Retired Salmon Arm lawyer facing sexual harassment allegation of past client

A retired Salmon Arm lawyer was cited by the Law Society of B.C. (LSBC) regarding alleged sexual harassment of a past client.
The Aug. 5 citation was sent to Ian Frank McTavish, advising him of a yet-to-be-scheduled hearing, to be conducted by the LSBC’s discipline committee, inquiring into his “conduct or competence” between Sept. 9, 2023 and July 31, 2024, when he was still a member of the Law Society.
According to the LSBC citation, McTavish is alleged to have sexually harassed a client he was representing in a family law matter, contravening the rules of the Code of Professional Conduct For British Columbia by doing one or more of the following:
• making unwelcome sexual comments, innuendoes, invitations, or advances toward the Client;
• engaging in unsolicited or unwelcome physical contact or touching of the Client; and
• communicating with the Client in a manner that was offensive or inconsistent with the proper tone of a professional communication from a lawyer.
The citation advises should McTavish fail to appear for the hearing, the Hearing Panel may proceed in his absence.
McTavish retired in 2024 after 51 years in law.
