{"id":123335,"date":"2025-09-06T03:08:08","date_gmt":"2025-09-06T03:08:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/123335\/"},"modified":"2025-09-06T03:08:08","modified_gmt":"2025-09-06T03:08:08","slug":"broadband-associations-back-cox-in-fight-with-music-industry-09-08-2025","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/123335\/","title":{"rendered":"Broadband Associations Back Cox In Fight With Music Industry 09\/08\/2025"},"content":{"rendered":"<p class=\"western\">Organizations representing broadband carriers are urging the Supreme Court to reverse a lower court decision holding Cox Communications responsible for subscribers&#8217; piracy, arguing<br \/>\nthat the ruling could result in millions of people losing the ability to go online.<\/p>\n<p class=\"western\">That decision, issued by the 4th Circuit Court of Appeals, &#8220;will be disastrous for Internet<br \/>\naccess, broadband deployment, and the digital economy,&#8221; organizations including US Telecom&#8211;The Broadband Association and CTIA&#8211;The Wireless Association say in a <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/24\/24-171\/373825\/20250905131135214_24-171%20Amici%20Brief.pdf\" rel=\"nofollow noopener\" target=\"_blank\">friend-of-the-court brief<\/a> filed Friday with the Supreme Court.<\/p>\n<p class=\"western\">The groups add that the 4th Circuit&#8217;s ruling would expose internet service providers &#8220;to the risk of ten-figure judgments unless they terminate subscribers upon receipt of barebones,<br \/>\nunverifiable notices that typically consist of little more than a timestamp and an IP address.&#8221;<\/p>\n<p>advertisement<\/p>\n<p>advertisement<\/p>\n<p class=\"western\">They are weighing in on a battle dating to 2018, when Sony Music Entertainment<br \/>\nand other music companies sued Cox for facilitating piracy by allegedly failing to disconnect subcribers who were accused of illegally downloading music.<\/p>\n<p class=\"western\">Sony and others<br \/>\nclaimed they sent \u201chundreds of thousands\u201d of notifications about piracy to Cox, and that the company failed to terminate repeat offenders.<\/p>\n<p class=\"western\">Cox was found liable and,<br \/>\nin late 2019, a jury ordered the broadband provider to pay $1 billion to the record companies &#8212; or nearly $100,000 per work for around 10,000 pieces of downloaded or shared music.<\/p>\n<p class=\"western\">Cox appealed to the 4th Circuit Court of Appeals, which upheld a finding that Cox contributed to copyright infringement by failing to disconnect alleged file-sharers, but\u00a0<a href=\"https:\/\/www.mediapost.com\/publications\/article\/393657\/court-vacates-1-billion-judgment-against-cox-over.html?edition=\" rel=\"nofollow noopener\" target=\"_blank\">returned the matter<\/a>\u00a0to the trial court for a new trial on<br \/>\ndamages.<\/p>\n<p class=\"western\">Cox is now appealing to the Supreme Court.
