A court has heard a former senior Sydney police officer’s “absolutely impaired” judgement was behind his assault of two men who had played a game of “knock and run” at his home.<\/p>\n
Jonathan Andrew Beard has avoided conviction after assaulting two men who had drunkenly knocked at his inner Sydney home and then hid, on September 21, 2024.<\/p>\n
Judge Jacqueline Milledge told Downing Centre Local Court today that the incident was “not trivial” but handed Mr Beard a two-year good behaviour bond for the two counts of assault occasioning actual bodily harm.<\/p>\n
“It was hurtful, and it should never have happened,” Judge Milledge told the court.<\/p>\n
At a February hearing, the court heard that Charlie Mannes and Rory Fendall were among a group playing knock and run at houses after an 18th birthday celebration, when they attended the former police superintendent’s home.<\/p>\n
The 57-year-old then pursued the men, who had fled the home, and assaulted them on a concrete laneway.<\/p>\n
The hearing was also told Mr Mannes was left with a dislocated shoulder in the aftermath of the assault, which involved the men being hit, shoved and pulled to the ground, and was captured on CCTV footage.<\/p>\n
“Whatever senseless activity these young men engaged in, they certainly didn’t deserve the consequences of what happened in that alcove,” the judge told the court.<\/p>\n
“I’ve criticised them, and I’ve criticised Jonathan Beard.”<\/p>\n
Medically retired from police force<\/p>\n
The court heard that Mr Beard had been seen by a medical practitioner a day before the incident, after he sustained “psychological” and “physical” injuries at his work as a police officer.<\/p>\n
The judge told the court that the former superintendent had reported symptoms consistent with post-traumatic stress disorder before the assault, including trouble sleeping, withdrawn behaviours and “persistent hypervigilance”.<\/p>\n
“This is how fragile Mr Beard was at the time, and that’s what this court has got to take into consideration,” the judge said.<\/p>\n
“His judgement was so poor on the evening.<\/p>\n
“I can see that his judgement was impaired, absolutely impaired.”<\/p>\n
Mr Beard was medically retired from NSW Police in November 2025, which defence lawyer Troy Edwards said concluded a “long and distinguishing policing career”.<\/p>\n
The ex-Kings Cross Commander was awarded an Australian Honours Police Medal for distinguished service in 2021.<\/p>\n
He was suspended with pay after the incident before his medical retirement.<\/p>\n
Mr Edwards also told the court that Mr Beard had suffered a neck injury “sustained in the incident” and had to undergo surgery as a result.<\/p>\n
In her sentencing, the judge said she did not want to lose sight of the impacts that the assault had on the young men, but said Mr Beard was “denunciated by his own organisation” following the assault.<\/p>\n
Sentencing criticised<\/p>\n
Earlier in the sentencing, prosecution lawyer Patrick Mulvihill had argued for a conviction to be recorded against the former police officer for the assault in “a very dangerous” location.<\/p>\n
“He [former superintendent Beard] was not under any imminent threat to his personal wellbeing,” Mr Mulvihill told the court.<\/p>\n
“It [not recording a conviction] would be effectively saying, ‘Well if you’re a police officer and you’ve got a good history in the force\u2026 you can go out there and deploy excessive force.'”<\/p>\n
The officer’s family, and the families of the young men, were present in court today.<\/p>\n
