23XI Racing and Front Row Motorsports on Tuesday \u201cargued to a federal judge why the organizations still should be issued a preliminary injunction to be recognized as chartered organizations\u201d until their antitrust lawsuit against NASCAR is finished. The 11-page filing in U.S. District Court for the Western District of North Carolina was in response to NASCAR notifying Judge Kenneth Bell it \u201cwould\u202fnot re-distribute any charters<\/a> to new participants\u202fwhile the case heads toward its Dec. 1 court date.\u201d NASCAR\u2019s backtrack Friday came one day after an \u201cacrimonious hearing that included the disclosure of\u202fexpletive-laden emails and text messages<\/a>\u201d from 23XI co-owner Michael Jordan and other high-profile litigants. Jeffrey Kessler, the attorney for the two teams, also argued that NASCAR agreeing not to redistribute any charters now \u201cdoes not moot Plaintiffs\u2019 Motion for Preliminary Injunction or eliminate Plaintiffs\u2019 irreparable harm if no relief is provided\u201d (AP, 9\/2<\/a>).<\/p>\n

If 23XI and FRM \u201cdon\u2019t get their desired outcome in court this week, it\u2019ll mean a lot of money for Cup Series teams, NASCAR says — to the tune of\u201d $1.5M per charter. In a letter, NASCAR Commissioner Steve Phelps \u201cdirectly addressed\u201d the 13 Cup Series teams that signed the charter agreement that went into effect at the beginning of the 2025 season.
