The landmark Supercars National Court of Appeal case was the subject of a three-hour hearing in Melbourne on Monday evening.<\/p>\n
It occurred after stewards had elected not to penalise Allen in Perth despite recognising that the 16psi minimum tyre pressure rule had been breached.<\/p>\n
Stewards cited a number of mitigating factors in their original decision, prompting outrage from rivals and the unprecedented appeal by Supercars.<\/p>\n
Motorsport Australia has confirmed the appeal court\u2019s findings via a brief statement.<\/p>\n
\u201cMotorsport Australia advises that the Supercars National Court of Appeal convened at 4pm AEST on Monday 17 August to hear Supercars\u2019 appeal from Stewards Decision 120 of the 2026 Bosch Power Tools Perth Super 440,\u201d it read.<\/p>\n
\u201cFollowing the written and oral submissions from Supercars, Grove Racing and Motorsport Australia and subsequent deliberation by the Court, the Court dismissed the appeal with written reasons to follow within 14 days pursuant to Rule 5.9.7 of Division B of the Supercars Operations Manual.<\/p>\n
\u201cMotorsport Australia thanks Judge Jonathan Forbes, Steven Chopping and Alexis Schoeb for their time and expertise, and for communicating this decision expeditiously.\u201d<\/p>\n
The verdict will not please Supercars, which has grown frustrated that MA stewards are preventing it from applying its own regulations.<\/p>\n
Rival teams had warned that a dismissal would open up a can of worms and give the green light for teams to exploit the manufacturer tolerance of every sensor on the cars.<\/p>\n
Among the mitigating factors cited by stewards in the initial judgement was the fact there is an \u201cacknowledged TPMS (tyre pressure monitoring sensor) accuracy of 0.4 psi\u201d.<\/p>\n
The outcome means Allen keeps his fifth place finish in the Perth finale and the 105 points he scored, including a fastest lap bonus.<\/p>\n","protected":false},"excerpt":{"rendered":"Kai Allen.
