The Supreme Court of the United States will allow Brian Flores’ lawsuit against the NFL (and several teams) to proceed toward open court after the justices “rebuffed an appeal from the league, which wanted the case handled through its arbitration process,” according to the Associated Press.
“The NFL must now accept that its commissioner cannot be the arbitrator over discrimination claims against the league and its teams. We look forward to litigating these claims in court,” David Gottlieb and Douglas Wigdor, the attorneys representing Flores, said in a statement.

Flores, 45, filed his lawsuit in 2022, accusing the NFL of racism in hiring. In addition to the league, the lawsuit also named the Denver Broncos, New York Giants, Houston Texans and Miami Dolphins. Flores accused Denver of interviewing him for their head coach opening in 2021 merely to satisfy the NFL’s Rooney Rule. The Broncos denied those allegations in 2022, calling them “blatantly false.”
Flores now serves as a defensive coordinator for the Minnesota Vikings. Denver put in a request to interview Flores for its DC position in 2023, but he opted to join the Vikings, and the Broncos ultimately hired Vance Joseph instead.
