{"id":106939,"date":"2025-08-30T03:50:12","date_gmt":"2025-08-30T03:50:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/106939\/"},"modified":"2025-08-30T03:50:12","modified_gmt":"2025-08-30T03:50:12","slug":"nascar-argues-injunction-demand-by-23xi-front-row-is-moot","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/106939\/","title":{"rendered":"NASCAR Argues Injunction Demand by 23XI, Front Row Is Moot"},"content":{"rendered":"<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe latest turn in the <a href=\"https:\/\/www.sportico.com\/t\/antitrust\/\" id=\"auto-tag_antitrust_1\" data-tag=\"antitrust\" rel=\"nofollow noopener\" target=\"_blank\">antitrust<\/a> litigation pitting 23XI Racing and Front Row Motorsports against <a href=\"https:\/\/www.sportico.com\/t\/nascar\/\" id=\"auto-tag_nascar_1\" data-tag=\"nascar\" rel=\"nofollow noopener\" target=\"_blank\">NASCAR<\/a> has NASCAR saying the two teams\u2019 demand for a preliminary injunction is now much ado about nothing.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIn a brief authored by Christopher S. Yates and other attorneys from Latham &amp; Watkins and Shumaker, Loop &amp; Kendrick, NASCAR on Friday says it has voluntarily agreed to \u201climit its lawful business conduct\u201d for the period of time until completion of a jury trial scheduled to begin on Dec. 1 in North Carolina. NASCAR asserts it will take steps in response to U.S. District Judge Kenneth D. Bell\u2019s \u201cconcerns about the potential for the creation of juror bias\u201d before a trial starts. Bell held a hearing with attorneys for the teams and NASCAR on Thursday.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tMore specifically, NASCAR says that up to six open teams will be eligible for starting grid positions for the remainder of the 2025 Cup Series Season. The association also pledges to not sell any additional charters for the season. Further, while there are two inactive charters previously held by Stewart-Haas Racing, NASCAR promises to not \u201ceffectuate a sale\u201d of those charters without Bell\u2019s blessing.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tNASCAR suggests its willingness to permit 23XI and Front Row to compete as open teams for the remainder of the season renders moot the two teams\u2019 demand for an injunction.\u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAs has been litigated intensely over the last year, 23XI and Front Row want to compete with the same benefits as charter teams without relinquishing their legal claims. NASCAR hopes Bell will conclude the two teams aren\u2019t harmed by status as open teams rather than charter teams, and thus those teams\u2019 drivers, including Tyler Reddick and <a href=\"https:\/\/www.sportico.com\/t\/bubba-wallace\/\" id=\"auto-tag_bubba-wallace_1\" data-tag=\"bubba-wallace\" rel=\"nofollow noopener\" target=\"_blank\">Bubba Wallace<\/a>, as well as teams\u2019 sponsors and business partners wouldn\u2019t see reason to cut ties. If Bell doesn\u2019t believe 23XI and Front Row would be harmed in the absence of an injunction, he\u2019d be less inclined to order an injunction.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tJeffrey Kessler, who is lead attorney for 23XI and Front Row in the litigation, argues not so fast in a statement mentioned in NASCAR\u2019s filing and sent to the media by email.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tKessler says that his clients \u201cdo not agree\u201d that their demand for an injunction has been rendered moot. He also disputes NASCAR\u2019s \u201crepresentations\u201d that 23XI and Front Row wouldn\u2019t face irreparable harm without an injunction.
