Say you own a house, and local zoning officials deploy a new regulation that would cause you and your neighbors to spend tens of thousands of dollars to comply. Some of your neighbors do so, and some delay, hoping the regulation is lifted. And that\u2019s indeed what happens months later, so some, not all, homeowners spent money for nothing.<\/p>\n
That\u2019s essentially what happened to commercial establishments \u2014 mainly bars, hotels, casinos, and restaurants \u2014 between March and the last day of July with Sunday Ticket, the NFL\u2019s out-of-market package. EverPass, which is currently owned by the NFL and the equity fund Redbird, made it clear in no uncertain terms that longtime Sunday Ticket distributor DirecTV is out, and EverPass is in. That meant going from satellite infrastructure to streaming over the internet and, depending on the size of the establishment, required tens of thousands of dollars in upgrades.<\/p>\n
\u201cThe shift happening in live sports distribution is much bigger than any one company or product,\u201d EverPass wrote to one disgruntled bar owner in May. \u201cTo clarify, there are no active discussions between EverPass and DirecTV regarding NFL Sunday Ticket. EverPass is the only authorized commercial distribution platform for NFL Sunday Ticket, beginning with the 2026 season.\u201d<\/p>\n

Two months later, EverPass issued a press release that DirecTV is back<\/a>, and reportedly for the next three seasons. It was also the day DAZN announced it was buying EverPass. There is no mention of reimbursing customers who spent significant sums on a system they would not use.<\/p>\n \u201cThis year they said, \u2018okay, well we\u2019re not renewing the deal with DirecTV,’\u201d said Dan Weissman, director of IT at Casino Matrix in San Jose, Calif., which has over 100 TVs. \u201cAnd they said maybe in March or something that if you want Sunday Ticket, you have to buy it from us. And you\u2019re like, \u2018Well, we built a system that was designed around modern content distribution. This is going backwards,\u2019 and they said, \u2018Tough, tough cookies. If you want Sunday Ticket, this is the price, and you have to give it to us.’\u201d<\/p>\n Weissman wrote a long, angry letter to Sunday Ticket when it was still my-way-or-the-highway with EverPass. In it, he described EverPass\u2019 conduct as a \u201cbetrayal\u201d of loyal customers.<\/p>\n \u201cLet\u2019s be honest about what this is,\u201d wrote Weissman, who never heard back despite sending it to nearly a dozen EverPass executives. \u201cEverPass was created by the NFL\u2019s own investment arm and private equity to make more money, not to provide better service to the customer. This episode is textbook enshittification, and everyone on this email should be embarrassed. It took a service that worked reliably for decades, made it more complicated and more expensive, forced customers into a proprietary ecosystem, and externalized the cost onto the businesses with the least leverage, all to create more value for investors.\u201d<\/p>\n Anthony Barone runs a modest-sized bar in Clifton, NJ, and he is one of the lucky ones because he held out, believing that after NFL Week 1, EverPass would hear howls of outrage when scores of commercial establishments either no longer had Sunday Ticket or the internet-based system experienced technical issues. As it turns out, the surrender came before even the preseason.<\/p>\n Before the switcheroo, Barone also wrote missives to EverPass telling them streaming in bars would make no sense because of WiFi concerns and the longer lag between when a play occurs and when it is shown on the TV.<\/p>\n \u201cIt seemed like they were just trying to find another way to make more money when it really wasn\u2019t helping out bars,\u201d Ramone said. Before the July 31 switch back to DirecTV, he warned his staff that their pay would decrease in the fall if his bar did not have Sunday Ticket, which he was expected to have at least for Week 1.\u201d<\/p>\n For many commercial establishments, Sunday Ticket is as much a necessity as having enough beer or paying the electric bill. It is a must-have, and that is why so many in the hospitality business saw EverPass using this as cutthroat leverage to ram through its own product.<\/p>\n \u201cWe absorbed the cost, the disruption, and the operational risk, only to learn that the mandate was never really a mandate,\u201d Weissman wrote in his unreturned email to EverPass. \u201cIt was a bluff to try to reap all the licensing fees for yourself, and our money was the collateral.\u201d<\/p>\n
