{"id":900547,"date":"2026-09-21T21:54:15","date_gmt":"2026-09-21T21:54:15","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/900547\/"},"modified":"2026-09-21T21:54:15","modified_gmt":"2026-09-21T21:54:15","slug":"ev-manufacturer-byd-scrubs-references-to-china-and-surveillance-from-its-privacy-policy","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/900547\/","title":{"rendered":"EV manufacturer BYD scrubs references to &#8216;China&#8217; and &#8216;surveillance&#8217; from its privacy policy"},"content":{"rendered":"<p>Tell us about your experience. <\/p>\n<p class=\"paragraph_paragraph___QITb\">Electric vehicle maker BYD removed any reference to &#8220;China&#8221; and &#8220;surveillance&#8221; from its Australian privacy policy, just days after questions from Four Corners.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The original policy gave the company almost unlimited powers to collect data on its Australian vehicle owners and broad discretion over how it could disclose it.<\/p>\n<p class=\"paragraph_paragraph___QITb\">It said the data could be gathered &#8220;in connection with suspected illegal or improper activities&#8221; and that this could be done through &#8220;surveillance activities&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;This gives some highly concerning indications about the potential data practices of the company,&#8221; said UNSW&#8217;s Katharine Kemp, an expert in privacy law and how it relates to connected vehicles.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The policy named China as one of 16 countries where Australians&#8217; data could be sent.<\/p>\n<p class=\"paragraph_paragraph___QITb\">BYD, which is challenging Toyota for the title of Australia&#8217;s top car brand, has been selling vehicles here since 2022.<\/p>\n<p class=\"paragraph_paragraph___QITb\">It is on track to sell about 100,000 cars in Australia this year, almost double its 2025 sales.<\/p>\n<p class=\"paragraph_paragraph___QITb\">When Four Corners asked about its privacy policy, BYD replied two days later, saying it had &#8220;undergone a review and been updated&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">All references to China were gone, along with any mention of surveillance.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The new policy was uploaded to BYD&#8217;s Australian website just an hour and sixteen minutes before the company sent it to Four Corners.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Confusingly, the website said its new policy no longer applied to vehicles and directed users to a separate document on its app.<\/p>\n<p><img decoding=\"async\" alt=\"A woman sits at a desk indoors, looking down at pages in her hand as a laptop sits open.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/09\/3d9f16655d1f78555d3557b1a09cba7a.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Katharine Kemp said the wording raised concerns about BYD&#8217;s potential data practices. (Four Corners: Ron Foley)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Both policies say the data collected from Australian vehicles is stored in Australia.<\/p>\n<p class=\"paragraph_paragraph___QITb\">While all references to China have been removed, nothing stops it from transferring data overseas, including to China.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;Should we need to transfer your personal data to other countries \u2026 we will comply with applicable data protection laws regarding cross-border data transfers,&#8221; the new policy says.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The Australian Privacy Act allows for data to be transferred to China.<\/p>\n<p class=\"paragraph_paragraph___QITb\">BYD said Chinese authorities had no access to the data of Australians.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;We haven&#8217;t and would not transfer any data of Australians to the Chinese authorities,&#8221; it said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">This is despite China&#8217;s national security laws obligating companies to co-operate with authorities if requested.<\/p>\n<p class=\"paragraph_paragraph___QITb\">BYD&#8217;s new policy begins with the company saying it values and &#8220;respect our customer&#8217;s privacy&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">But privacy expert Katharine Kemp said that didn&#8217;t mean much.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;So many privacy policies that don&#8217;t provide good privacy protections start with exactly those words, and I would never pay any attention to them,&#8221; she said.<\/p>\n<p>&#8220;It&#8217;s privacy fluff. It&#8217;s nothing.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms Kemp said she could not remember reading a connected car privacy policy that &#8220;consistently meets requirements of fairness and reasonableness&#8221;.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2026-09-21\/byd-hacked-by-cybersecurity-expert-vehicle-sabotage-surveillance\/107139482\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">A cybersecurity expert hacked this BYD. (Four Corners: Ron Foley)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Last month the government released draft legislation to update Australia&#8217;s Privacy Act, acknowledging the risks posed by emerging technologies, including connected vehicles.<\/p>\n<p class=\"paragraph_paragraph___QITb\">BYD said it would welcome new laws that take into account connected cars.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;At the moment the industry is applying elements of the Australian Privacy Act from 1988, together with other regulations that almost certainly did not foresee a scenario with connected vehicles almost 40 years on,&#8221; the company said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Ms Kemp said the Privacy Act needed an overhaul.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;The majority of people do care about their privacy.
