At one point, it looked like Roger Penske was going to take the stand. Now, the NASCAR antitrust lawsuit has been settled. The sanctioning body and Jim France settled with 23XI Racing and Front Row Motorsports this morning.
Roger Penske is a respected team owner. His influence on NASCAR and motorsports as a whole cannot be overstated. This lawsuit was just as important to Penske as it was to any other team owner. With IndyCar adopting a charter system recently, it could have even set a legal precedent for an antitrust case directed at the series, which Penske owns.
Like Rick Hendrick, Penske is relieved that this case ended in a settlement. On top of that, Penske now has three permanent charters in the Cup Series thanks to said settlement.
“Today’s settlement is tremendous news for the industry,” Penske said in a statement. “We are stronger together as a sport and the agreement today allows all of us to focus on what’s important, the continued growth of NASCAR. The sport has never been more competitive and today’s resolution provides the entire industry with a platform that strengthens our business and allows us to continue to entertain our millions of passionate fans in a unified way.”
Wood Brothers Racing had a similar statement to Roger Penske. Much simpler, though. “Great news.” That’s it. Two words.

So, Roger Penske is happy to see a settlement. A lot of NASCAR fans are also happy to see the case end this way. While there is merit to letting the case go to a jury deliberation, both sides had a lot to lose in that uncertain circumstance. A settlement was always going to be the best way for these two sides to move forward.
Roger Penske joins Rick Hendrick in settlement sentiments
While most teams opted not to join this lawsuit, they will reap the rewards of it. At least, when it comes to permanent charters. That was the big ask the teams kept pursuing in negotiations, and NASCAR would not concede. There were other concessions made that will change the charter agreement.
Rick Hendrick is one of the most successful and storied team owners in the sport. He is happy to see this come to an end. As are most NASCAR fans. His reaction was much like Roger Penske’s.
“Millions of loyal NASCAR fans and thousands of hardworking people rely on our industry, and today’s resolution allows all of us to focus on what truly matters – the future of our sport,” Hendrick said in a statement. “For more than 40 years, NASCAR racing has been my passion. I believe deeply in what we can accomplish when we work together.
“This moment presents an important opportunity to strengthen our relationships and recommit ourselves to building a collaborative and prosperous future for all stakeholders. I’m incredibly optimistic about what’s ahead. When our industry is united, there’s no limit to how far we can go or how much we can grow the sport we love.”
