(Screenshot)<\/p>\n<p class=\"paragraph_paragraph___QITb\">It was a confusing statement, Justice Christopher Horan said on Tuesday when he found the company deceived its Australian customer base.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;I consider that such an assumption or conclusion was erroneous. Accordingly, the conduct was misleading or deceptive,&#8221; he said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;The one-month representation amounted to conduct that was liable to mislead the public.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;I accept the ACCC&#8217;s submission that it was not possible to use the eHarmony Platform as a Basic member, free of charge, to &#8216;date&#8217; other members by engaging in ongoing communications for the purposes of developing a romantic relationship.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">The court found about 1.3 million users from Australia registered for a basic membership between 2019 and 2024.<\/p>\n<p class=\"paragraph_paragraph___QITb\">One user who gave evidence to the court \u2014 and cannot be named for legal reasons \u2014 signed up for a six-month membership at a one-time discounted payment of $155.64, but deleted her profile two months later after failing to meet anyone.\u00a0<\/p>\n<p><img decoding=\"async\" alt=\"A close up of Law Courts signage on glass.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/08\/61055b1a3992fd307cab50c1dd8b7024.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">The court will decide on penalties and consumer redress at a later date.
