(Supplied: Firmus Technologies)<\/p>\n<p class=\"paragraph_paragraph___QITb\">Firmus, however, has appealed <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-09-15\/firmus-technologies-lodge-tascat-appeal-for-generator-use\/107144572\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/107144572\" rel=\"nofollow noopener\" target=\"_blank\">that condition through the Tasmanian Civil and Administrative Tribunal (TASCAT<\/a>), arguing it wanted to use the generators &#8220;for limited augmentation of the mains electricity supply to offset curtailment, manage energy security and maintain operational reliability during periods of energy market stress&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Tasmania&#8217;s Environment Protection Authority (EPA) board has now applied to TASCAT to join as a party to Firmus&#8217;s appeal.<\/p>\n<p>EPA likely to have assessed project if proposed use was higher<\/p>\n<p class=\"paragraph_paragraph___QITb\">In its October 7 submission, seen by the ABC, the board said it was originally told the generators would be used &#8220;just for emergency use in the event of a power failure&#8221;, and would not be used during normal operation other than for scheduled weekly exercise runs of less than two hours, annual load tests, and utility outage events.<\/p>\n<p class=\"paragraph_paragraph___QITb\">The board said Firmus&#8217;s recent appeal showed it planned on using the generators in more circumstances than it thought.<\/p>\n<p><img decoding=\"async\" alt=\"Three men standing outside a building that says 'Firmus'.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/10\/1791596891_275_026837053169fe4b3124fcd7deb1300b.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Tasmanian Premier Jeremy Rockliff (centre) with co-CEOs Tim Rosenfield and Oliver Curtis at the Firmus Technologies site. (Supplied: Tasmanian government)<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;That variation, if part of the original proposal, would likely have resulted in the Board making a different decision in relation to whether to assess the proposal,&#8221; the board said.<\/p>\n<p>&#8220;Seeking to enlarge the use of the diesel generators post-approval undermines the Board&#8217;s determination and changes the environmental risk profile posed by the activity.&#8221;<\/p>\n<p class=\"paragraph_paragraph___QITb\">It pointed out that if Firmus&#8217;s appeal against the condition around generator use is upheld, it could allow it to subvert EPA processes it likely would have been subjected to &#8220;if the proposal had been accurately presented&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">&#8220;And further, if upheld, the appeal has the potential to permit an activity in circumstances where the environmental risks have not been properly assessed, which may result in environmental harm including nuisance \u2026 necessitating the EPA taking enforcement action in respect of it,&#8221; it said.<\/p>\n<p><img decoding=\"async\" alt=\"Piles of rocky dirt foregounds a construction site with yellow machinery in a hazy valley dotted with homes.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/au\/wp-content\/uploads\/2026\/10\/2fa2c9a6f52d482d85096aa6ec4180f0.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Construction underway at Firmus&#8217;s St Leonards site. (ABC News: Morgan Timms)<\/p>\n<p class=\"paragraph_paragraph___QITb\">The EPA board said it would not comment on matters currently being considered by TASCAT, and Firmus declined to comment on the matter.<\/p>\n<p class=\"paragraph_paragraph___QITb\">A state government spokesperson said it was supportive of private investments that created jobs and economic benefits but &#8220;projects should use resources responsibly and engage transparently with communities&#8221;.<\/p>\n<p class=\"paragraph_paragraph___QITb\">Greens MP Tabatha Badger said she welcomed the EPA raising concerns and pointing out the potential for the generators to breach acceptable limits and for noise to carry across the river.\u00a0<\/p>\n<p>&#8220;Victoria is already moving towards rules for AI data centres that ensure diesel generators are only used only as a back-up.
