In early 2024, Nicholas Bavas of Dallas County, Iowa, placed five parlay bets with DraftKings based on the projected leaderboard at the <a href=\"https:\/\/www.attpbgolf.com\" target=\"_blank\" rel=\"noopener external nofollow\">AT&amp;T Pebble Beach Pro\u2011Am<\/a>. <\/p>\n<p data-start=\"108\" data-end=\"183\">Confident that bad weather would halt the final round, he locked in his picks; including winner <a href=\"https:\/\/www.pgatour.com\/player\/51766\/wyndham-clark\" target=\"_blank\" rel=\"noopener external nofollow\">Wyndham Clark<\/a>\u2013matching the top\u201120 finishers in their exact order.\u00a0<\/p>\n<p data-start=\"547\" data-end=\"624\">According to <a href=\"https:\/\/www.desmoinesregister.com\/story\/sports\/2025\/05\/30\/iowa-bettor-sues-draftkings-over-14-2m-in-winnings\/83924918007\/\" target=\"_blank\" rel=\"noopener external nofollow\">Des Moines Register<\/a>:<\/p>\n<p data-start=\"547\" data-end=\"624\">10:18 p.m.\u2013 Bavas wagered $25 on a parlay picking the top 20 finishers in any order, with a potential $250,068 payout.<\/p>\n<p data-start=\"547\" data-end=\"624\">11:22 p.m.\u2013 He placed a $50 parlay identical to his first bet, worth up to $2.3 million.<\/p>\n<p data-start=\"547\" data-end=\"624\">11:59 p.m.\u2013 A $100 repeat of the same parlay pushed the possible payout to $4.65 million.<\/p>\n<p data-start=\"547\" data-end=\"624\">12:01 a.m.\u2013 His final $50 ticket mirrored the earlier $50 bet, again carrying a $2.3 million return.<\/p>\n<p data-start=\"108\" data-end=\"183\">When the PGA Tour called the tournament at 54 holes, those bets lined up perfectly for a staggering $14.2 million payday. But DraftKings refused to pay. Instead, it voided the wagers and refunded his stakes, citing its \u201c<a href=\"https:\/\/sportsbook.draftkings.com\/help\/sport-rules\/golf\" target=\"_blank\" rel=\"noopener external nofollow\">Tournament Futures Winner<\/a>\u201d rule.<\/p>\n<p data-start=\"185\" data-end=\"260\">The fallout sparked outrage. Bavas responded by suing the sportsbook for breach of contract and consumer fraud. Thus, even if the \u201cwinner\u201d part of each bet was voided, the remaining picks should have been recalculated and paid out accordingly.<\/p>\n<p>DraftKings Pushes Back with Fine Print and Legal Defenses<\/p>\n<p data-start=\"333\" data-end=\"408\"><a href=\"https:\/\/www.draftkings.com\" target=\"_blank\" rel=\"noopener external nofollow\">DraftKings<\/a> hasn\u2019t held back in its defense. In a sprawling <a href=\"https:\/\/www.aol.com\/gambler-sues-draftkings-claims-online-152417294.html\" target=\"_blank\" rel=\"noopener external nofollow\">52\u2011page filing<\/a>, the company listed 19 separate affirmative defenses, including the claim that Bavas \u201cknowingly accepted the risk\u201d that unforeseen circumstances could affect odds or payouts. Their position hinges on the user\u2019s agreement to DraftKings\u2019 terms of use\u2013language that, they assert, absolves them of liability in such situations.<\/p>\n<p data-start=\"410\" data-end=\"485\">Further, the company accuses Bavas of <a href=\"https:\/\/www.kcci.com\/article\/nicholas-bavas-iowa-draftkings-betting-lawsuit\/64921007\" target=\"_blank\" rel=\"noopener external nofollow\">acting in bad faith<\/a>, suggesting he is exploiting contractual loopholes for financial gain. The filing claims that he either misinterpreted the fine print or is deliberately using precise contractual language to undermine DraftKings\u2019 contractual protections. In their view, Bavas\u2019 claim is less about gambling strategy and more about gaming the system.<\/p>\n<p>Fair Play vs. Fine Print<\/p>\n<p data-start=\"547\" data-end=\"624\">At its core, this dispute <a href=\"https:\/\/www.newsweek.com\/sports\/golf\/draftkings-sued-14-million-pga-tour-pebble-beach-result-2079169\" target=\"_blank\" rel=\"noopener external nofollow\">underscores the tension<\/a> between customer expectations and legal fine print. Bavas maintains that if players lose under rain-shortened conditions, DraftKings offers no refunds. Yet when a win materializes\u2013albeit complicated by weather and timing; the same rules are wielded to void bets.
