{"id":920591,"date":"2026-10-08T11:54:15","date_gmt":"2026-10-08T11:54:15","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/920591\/"},"modified":"2026-10-08T11:54:15","modified_gmt":"2026-10-08T11:54:15","slug":"australias-top-court-puts-fossil-fuel-developers-on-notice","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/920591\/","title":{"rendered":"Australia\u2019s top court puts fossil fuel developers on notice"},"content":{"rendered":"<p>Australia\u2019s highest court has just delivered its <a href=\"https:\/\/envirojustice.org.au\/climate-change-in-australias-high-court\/\" rel=\"nofollow noopener\" target=\"_blank\">first-ever decision<\/a> in a climate case. And it could sour the economic argument for developing new coal and gas projects in New South Wales, and possibly Australia.<\/p>\n<p>This High Court judgement is timely \u2013 Australia is co-hosting an international <a href=\"https:\/\/theconversation.com\/1-5-c-to-stay-alive-pacific-countries-demand-the-world-makes-good-on-climate-promises-293539\" rel=\"nofollow noopener\" target=\"_blank\">pre-COP31 climate summit<\/a> in the Pacific this week and is facing <a href=\"https:\/\/www.abc.net.au\/news\/2026-10-05\/pre-cop31-australia-challenged-over-fossil-fuel-expansion\/107220650\" rel=\"nofollow noopener\" target=\"_blank\">renewed pressure<\/a> from Pacific leaders over fossil fuel projects.<\/p>\n<p>The court\u2019s <a href=\"https:\/\/www.hcourt.gov.au\/cases-and-judgments\/judgments\/judgments-1998-current\/mach-energy-australia-pty-ltd-v-denman-aberdeen-muswellbrook-scone-healthy-environment-group-inc\" rel=\"nofollow noopener\" target=\"_blank\">decision on Wednesday<\/a> \u2013 in a case brought by a community group against mining company MACH Energy over a coalmine expansion \u2013 is not a unified legal declaration against fossil fuels. <\/p>\n<p>But this restrained, technical judgement quietly sets a new standard for coal and gas projects in the state \u2013 and potentially across the country. It means planning authorities must consider the whole carbon footprint of these projects, including the emissions produced by customers burning these fossil fuels overseas.<\/p>\n<p>Although the decision concerns one specific coal mine \u2013 MACH Energy\u2019s Mount Pleasant <a href=\"https:\/\/machenergyaustralia.com.au\/mount-pleasant\/\" rel=\"nofollow noopener\" target=\"_blank\">coal mine<\/a> in NSW \u2013 it directly affects the <a href=\"https:\/\/newshub.medianet.com.au\/2026\/10\/high-court-rules-in-favour-of-hunter-valley-community-landmark-climate-ruling-will-reshape-fossil-fuel-approvals-across-australia\/175259\/\" rel=\"nofollow noopener\" target=\"_blank\">17 other<\/a> coal proposals currently in the state\u2019s planning pipeline. <\/p>\n<p>It could also provide a <a href=\"https:\/\/www.corrs.com.au\/insights\/scope-3-emissions-a-regulatory-cloud-soon-to-lift\" rel=\"nofollow noopener\" target=\"_blank\">legal blueprint<\/a> for how courts across the country handle future cases against fossil fuel projects.<\/p>\n<p>            <img decoding=\"async\" alt=\"Coal being loaded into a truck at a quarry.\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/10\/file-20261007-50-2ze8a0.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/p>\n<p>              The case has put fossil fuel companies, including those that mine coal, on notice.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.gettyimages.com.au\/detail\/photo\/loading-of-coal-in-a-quarry-dumper-front-loader-royalty-free-image\/901205926?phrase=coal%20mine&amp;searchscope=image%2Cfilm\" rel=\"nofollow noopener\" target=\"_blank\">EvgenyMiroshnichenko\/Getty<\/a><\/p>\n<p>Remind me, what is climate litigation?<\/p>\n<p><a href=\"https:\/\/www.lse.ac.uk\/granthaminstitute\/explainers\/what-is-climate-change-litigation\/\" rel=\"nofollow noopener\" target=\"_blank\">Climate litigation<\/a> involves taking governments or companies \u2013 and  occasionally individuals \u2013 to court in a bid to hold them responsible for climate harms.<\/p>\n<p>There are <a href=\"https:\/\/www.climatecasechart.com\" rel=\"nofollow noopener\" target=\"_blank\">now thousands<\/a> of these cases worldwide. After the United States and Brazil, Australia has more of these cases than anywhere else: <a href=\"https:\/\/www.lse.ac.uk\/granthaminstitute\/wp-content\/uploads\/2026\/06\/Global-Trends-Summary.pdf\" rel=\"nofollow noopener\" target=\"_blank\">193 cases<\/a> by the end of 2025. This wealth of climate litigation is due to the prevalence of fossil fuel projects in Australia, coupled with lax regulation and high community engagement.<\/p>\n<p>Climate litigation is used because a court can <a href=\"https:\/\/law.unimelb.edu.au\/alumni\/mls-news\/issue-21-june-2019\/waging-a-legal-battle-on-climate-change\" rel=\"nofollow noopener\" target=\"_blank\">legally require<\/a> governments and companies to act, in a way that community opposition or political pressure can\u2019t. It is particularly effective where <a href=\"https:\/\/chicagounbound.uchicago.edu\/cgi\/viewcontent.cgi?article=2727&amp;context=journal_articles\" rel=\"nofollow noopener\" target=\"_blank\">government regulation<\/a> is slow, weak or missing altogether.<\/p>\n<p>      Read more:<br \/>\n      <a href=\"https:\/\/theconversation.com\/climate-litigation-is-on-the-rise-around-the-world-and-australia-is-at-the-head-of-the-pack-210375\" rel=\"nofollow noopener\" target=\"_blank\">Climate litigation is on the rise around the world and Australia is at the head of the pack<\/a><\/p>\n<p>What is this case about?<\/p>\n<p>The Mount Pleasant open-cut <a href=\"https:\/\/www.planningportal.nsw.gov.au\/major-projects\/projects\/mt-pleasant-mod-8-extension-mine-life\" rel=\"nofollow noopener\" target=\"_blank\">coal mine<\/a> sits near Muswellbrook, in NSW\u2019s Hunter Valley. It was originally approved to run until December 2026, digging up to <a href=\"https:\/\/majorprojects.planningportal.nsw.gov.au\/prweb\/PRRestService\/mp\/01\/getContent?AttachRef=DA92%2F97-MOD-8%2120260128T230820.705+GMT\" rel=\"nofollow noopener\" target=\"_blank\">10.5 million tonnes<\/a> of coal each year. <\/p>\n<p>In 2021, the mine\u2019s owner, MACH Energy, sought to <a href=\"https:\/\/machenergyaustralia.com.au\/current-projects\/mount-pleasant-optimisation-project\/\" rel=\"nofollow noopener\" target=\"_blank\">extend its life<\/a> by 22 years, and double its output to 21 million tonnes a year until 2048.<\/p>\n<p>Most of the mine\u2019s climate footprint does not come from the mine itself, but from the burning of the coal it produces. The vast majority of its emissions are classified as \u201c<a href=\"https:\/\/cer.gov.au\/schemes\/national-greenhouse-and-energy-reporting-scheme\/about-emissions-and-energy-data\/emissions-and-energy-types\" rel=\"nofollow noopener\" target=\"_blank\">scope 3<\/a>\u201d \u2013 this includes the emissions produced when the mine\u2019s coal is burned overseas. <\/p>\n<p>In 2022, the Independent Planning Commission, the body that decides on major NSW projects, <a href=\"https:\/\/www.ipcn.nsw.gov.au\/cases\/2022\/05\/mt-pleasant-optimisation-project-ssd-10418\" rel=\"nofollow noopener\" target=\"_blank\">approved the expansion<\/a> of the mine. But a local community group, the Denman Aberdeen Muswellbrook Scone Healthy Environment Group, <a href=\"https:\/\/www.caselaw.nsw.gov.au\/decision\/1914f930614d32e59ceeefd5\" rel=\"nofollow noopener\" target=\"_blank\">challenged that approval<\/a> in the NSW Land and Environment Court. <\/p>\n<p>The community group argued the planning commission had failed to ask how the mine\u2019s emissions would worsen climate change in the Hunter region. The group also argued the commission breached a NSW planning rule that required it to consider imposing conditions to minimise greenhouse gas emissions, including scope 3 emissions, to the \u201c<a href=\"https:\/\/legislation.nsw.gov.au\/view\/whole\/html\/inforce\/current\/epi-2021-0731#sec.2.20\" rel=\"nofollow noopener\" target=\"_blank\">greatest extent practicable<\/a>\u201d.<\/p>\n<p>Although the community group lost in the Land and Environment Court, the NSW Court of Appeal <a href=\"https:\/\/www.austlii.edu.au\/cgi-bin\/viewdoc\/au\/cases\/nsw\/NSWCA\/2025\/163.html\" rel=\"nofollow noopener\" target=\"_blank\">unanimously agreed<\/a> with their arguments, and declared the approval invalid in July 2025. MACH Energy <a href=\"https:\/\/www.theguardian.com\/environment\/2026\/oct\/07\/mount-pleasant-coalmine-case-high-court-climate-change-hunter-valley\" rel=\"nofollow noopener\" target=\"_blank\">appealed this decision<\/a>, bringing the case to the High Court in May this year.<\/p>\n<p>            <img decoding=\"async\" alt=\"Hot air balloons float over a lush, green valley at sunrise.\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/10\/file-20261007-70-12lcgz.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/p>\n<p>              The Hunter Valley is renowned for its thriving wine industry and picturesque landscapes.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.gettyimages.com.au\/detail\/photo\/hot-air-balloons-in-pokolbin-wine-region-during-royalty-free-image\/2156575368?phrase=Hunter%20valley%20australia&amp;searchscope=image%2Cfilm\" rel=\"nofollow noopener\" target=\"_blank\">Ben Graham\/Getty<\/a><\/p>\n<p>What did the High Court decide?<\/p>\n<p>The High Court\u2019s decision to oppose the Mount Pleasant mine expansion was <a href=\"https:\/\/www.theguardian.com\/environment\/2026\/oct\/07\/mount-pleasant-coalmine-case-high-court-climate-change-hunter-valley\" rel=\"nofollow noopener\" target=\"_blank\">not unified<\/a>: three judges were in favour, and two against.<\/p>\n<p>The three judges in favour reached the same conclusion. They ruled the Independent Planning Commission didn\u2019t do enough to assess the mine\u2019s scope 3 emissions, or how these might be mitigated or reduced.<\/p>\n<p>They also rejected the idea that scope 3 emissions, when they happen overseas, are someone else\u2019s problem. As <a href=\"https:\/\/www.hcourt.gov.au\/cases-and-judgments\/judgments\/judgments-1998-current\/mach-energy-australia-pty-ltd-v-denman-aberdeen-muswellbrook-scone-healthy-environment-group-inc\" rel=\"nofollow noopener\" target=\"_blank\">Justice Michelle Gordon<\/a> put it, these emissions have the same detrimental impact no matter how they are categorised.<\/p>\n<p>This means that for every NSW coal or gas project approval, decision-makers must now consider imposing conditions to deal with scope 3 emissions, such as requiring companies to buy <a href=\"https:\/\/www.climatecouncil.org.au\/resources\/carbon-offsetting-worthwhile\/\" rel=\"nofollow noopener\" target=\"_blank\">carbon offsets<\/a>.<\/p>\n<p>However, offsets are no silver bullet, as they allow companies <a href=\"https:\/\/www.climatecouncil.org.au\/resources\/carbon-offsetting-worthwhile\/\" rel=\"nofollow noopener\" target=\"_blank\">to compensate<\/a> for their current emissions and effectively keep burning the same amount of fossil fuels.<\/p>\n<p>            <img decoding=\"async\" alt=\"Community members gather outside the High Court of Australia, holding placards about coal mine.\" src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/10\/file-20261007-60-ye4a76.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/p>\n<p>              Supporters of a Hunter Valley community group gather outside the High Court of Australia.<br \/>\n              <a class=\"source\" href=\"https:\/\/photos.aap.com.au\/search\/high%20court%20denman\" rel=\"nofollow noopener\" target=\"_blank\">Dan Himbrechts\/AAP<\/a><\/p>\n<p>What comes next<\/p>\n<p>Community groups now have a clear, High Court-endorsed basis to challenge approvals where authorities haven\u2019t properly assessed a project\u2019s full carbon footprint. <\/p>\n<p>In NSW, developers of future coal projects will be expected to propose ways to curb their scope 3 emissions, potentially at significant cost. This could dramatically reshape the <a href=\"https:\/\/theconversation.com\/making-fossil-fuel-companies-accountable-for-their-products-emissions-would-support-the-clean-energy-transition-219659\" rel=\"nofollow noopener\" target=\"_blank\">economic case<\/a> for continued fossil fuel production in Australia.<\/p>\n<p>The case now returns to the NSW Land and Environment Court, which can suspend the operation of the mine or set conditions on its scope 3 emissions. The latter option, however, may be extremely expensive for MACH Energy. <\/p>\n<p>The High Court\u2019s decision is consistent with other recent rulings across the globe. <\/p>\n<p>In <a href=\"https:\/\/www.climatecasechart.com\/document\/greenpeace-nordic-and-others-v-norway_0687\" rel=\"nofollow noopener\" target=\"_blank\">Norway<\/a> and the <a href=\"https:\/\/www.climatecasechart.com\/document\/r-finch-on-behalf-of-the-weald-action-group-others-v-surrey-county-council-others_e6d3\" rel=\"nofollow noopener\" target=\"_blank\">United Kingdom<\/a>, courts have required decision-makers to deal with all greenhouse gas emissions linked to fossil fuel projects, not just those from the project site itself. <\/p>\n<p>And last year, the <a href=\"https:\/\/theconversation.com\/worlds-highest-court-issues-groundbreaking-ruling-for-climate-action-heres-what-it-means-for-australia-261842\" rel=\"nofollow noopener\" target=\"_blank\">International Court of Justice<\/a> found countries are legally required to assess the effects of fossil fuel projects, both in their own jurisdictions and overseas.<\/p>\n<p>While the High Court\u2019s ruling is focused on NSW law, courts and decision-makers across Australia are paying close attention.
