The joint trial of an Ottawa man and woman accused of killing a seven-week-old boy continued this week with the infant’s biological father testifying that he’d expressed his concerns about the mother to authorities months before his son’s death in October 2021.
Boravy Buth, the infant’s mother, and Patrick O’Connor, her partner at the time, are each charged with second-degree murder. Buth is also charged with criminal negligence causing death.

Buth’s assault charge was withdrawn and she entered into a peace bond, agreeing not to communicate directly with the witness. He said he learned through legal counsel that Buth was by then pregnant with their third child.
By the time that child was born, Buth was living with O’Connor, her co-accused. The infant died on Oct. 26, 2021, at just seven weeks old.
Charges upgraded
According to an Ottawa police officer who testified earlier in the trial, Buth said the baby had fallen off the bed in the middle of the night.
Following a 16-month investigation, Buth and O’Connor were initially charged with failing to provide the necessaries of life. Those charges were later upgraded.
Both have pleaded not guilty.
Under cross-examination this week, defense lawyers pointed to the biological father’s struggles with addiction and suggested he was a controlling partner.
The witness acknowledged that he could have done more to help with raising the kids, and admitted he wasn’t always sober. He also acknowledged an “element” of control in the relationship, but noted the family was living in his home, using his vehicle and relying solely on his income.
The jury trial is expected to last eight weeks.
