Update on the lawsuit between 23XI Racing, Front Row Motorsports and NASCAR

23XI Racing and Front Row Motorsports are currently in a lawsuit against NASCAR. The teams are claiming antitrust violations regarding the latest charter agreements.

The trial is set to begin in December.

Last week, multiple team owners issues Declarations to the court. The baseline sentiment of all the letters was that the lawsuit needed to end or risk major disruptions to the sport.

“In addition to the parties’ willingness to resolve this matter, other race teams, this Court, and the Fourth Circuit Court of Appeals have also encouraged settlement discussions.”

On Monday night, NASCAR asked the court to gather a judicial settlement conference.

“The parties’ readiness to resolve this matter, along with the interests of others in the sport and the Court to see this case resolved, suggest a judicial settlement conference would be a meaningful way to facilitate a settlement.”

“The parties have indicated a willingness to resolve this case and have attempted to do so through mediation and settlement conferences. Other Charter holders have now indicated that their desire is that this litigation be resolved.”

“Accordingly, NASCAR believes that the parties would benefit from a facilitated settlement discussion with a distinguished member of the bench who could provide unique insight into a jury trial in a complex matter such as this one in front of a jury in this District.”

“Recognizing the value of a judicial settlement conference, this Court has previously indicated a willingness to offer a judicial settlement conference at a similar stage in the proceedings: after efforts with a private mediator and following the close of discovery and filing of summary judgment motions.”

Michael Jordan previously said the teams are open to a settlement

NASCAR and the teams have been back-and-forth in the courts regarding trivial aspects of the lawsuit before the antitrust trial begins.

In August, Jordan said, “I look forward to going down to fire. If I have to fight this to the end, for the betterment of the sport, I will.”

However, he added, “We’ve always been open to a settlement. Always have been. We’ve never taken that off the table.”
