Entertainment and AFL agent Ralph Carr has been sentenced to six years in prison for the rape and sexual assault of a former employee.<\/p>\n
Carr, 66, was convicted of two counts of rape and one count of sexual assault after a trial in the county court of Victoria<\/a> last month.<\/p>\n On Tuesday, Judge Frank Gucciardo sentenced Carr to six years in prison, with a minimum term of four years.<\/p>\n Carr had pleaded not guilty to the offences, which were committed against the former employee in March 2023. He appeared in court via videolink for his sentencing, and has foreshadowed an appeal against his conviction.<\/p>\n Carr also sought a stay on his sentence, an application which Gucciardo declined on Tuesday.<\/p>\n A sketch of Ralph Carr in the Victorian county court on 17 August. Illustration: Paul Tyquin\/AAP<\/p>\n Gucciardo said that Carr was three decades older than his victim, and had raped her in the context of her being someone who had worked for him and was confiding in him as she felt overwhelmed while drunk and affected by cocaine. As such, his offending involved a serious breach of trust.<\/p>\n It was \u201cpredatory\u201d and \u201copportunistic\u201d, he said, rather than premeditated.<\/p>\n \u201cRape is a crime of violence,\u201d Gucciardo said.<\/p>\n \u201cAt a point in which she looked at you for care and support \u2026 you chose to abuse that trust in the most abhorrent manner.\u201d<\/p>\n Sign up for the Breaking News Australia email<\/a><\/p>\n Carr, watching on from the Melbourne<\/a> assessment prison, repeatedly shook his head while Gucciardo was speaking.<\/p>\n Shortly after he was sentenced, Carr appeared to be crying.<\/p>\n Gucciardo said he accepted that Carr was of good character, and not at risk of further offending.<\/p>\n But he said that it was clear Carr\u2019s conduct was \u201cappalling\u201d and ignored the right of the victim to feel safe.<\/p>\n \u201cThese were acts that fundamentally disregarded that right for your own sexual pleasure.\u201d<\/p>\n There was no application made by the prosecution for Carr to be placed on a sex offenders register.<\/p>\n Gucciardo considered the offending in the mid-range, and said other factors, including that the crimes had likely ended Carr\u2019s career, his age, and his prior good character including lack of criminal record were also factors in his sentencing.<\/p>\n He said he considered 14 character references tendered for Carr from family and professional contacts, which noted the offending was \u201centirely at odds with the man that they know\u201d.<\/p>\n On the stay application, Gucciardo again criticised submissions made by Dermot Dann KC for Carr that anyone who had seen the victim give evidence in the case would have grave concerns about the verdict, describing the submissions as a \u201cflourish of advocacy\u201d.<\/p>\n The judge referred to a stay application granted to Ronald Ryan \u2013 the last person hanged in Victoria \u2013 in 1967.<\/p>\n Gucciardo noted that the judge in that case found that \u201cfinality is a good thing, but justice is better\u201d and that the stay was granted because he \u201csensed a real possibility of a miscarriage of justice\u201d.<\/p>\n \u201cI have no such sense in this case,\u201d Gucciardo said.<\/p>\n Carr had agued for the stay largely on the basis that the victim\u2019s evidence was unreliable, and also because of concerns about his mental health amid onerous prison conditions including routine lockdowns in his cell for more than 23 hours a day.<\/p>\n But the court heard on Tuesday that Carr was expected to be moved to less onerous conditions at a different prison within a week.<\/p>\n His victim gave evidence during a closed court hearing, with the defence and prosecution agreeing she was the most important witness in the trial.<\/p>\n The assault occurred in March 2023, after the woman said she spent an evening drinking and taking cocaine with Carr while listening to music and watching football at his friend\u2019s home.<\/p>\n At the start of the trial, prosecutor Matthew Fisher said the offences had taken place when the woman was at Carr\u2019s house, where he tried to kiss her and sexually assaulted her.<\/p>\n She pushed his hands away and said \u201cI don\u2019t want this\u201d, Fisher told the court, to which he responded with comments like \u201cYou\u2019re so sexy,\u201d \u201cI can\u2019t sleep, help me,\u201d and \u201cI need this\u201d.<\/p>\n The woman said Carr raped her twice, Fisher said.<\/p>\n \u201cShe turned around to face him, and at that point she punched him with her fist to his face, to his nose,\u201d Fisher told the court.<\/p>\n \u201cHe grabbed his face and said words to the effect of \u2018you\u2019ve broken my nose\u2019.<\/p>\n \u201cShe got out of bed and said to him: \u2018You\u2019re a fucking rapist.\u2019\u201d<\/p>\n The woman went to another room and started taking notes of what happened on her phone, before texting her mother. Her mother called the police despite her daughter\u2019s reluctance to involve them, the court heard.<\/p>\n The police arrived at Carr\u2019s property about 3am on 24 March 2023.<\/p>\n Police then spoke to the woman, with the exchange recorded on a body-worn camera. The footage of that 35-minute conversation was shown to the jury.<\/p>\n The trial heard the woman worked for Carr for several months during 2022, and the pair had resumed contact to discuss other employment opportunities, including working on his autobiography, when he invited her to his property.<\/p>\n Dann told the court that none of the offences occurred. He said it defied logic that the woman continued to stay in the house after the alleged offences, and told her mother she felt safe there.<\/p>\n The victim\u2019s credibility was also damaged by the fact she said she was reluctant to contact authorities because of a prior allegation involving police, but that allegation had been found unproven, Dann said.<\/p>\n He also questioned why she had raised the issue of \u201crecompense\u201d with her mother while she was still at Carr\u2019s house.<\/p>\n Dann described the verdict in the case as \u201cthe most obvious miscarriage of justice I\u2019ve ever seen\u201d.<\/p>\n Carr has represented some of the biggest names in Australian pop music since the 1990s, including Vanessa Amorosi, Kate Ceberano and Tina Arena, whom he married while she was signed to him. Carr and Arena divorced in 1999.<\/p>\n At its peak, his company Ralph Carr Management had a record label, a publishing company and a promotions\/touring arm, with a client list including entertainment reporter Richard Wilkins and Neighbours star and singer Bonnie Anderson.<\/p>\n In recent years Carr lost a number of his high-profile clients, but continued to manage a small number of AFL players, most notably former star Richmond midfielder Dustin Martin. Martin said after the verdict that he had immediately cut all ties with Carr.<\/p>\n Within days of being charged by police, Carr\u2019s identity was suppressed because multiple courts found he was at risk of harming himself because of the allegations.<\/p>\n The granting of suppression orders on mental health grounds in Victoria had come under scrutiny after another county court rape case involving AFL identity Tom Silvagni.<\/p>\n Information and support for anyone affected by rape or sexual abuse is available from the following organisations.
