{"id":164002,"date":"2025-09-23T14:35:07","date_gmt":"2025-09-23T14:35:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/164002\/"},"modified":"2025-09-23T14:35:07","modified_gmt":"2025-09-23T14:35:07","slug":"government-required-to-create-plan-to-protect-greater-glider-in-major-legal-win-for-wilderness-society-endangered-species","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/164002\/","title":{"rendered":"Government required to create plan to protect greater glider in major legal win for Wilderness Society | Endangered species"},"content":{"rendered":"<p class=\"dcr-130mj7b\">The federal environment minister, Murray Watt, has conceded that successive governments acted unlawfully when they failed to create mandatory recovery plans for native species threatened with extinction in a major legal win for one of Australia\u2019s largest environmental organisations.<\/p>\n<p class=\"dcr-130mj7b\">The Wilderness Society has been successful in federal court proceedings it launched in March that sought to compel the minister to make recovery plans for species including the greater glider and the ghost bat.<\/p>\n<p class=\"dcr-130mj7b\">In a court settlement, reached Friday, the government agreed mandatory recovery plans for four threatened species \u2013 the greater glider, the ghost bat, the lungfish and the sandhill dunnart \u2013 had not been made and successive ministers had exceeded the timeframe in which the plans were required to be created and put in force.<\/p>\n<p class=\"dcr-130mj7b\">The government also agreed that recovery plans for seven other threatened species \u2013 including the baudin\u2019s and carnaby\u2019s black cockatoos \u2013 that were previously said to have expired or \u201csunsetted\u201d, would remain in force.<\/p>\n<p class=\"dcr-130mj7b\"><a href=\"https:\/\/www.theguardian.com\/email-newsletters?CMP=copyembed&amp;CMP=emailbutton\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Sign up: AU Breaking News email<\/a><\/p>\n<p class=\"dcr-130mj7b\">\u201cToday is a win for threatened wildlife across Australia. If the minister decides a species does require one, the plan must usually be made within three years.<\/p>\n<p class=\"dcr-130mj7b\">Once a recovery plan is enacted, the minister must not make decisions that would be considered contrary to its goals and actions.<\/p>\n<p class=\"dcr-130mj7b\">The Wilderness Society\u2019s legal action followed long-held concerns about a backlog of unfinished and undeveloped plans for species including the greater glider, which has required a recovery plan since 2016 but has no plan in place.<\/p>\n<p class=\"dcr-130mj7b\">Years of <a href=\"https:\/\/www.theguardian.com\/environment\/2018\/feb\/20\/fantasy-documents-recovery-plans-failing-australias-endangered-species\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">reporting by Guardian Australia<\/a> has highlighted the failure by successive governments to make recovery plans within the required time frames. An auditor general\u2019s <a href=\"https:\/\/www.anao.gov.au\/sites\/default\/files\/Auditor-General_Report_2021-22_19.pdf\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">report in 2022<\/a> found only 2% of recovery plans had been completed within their statutory timeframe since 2013.<\/p>\n<p class=\"dcr-130mj7b\">In 2020 the federal environment department <a href=\"https:\/\/www.theguardian.com\/environment\/2020\/oct\/19\/australian-threatened-species-at-risk-due-to-government-inaction-over-backlog-of-recovery-plans\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">told a Senate estimates<\/a> hearing that 170 plants, animals and habitats were waiting for recovery plans.<\/p>\n<p class=\"dcr-130mj7b\">To reduce the backlog, the previous Coalition government had the threatened species scientific committee reassess whether some species still required a plan and, in 2022, <a href=\"https:\/\/www.theguardian.com\/environment\/2022\/jun\/02\/coalition-scrapped-recovery-plans-for-176-threatened-species-and-habitats-in-one-of-its-final-acts\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">scrapped the requirement<\/a> for almost 200 plants, animals and habitats.<\/p>\n<p class=\"dcr-130mj7b\">In 2022, <a href=\"https:\/\/www.theguardian.com\/environment\/2022\/nov\/27\/tangled-mess-of-inaction-hundreds-of-threatened-species-recovery-plans-expiring-in-next-six-months\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">freedom of information documents obtained by Guardian Australia<\/a> revealed concerns within the federal environment department that 372 recovery plans covering 575 species and ecosystems were due to expire by the end of 2023.<\/p>\n<p class=\"dcr-130mj7b\">Last week before it reached its settlement with the Wilderness Society, the government updated its <a href=\"https:\/\/www.dcceew.gov.au\/environment\/biodiversity\/threatened\/recovery-plans\/made-or-adopted\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">recovery plans webpage<\/a> to state that recovery plans were exempt from sunsetting.<\/p>\n<p><a data-ignore=\"global-link-styling\" href=\"#EmailSignup-skip-link-18\" class=\"dcr-jzxpee\">skip past newsletter promotion<\/a><\/p>\n<p class=\"dcr-rsfwa\">Sign up to Breaking News Australia<\/p>\n<p class=\"dcr-1xjndtj\">Get the most important news as it breaks<\/p>\n<p>Privacy Notice: Newsletters may contain information about charities, online ads, and content funded by outside parties. It\u2019s time to prioritise nature, or face legal action and further community outcry.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Ellen Maybery, a lawyer at Environmental Justice Australia which acted for the Wilderness Society in the proceedings, said the win \u201cforces the government to act\u201d.<\/p>\n<p class=\"dcr-130mj7b\">\u201cFor decades, successive governments have failed to follow their own laws and deliver these vital recovery plans.
