\u201cThis includes if the alteration was temporary.<\/p>\n
\u201cThe fact that people are not able to easily remove the graffiti from their vehicles suggests that this would likely amount to malicious property damage.\u201d<\/p>\n
The penalties for damaging property are severe nationwide, but particularly in NSW, damaging property carries a maximum penalty of five years\u2019 imprisonment (or up to 10 to 12 years if caused by fire or explosives, and six years if committed in company) under Section 195 of the Crimes Act 1900.<\/p>\n
What does the law say about parking over driveways?<\/p>\n
While the resident\u2019s paint reaction could land him behind bars, the drivers who obstructed his access aren\u2019t off the hook either.<\/p>\n
Under Australian Road Rule 198, drivers are strictly prohibited from stopping on a road in a position that obstructs access by vehicles or pedestrians to or from a driveway or passageway, unless driving a public bus dropping off or picking up passengers.<\/p>\n
Across Australia, the maximum penalty for breaching this road rule in court is a fine of up to $2200, alongside council infringement notices and the risk of having the vehicle towed at the owner\u2019s expense.<\/p>\n
