Now, the organization has launched an appeal in hopes of preserving this enforcement strategy.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tSoundExchange\u2019s notice of appeal on Friday (Sept. 5) challenges an August <a href=\"https:\/\/www.billboard.com\/pro\/siriusxm-beats-royalties-lawsuit-soundexchange-cant-sue\/\" rel=\"nofollow noopener\" target=\"_blank\">federal court ruling<\/a> that dismissed its $400 million lawsuit against SiriusXM. Judge Naomi Reice Buchwald held in her decision that SoundExchange, a nonprofit designated by the Copyright Royalty Board to collect performance royalties for artists, does not actually have the right to sue anybody under federal law.<\/p>\n<p>\t\t\t\t\tRelated\t\t<\/p>\n<p>\t\t\t<a href=\"https:\/\/www.billboard.com\/pro\/siriusxm-beats-royalties-lawsuit-soundexchange-cant-sue\/\" class=\"c-lazy-image__link lrv-a-unstyle-link\" rel=\"nofollow noopener\" target=\"_blank\"><\/p>\n<p>\t\t\t\t\t\t<img decoding=\"async\" class=\"c-lazy-image__img lrv-u-background-color-grey-lightest lrv-u-width-100p lrv-u-display-block lrv-u-height-auto\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/09\/SiriusXM-BLUE-logo-2025-billboard-1800.jpg\" data-lazy-src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/09\/SiriusXM-BLUE-logo-2025-billboard-1800.jpg\" alt=\"SiriusXM\" data-lazy- data-lazy- height=\"\" width=\"\"\/><\/p>\n<p>\t\t\t<\/a><\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThis ruling was the first to weigh in on SoundExchange\u2019s standing to collect recorded royalties via lawsuits, and the implications are big. For more than a decade, the organization has regularly used litigation to secure <a href=\"https:\/\/www.billboard.com\/pro\/sirius-xm-150m-soundexchange-settlement-unpaid-royalties\/\" rel=\"nofollow noopener\" target=\"_blank\">hundreds of millions of dollars <\/a>in royalties from radio broadcasters like SiriusXM and music streamers such as Slacker and Napster.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tAlready, music companies are trying to use Judge Buchwald\u2019s ruling in their favor. Just weeks after the decision came down, Sonos told a court that it will file a motion to dismiss its own pending SoundExchange royalties lawsuit based on the rationale in the SiriusXM case. \u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tFaced with the possibility of losing a key enforcement strategy, SoundExchange is standing firm and using an appeal to go on the offensive. The group wants the Second Circuit Court of Appeals to reverse Judge Buchwald, calling the decision an \u201cerroneous ruling and flawed interpretation\u201d of the Copyright Act in a statement on Friday.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cAs Congress surely realized in creating the statutory license, some licensees will seek any available means to avoid paying artists for the full value of their work to maximize profitability,\u201d said SoundExchange in the statement. \u201cFor the statutory license to function properly, SoundExchange fully believes Congress intended that the \u2018enforcement\u2019 power clearly granted in the statute must necessarily include the ability of its administrator to bring litigation claims when digital music services fail to meet their obligations under the law.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cIn the meantime,\u201d continues the statement, \u201cSoundExchange will continue in its mission of securing fair compensation for artists and rights owners and looks forward to arguing its case in court.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tA rep for SiriusXM did not immediately return a request for comment on the appeal.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe SoundExchange lawsuit against SiriusXM, <a href=\"https:\/\/www.billboard.com\/pro\/soundexchange-suing-siriusxm-over-unpaid-royalties-lawsuit\/\" rel=\"nofollow noopener\" target=\"_blank\">brought in 2023<\/a>, accused the satellite radio giant of \u201cgaming the system\u201d with manipulative bundling to withhold more than $150 million in performance royalties up to that point.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tSoundExchange says SiriusXM has continued to apply this \u201cfaulty methodology\u201d in the years since and now owes more than $400 million to artists and labels.
