dcr-1s160rg\">\u201cThe tribunal is satisfied that the risk of imprisonment faced by the [siblings] for refusal to do military service would involve a real chance of serious harm to them. The essential and significant reason for this persecution would be the political opinion underlying their refusal to do compulsory military service.<\/p>\n<p class=\"dcr-1s160rg\">\u201cThere are no reasonable steps the [siblings] could take to modify their behaviour to avoid the threat of serious harm. As the risk of persecution comes from the state itself, the tribunal finds that state protection is not available. The risk of harm also extends to all areas of Israel.\u201d<\/p>\n<p class=\"dcr-1s160rg\">The tribunal ruled the three adult siblings facing conscription into the IDF met Australia\u2019s obligations for protection under the refugees convention: that is, they faced a \u201c<a href=\"https:\/\/www.austlii.edu.au\/cgi-bin\/viewdoc\/au\/cases\/cth\/ARTA\/2025\/3075.html\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">well-founded fear of persecution<\/a>\u201d in their home country.
