NASCAR has filed a 59-page exhibit list detailing pieces of evidence it could use when an antitrust lawsuit trial against 23XI Racing and Front Row Motorsports begins on Dec. 1.

The two Cup Series teams filed this lawsuit last October, “arguing that the stock car racing circuit and its leadership have used anti-competitive practices to prevent fair competition in the sport.” A year of hearings, rulings, and an appeal have led to this point, and now the two sides of this lawsuit will meet in a Charlotte courthouse.

According to a pre-Thanksgiving filing, the legal team representing NASCAR and CEO Jim France will cover many topics while presenting as the Defendants. This could include such things as the 2025 Charter Agreement and the negotiations leading up to it, the financial aspects of the sport, the media rights agreement, and driver contracts.

The financial aspect will likely be a significant part of this trial. 23XI Racing and Front Row Motorsports listed Jim France’s W-2s, 1099-NECs, and tax returns on its exhibit list.

NASCAR could include photos of Airspeed, the state-of-the-art facility housing 23XI Racing in Huntersville, North Carolina. This new facility with its unique design and lights is easily seen when traveling up and down I-77.

The exhibit list also confirmed that the legal team could include a photo of Michael Jordan’s yacht, “Catch 23,” and 30 handwritten notes from 23XI Racing co-owner Curtis Polk, who NASCAR named as a defendant in a previous countersuit.

For example, the 59-page exhibit list features several driver and personal services agreements. This includes those for Tyler Reddick, Bubba Wallace, Riley Herbst, Zane Smith, Noah Gragson, and Todd Gilliland.

The exhibit list also has a driver agreement for Ty Dillon, who previously suited up for 23XI Racing during the 2021 Busch Clash. He took over the No. 23 Toyota Camry as Wallace did not meet the eligibility requirements for the event.

Like the 44-page filing from 23XI Racing and Front Row Motorsports, NASCAR’s exhibit list features dozens of unsealed message threads between key parties involved in the charter negotiations and this lawsuit. The list specifically includes emails between 23XI Racing executives such as co-owner Denny Hamlin, co-owner Michael Jordan, co-owner Curtis Polk, and President Steve Lauletta.

NASCAR’s exhibit list also includes emails and texts involving Front Row Motorsports owner Bob Jenkins, General Manager Jerry Freeze, and other NASCAR team owners. Some of these emails have descriptions tying them to charter purchase agreements. Others will remain relatively vague until the legal team details them in front of the jury.

Some items appeared on both exhibit lists filed to the PACER online service hosting documents related to this lawsuit. This includes sanction agreements between NASCAR and tracks on the schedule, such as Atlanta Motor Speedway.

These exhibit lists are not a perfect representation of the upcoming talking points during trial. These legal teams may not use everything listed in the respective documents.
