A jury has declared a mistrial in the case of a mother accused of killing her seven-week-old son in Ottawa in 2021 but has found her partner at the time guilty of second-degree murder.

Boravy Buth and Patrick O’Connor were on trial for second-degree murder in the death of the infant, whom CBC is not identifying.

Buth was also charged with criminal negligence causing death, but a mistrial was declared on both of those charges early Sunday evening.

O’Connor was found guilty of the lone charge against him.

During the trial, a forensic pathologist likened the boy’s injuries to something seen after a vehicle collision or a fall from a significant height.

The two defence lawyers attempted to pin the guilt for the child’s death on each other’s clients during their closing statements.
