{"id":922388,"date":"2026-10-09T23:28:18","date_gmt":"2026-10-09T23:28:18","guid":{"rendered":"https:\/\/www.newsbeep.com\/au\/922388\/"},"modified":"2026-10-09T23:28:18","modified_gmt":"2026-10-09T23:28:18","slug":"man-fined-10k-over-illegal-dump-that-left-whittlesea-city-council-with-3m-clean-up-bill","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/au\/922388\/","title":{"rendered":"Man fined $10k over illegal dump that left Whittlesea City Council with $3m clean-up bill"},"content":{"rendered":"<p class=\"paragraph_paragraph___QITb\">A man has been fined $10,000 for running an illegal tip on land leased from a suburban Melbourne council, but that penalty was a fraction of the $3 million clean-up bill the council was left with.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Mohamad Yassin Yousef Sadek was convicted of environmental offences in August in the Heidelberg Magistrates&#8217; Court, where he was also ordered to pay $5,000 to the Environmental Protection Agency (EPA) to cover its costs.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The EPA prosecuted the case, alleging Sadek was a leaseholder on land owned by Whittlesea City Council in 2021 when he did deals with truck drivers to illegally accept industrial waste from their worksites over two months.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The EPA said 11,000 tonnes of contaminated soil and industrial rubbish later had to be cleared from the property in Wollert on Melbourne&#8217;s northern fringe.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Some of the waste contained asbestos.<\/p>\n<p><img decoding=\"async\" alt=\"Contaminated soil dumped illegally in Wollert\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/10\/30255d3434ed1eec83544015d5f182d8.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">The EPA found asbestos in soil tested from a number of locations on the property. (Supplied: EPA)<\/p>\n<p class=\"paragraph_paragraph___QITb\">The clean-up cost local ratepayers $3 million.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Environmental law expert Brad Jessup said Victoria has an illegal dumping problem, and he was concerned small penalties created a financial incentive for polluters.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;This is an example where the fine was likely less than the costs of [lawfully] disposing of the waste,&#8221; Dr Jessup said.<\/p>\n<p>&#8220;So if you are an unethical business operator, what you&#8217;re seeing in this judgement is business opportunity.&#8221;EPA discovers illegal dumping via tip-off<\/p>\n<p class=\"paragraph_paragraph___QITb\">EPA inspectors first visited the council-owned land in September 2021 following a tip-off that waste was being illegally stored there.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;EPA officers observed built-up areas of mudstone and crushed rock material, textiles, brick fragments, metal, timber and grey fibrous cement materials,&#8221; the agency said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">It said soil testing detected asbestos at seven locations on the property.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2026-06-10\/melbourne-councils-struggling-to-clean-up-illegal-waste\/106746440\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Melbourne councils plead for help as illegal rubbish dumping increases<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Melbourne councils are struggling to combat the rise of illegal dumping, despite over $21 million of funding from the Victorian state government.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The EPA said Sadek failed to comply with environmental notices it issued over a nearly two-year period.<\/p>\n<p class=\"paragraph_paragraph___QITb\">In July 2023, the EPA ordered the council, as landowner, to remove all industrial waste.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The EPA reported the council had to clear more than 300 truck and trailer loads of contaminated soil and waste from the property, which came with a multi-million-dollar cost.<\/p>\n<p class=\"paragraph_paragraph___QITb\">It took another three years after this for the criminal case against Sadek to be finalised.<\/p>\n<p class=\"paragraph_paragraph___QITb\">In a statement to the ABC, Whittlesea City Council said the scale of environmental damage to its land was significant.<\/p>\n<p><img decoding=\"async\" alt=\"A contemporary appearing building with a sign saying &quot;COUNCIL OFFICES GREAT HALL&quot; it said.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;With the criminal proceedings against the sub tenants now concluded and majority of the remediation works completed, council is considering all available options to recover the costs incurred.&#8221;<\/p>\n<p>Calls for larger penalties for polluters\u00a0<\/p>\n<p class=\"paragraph_paragraph___QITb\">Dr Jessup said environmental laws had been reformed in recent years, giving prosecutors the power to seek larger fines for polluters and strip them of the proceeds of their offending.<\/p>\n<p class=\"paragraph_paragraph___QITb\">In Sadek&#8217;s case, neither of those powers were used.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The legal expert said part of the issue was that the EPA preferred to prosecute environmental matters in the magistrates&#8217; court.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;The magistrates&#8217; court has caps and has limits on the kind of fines it can issue, and there is less willingness to engage with some of the more complex legal topics around sentencing,&#8221;
