One Nation party<\/a> had made the comment in a social media post two years earlier, on the day Britain\u2019s Queen Elizabeth II died, while responding to Faruqi\u2019s remarks that she could not \u201cmourn the leader of a racist empire built on stolen lives, land and wealth of colonised peoples\u201d.<\/p>\nIn their ruling on Monday, the three-judge panel of the Full Federal Court of Australia said that \u201cnone of the grounds\u201d of appeal had been established, adding that Hanson\u2019s comment was unlawful and unprotected \u2060by free speech defences.<\/p>\n
\u201cToday, justice has prevailed,\u201d Faruqi told reporters outside court in Sydney. \u201cToday\u2019s win is for every single person out there who has been told to go back to where you came from.\u201d<\/p>\n
Hanson said she and her legal team would review the decision and intended to lodge an appeal with Australia\u2019s final court of appeal, the High Court.<\/p>\n
\u201cPublic discussion in Australia has become almost totally silenced by laws and rules which prevent ordinary people expressing their personal views in case some small part of our society takes some sort of offence or feels hurt or \u2018distressed\u2019. This has never been, nor ever should be, the Australian way,\u201d Hanson posted on X.<\/p>\n
The Full Federal Court said it agreed with the 2024 judgement, which \u201ccorrectly characterised\u201d Hanson\u2019s post as containing an anti-Muslim and Islamophobic message and \u201cbeing a variant of the historically racist, nativist and anti-immigrant slogan \u2018go back to where you came \u200cfrom\u2019.\u201d<\/p>\n
The law was also constitutionally valid and Hanson did not establish a defence allowing for fair comment on a matter of public interest, it said.<\/p>\n
\u201cWe have 434 paragraphs of dismissing Pauline Hanson\u2019s appeal, of confirming that indeed Pauline Hanson behaved in racism, \u200cIslamophobia, \u200cand hate,\u201d Faruqi said.<\/p>\n
\u201cHate speech is not free speech, and the Federal Court has reaffirmed that today.\u201d<\/p>\n
Founded in 1997, One Nation was long seen as a fringe party but Hanson\u2019s hard line on immigration has attracted more support in recent polls.<\/p>\n
