Here\u2019s what authorities got wrong about the trade-offs"},"content":{"rendered":"<p>The New South Wales <a href=\"https:\/\/www.ipcn.nsw.gov.au\" rel=\"nofollow noopener\" target=\"_blank\">Independent Planning Commission<\/a> has <a href=\"https:\/\/www.theguardian.com\/australia-news\/2026\/sep\/30\/hunter-valley-coal-project-singleton-ipc-planning-decision\" rel=\"nofollow noopener\" target=\"_blank\">just greenlit<\/a> an expansion of the largest coal mine project in the state\u2019s history.<\/p>\n<p>The decision to expand Yancoal and Glencore\u2019s Hunter Valley Operations <a href=\"https:\/\/www.hvo.com.au\/continuation-project\/\" rel=\"nofollow noopener\" target=\"_blank\">coal mine<\/a>, which will now operate until 2045, is controversial. The planning commission received more than <a href=\"https:\/\/www.abc.net.au\/news\/2026-09-30\/hunter-valley-operations-coal-mine-ipc-decision\/107022996\" rel=\"nofollow noopener\" target=\"_blank\">10,000 public submissions<\/a> across its hearing cycle. <\/p>\n<p>Proponents of the expansion, including NSW Premier <a href=\"https:\/\/www.newcastleherald.com.au\/story\/9319352\/chris-minns-backs-hunter-mine-expansion-while-defending-renewables-strategy\/\" rel=\"nofollow noopener\" target=\"_blank\">Chris Minns<\/a>, argued it would save <a href=\"https:\/\/www.abc.net.au\/news\/2026-09-30\/hunter-valley-operations-coal-mine-ipc-decision\/107022996\" rel=\"nofollow noopener\" target=\"_blank\">1,500 jobs<\/a> and inject A$1 billion into the economy each year, according to Hunter Valley Operations\u2019 own figures. <\/p>\n<p>Opponents objected to the roughly <a href=\"https:\/\/www.ipcn.nsw.gov.au\/sites\/default\/files\/2026-09\/Statement%20of%20Reasons%20for%20Decision%20HVO%20Continued%20Operations%20Project%20%28SSD%2011826681%20%26%20SSD%2011826621%29.pdf.pdf\" rel=\"nofollow noopener\" target=\"_blank\">794 megatonnes<\/a> of greenhouse gases the coal will emit when transported and burned and raised concerns for <a href=\"https:\/\/majorprojects.planningportal.nsw.gov.au\/prweb\/PRRestService\/mp\/01\/getContent?AttachRef=SUB-95190473%2120250925T024439.874+GMT\" rel=\"nofollow noopener\" target=\"_blank\">local health<\/a>, <a href=\"https:\/\/majorprojects.planningportal.nsw.gov.au\/prweb\/PRRestService\/mp\/01\/getContent?AttachRef=SUB-95256707!20250925T074229.273+GMT&amp;utm_source=chatgpt.com\" rel=\"nofollow noopener\" target=\"_blank\">agriculture<\/a> and <a href=\"https:\/\/www.ipcn.nsw.gov.au\/sites\/default\/files\/2026-07\/SUBMISSION%20TO%20THE%20INDEPENDENT%20PLANNING%20COMMISSION.pdf\" rel=\"nofollow noopener\" target=\"_blank\">First Nations<\/a> communities.<\/p>\n<p>The project was approved after an important NSW Court of Appeal <a href=\"https:\/\/www.caselaw.nsw.gov.au\/decision\/198358b0f4e9e10f2b50c718?fbclid=IwY2xjawUp2OVleHRuA2FlbQIxMABwZG9mAXNydGMGYXBwX2lkEDIyMjAzOTE3ODgyMDA4OTIAAR6BQfiIQLj5hlE-dPsl1epTQNuhKrRNRBl4e0rk3feIlNFD4ry-6OqaE_LsDA_aem_pkHYtFXN5KlrkPj6bv_s8w\" rel=\"nofollow noopener\" target=\"_blank\">decision<\/a> last year, which ruled the planning commission must take into account the impact of emissions from burning the product overseas on the local environment. This decision is currently <a href=\"https:\/\/www.hcourt.gov.au\/cases-and-judgments\/cases\/current\/case-no-s1742025\" rel=\"nofollow noopener\" target=\"_blank\">being appealed<\/a> in the High Court, with an outcome expected next week.<\/p>\n<p>So why is this expansion so controversial? And why does it matter?<\/p>\n<p>Why was the expansion approved?<\/p>\n<p>In NSW, mining projects, including proposals to expand them, must first <a href=\"https:\/\/www.nsw.gov.au\/departments-and-agencies\/department-of-planning-housing-and-infrastructure\" rel=\"nofollow noopener\" target=\"_blank\">be assessed<\/a> by the Department of Planning, Housing and Infrastructure.<\/p>\n<p>The planning commission reviews the Department\u2019s assessment alongside any public submissions. It must then consider the <a href=\"https:\/\/legislation.nsw.gov.au\/view\/html\/inforce\/current\/act-1979-203#sec.4.15\" rel=\"nofollow noopener\" target=\"_blank\">environmental impacts<\/a>  of the project, as well as the social and economic impacts on the area. <\/p>\n<p>It must also <a href=\"https:\/\/files.parliament.nsw.gov.au\/fileapi\/ParlFiles\/GetArtifact\/Correspondence%20from%20the%20Australian%20Climate%20Accountability%20Project.pdf?serverRelativeUrl=%2Flcdocs%2Fother%2F23719%2FCorrespondence%20from%20the%20Australian%20Climate%20Accountability%20Project.pdf\" rel=\"nofollow noopener\" target=\"_blank\">take into account<\/a> NSW\u2019s <a href=\"https:\/\/legislation.nsw.gov.au\/view\/html\/inforce\/current\/act-2023-048\" rel=\"nofollow noopener\" target=\"_blank\">emissions targets<\/a> and environmental <a href=\"https:\/\/legislation.nsw.gov.au\/view\/html\/inforce\/current\/epi-2021-0731\" rel=\"nofollow noopener\" target=\"_blank\">policy instruments<\/a>, including the federal Safeguard Mechanism. The <a href=\"https:\/\/lens.monash.edu\/can-australias-safeguard-mechanism-deliver-the-emissions-cuts-it-promises\/\" rel=\"nofollow noopener\" target=\"_blank\">Safeguard Mechanism<\/a> is the main federal tool for cutting emissions from big polluters. What happens now?<\/a><\/p>\n<p>On Wednesday, the planning commission handed down its decision to approve the expansion of the Hunter Valley Operations coal mine. That\u2019s <a href=\"https:\/\/www.ipcn.nsw.gov.au\/sites\/default\/files\/2026-09\/Statement%20of%20Reasons%20for%20Decision%20HVO%20Continued%20Operations%20Project%20%28SSD%2011826681%20%26%20SSD%2011826621%29.pdf.pdf\" rel=\"nofollow noopener\" target=\"_blank\">despite acknowledging<\/a> roughly 98% of the emissions from the Hunter Valley project are \u201c<a href=\"https:\/\/www.ipcn.nsw.gov.au\/sites\/default\/files\/2026-09\/Statement%20of%20Reasons%20for%20Decision%20HVO%20Continued%20Operations%20Project%20%28SSD%2011826681%20%26%20SSD%2011826621%29.pdf.pdf\" rel=\"nofollow noopener\" target=\"_blank\">scope 3<\/a>\u201d emissions generated by burning coal in importing countries. The planning commission\u2019s decision also goes against the NSW Net Zero Commission, which <a href=\"https:\/\/www.netzerocommission.nsw.gov.au\/sites\/default\/files\/2025-12\/NZC_Coal_Spotlight_Report_2025.pdf\" rel=\"nofollow noopener\" target=\"_blank\">has advised<\/a> continued extensions or expansions to coal mining in NSW are not consistent with emissions targets in the <a href=\"https:\/\/legislation.nsw.gov.au\/view\/html\/inforce\/current\/act-2023-048\" rel=\"nofollow noopener\" target=\"_blank\">NSW Climate Change Act<\/a> or the <a href=\"https:\/\/unfccc.int\/process-and-meetings\/the-paris-agreement\" rel=\"nofollow noopener\" target=\"_blank\">Paris Agreement<\/a>.<\/p>\n<p>A key part of the planning commission\u2019s reasoning was the mine\u2019s emissions would be accounted for elsewhere. Ultimately, it decided any other risks were outweighed by the benefits for the Hunter region and NSW more broadly, including for an average of 1,311 jobs over the life of the project, government royalties and a \u201cmore orderly transition\u201d away from fossil fuels. <\/p>\n<p>However, it imposed <a href=\"https:\/\/www.ipcn.nsw.gov.au\/sites\/default\/files\/2026-09\/Statement%20of%20Reasons%20for%20Decision%20HVO%20Continued%20Operations%20Project%20(SSD%2011826681%20%26%20SSD%2011826621).pdf.pdf\" rel=\"nofollow noopener\" target=\"_blank\">a condition<\/a> that Hunter Valley Operations take reasonable measures to export coal only to countries that are party to the Paris Agreement \u2013 under which states cooperate to limit warming to well below 2\u00b0C \u2013 or have equivalent policies in place, such as Taiwan.<\/p>\n<p>            <img decoding=\"async\" alt=\"A scenic view of a valley filled with mist.\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/10\/file-20261001-50-qy0s7c.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/p>\n<p>              NSW\u2019s Hunter Valley is known for its thriving wine industry and picturesque landscapes.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.gettyimages.com.au\/detail\/photo\/hunter-valley-at-sunrise-royalty-free-image\/145560288?phrase=Hunter%20valley%20australia&amp;searchscope=image,film\" rel=\"nofollow noopener\" target=\"_blank\">Lyn Walkerden Photography\/Getty<\/a><\/p>\n<p>A question of trade-offs<\/p>\n<p>The Independent Planning Commission\u2019s decision highlights problems with how trade-offs and impacts on local communities are framed in the climate transition. This is a major reason why democracies are <a href=\"https:\/\/www.idea.int\/sites\/default\/files\/publications\/democracy-and-the-challenge-of-the-climate-change.pdf\" rel=\"nofollow noopener\" target=\"_blank\">failing to tackle<\/a> climate change.<\/p>\n<p>Climate change is a process that forces governments, industries and everyday people to make trade-offs. The costs of abandoning fossil fuels are often local, immediate and easy to spot when planning decisions are made. The planning commission highlighted the loss of <a href=\"https:\/\/www.ipcn.nsw.gov.au\/sites\/default\/files\/2026-09\/Statement%20of%20Reasons%20for%20Decision%20HVO%20Continued%20Operations%20Project%20%28SSD%2011826681%20%26%20SSD%2011826621%29.pdf.pdf\" rel=\"nofollow noopener\" target=\"_blank\">local jobs<\/a> as one such cost. <\/p>\n<p>However, the environmental damage of expanding oil, gas and coal projects is increasingly obvious. This week, for example, researchers at ANU and UNSW released a <a href=\"https:\/\/theconversation.com\/we-can-finally-measure-the-damage-each-new-coal-gas-or-oil-project-will-do-to-people-and-nature-292128\" rel=\"nofollow noopener\" target=\"_blank\">publicly available tool<\/a> that quantifies the environmental harms of specific projects. The <a href=\"https:\/\/carbonimpactstracer.com\" rel=\"nofollow noopener\" target=\"_blank\">Carbon Impacts Tracer<\/a> draws on peer-reviewed research to track temperature rise and then estimate climate-related impacts, such as how much glacial ice will melt or how many people could die due to heatwaves.<\/p>\n<p>      Read more:<br \/>\n      <a href=\"https:\/\/theconversation.com\/we-can-finally-measure-the-damage-each-new-coal-gas-or-oil-project-will-do-to-people-and-nature-292128\" rel=\"nofollow noopener\" target=\"_blank\">We can finally measure the damage each new coal, gas or oil project will do to people and nature<\/a><\/p>\n<p>Running Hunter Valley Operations\u2019 numbers through this tool, the coal mine expansion <a href=\"https:\/\/www.ipcn.nsw.gov.au\/sites\/default\/files\/2026-07\/31896%20Maria%20Lawaz%20amended%20submission%20.pdf\" rel=\"nofollow noopener\" target=\"_blank\">will result<\/a> in an estimated 462,000 more people being exposed to dangerously high temperatures and 435 additional heat-related deaths in Europe.<\/p>\n<p>It\u2019s a philosophical question whether saving 1,311 jobs can be weighed against 435 preventable deaths. But these are the conundrums we must increasingly confront in the climate transition. The greatest risk, however, arises when clever carbon accounting stops us asking important questions.<\/p>\n<p>Consider the planning commission\u2019s reliance on the Paris Agreement, for example. Given the Paris Agreement counts emissions where fuel is burned, not where it\u2019s extracted, Hunter Valley Operations\u2019 exported coal never appears on Australia\u2019s books. What\u2019s more, governments already plan to produce <a href=\"https:\/\/productiongap.org\" rel=\"nofollow noopener\" target=\"_blank\">far more coal<\/a> than a Paris-compliant world can burn. Every extra tonne mined adds to that global oversupply, pushing prices down and keeping coal cheaper for longer. When it comes to the climate transition, it exists to make the trade-offs clear. <\/p>\n<p>Without it, decision-makers \u2014 and democracies \u2014 can\u2019t properly weigh the costs of abandoning fossil fuels or doubling down on their use. The issue is many existing legal frameworks push carbon out of sight, with the Independent Planning Commission\u2019s latest decision being a case in point.<\/p>\n<p>Worryingly, the NSW Minerals Council wants to go further. It is <a href=\"https:\/\/nswmining.com.au\/news\/hvo-approval\/\" rel=\"nofollow noopener\" target=\"_blank\">urging the state<\/a> to legislate to limit legal challenges to coal approvals. This would effectively invert the role of law.
