{"id":168971,"date":"2025-09-25T19:11:04","date_gmt":"2025-09-25T19:11:04","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/168971\/"},"modified":"2025-09-25T19:11:04","modified_gmt":"2025-09-25T19:11:04","slug":"doug-ford-takes-aim-at-mark-carney-over-review-of-notwithstanding-clause-usage","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/168971\/","title":{"rendered":"Doug Ford takes aim at Mark Carney over review of notwithstanding clause usage"},"content":{"rendered":"<p class=\"c-paragraph\">Ontario Premier Doug Ford took aim at the federal government and judicial \u201coverreach\u201d Thursday over a move to have the Supreme Court of Canada weigh in on provincial overuse of the notwithstanding clause.<\/p>\n<p class=\"c-paragraph\">\u201cThat is way overreach,\u201d Ford told reporters, referring both to the court and the federal government. <\/p>\n<p class=\"c-paragraph\">He added that federal and provincial parliaments should be \u201csupreme, meaning people are supreme, not judges ruling on stuff that shouldn\u2019t even be in front of the courts.\u201d<\/p>\n<p class=\"c-paragraph\">Ford also took aim at Prime Minister Mark Carney and said the other premiers are also angry about the move. <\/p>\n<p class=\"c-paragraph\">\u201cIt\u2019s not just this premier, it\u2019s premiers across the country are on fire,\u201d Ford said. \u201cThis is the worst decision Prime Minister Carney has ever done, and it will be an absolute disaster.\u201d<\/p>\n<p class=\"c-paragraph\">Ford made the remarks during an unrelated news conference where he promised to ban speed cameras.<\/p>\n<p class=\"c-paragraph\">His comments come after Carney\u2018s Liberal government last week filed a factum \u2014 a written statement of fact and law \u2014 asking the Supreme Court of Canada to <a href=\"https:\/\/www.cp24.com\/news\/canada\/2025\/09\/17\/alberta-defends-notwithstanding-clause-in-arguments-for-bill-21-supreme-court-case\/\" rel=\"nofollow noopener\" target=\"_blank\">set limits on how the notwithstanding clause can be invoked<\/a>. The government argued that provincial overuse of the notwithstanding clause amounts to \u201cindirectly amending the Constitution.\u201d<\/p>\n<p class=\"c-paragraph\">The factum was filed as part of a case on Quebec\u2019s Bill 21, known as the secularism law, which prohibits public sector workers in positions of authority from wearing religious symbols while at work.<\/p>\n<p class=\"c-paragraph\">The notwithstanding clause allows provincial governments to pass legislation that may conflict with charter rights. Conventionally it has been used sparingly. But in recent years, provincial governments have used the clause more freely.<\/p>\n<p class=\"c-paragraph\">Ford has used or threatened to use the notwithstanding clause multiple times in order to push through his government\u2019s agenda, despite charter concerns. His government used the clause to push through a law limiting third party election advertising in 2021. It also threatened to use it when it unilaterally shrunk the size of Toronto City Council in 2018, and when it moved to block a teacher\u2019s strike in 2022.<\/p>\n<p class=\"c-paragraph\">In his news conference, Ford said that Carney is \u201cwasting his time\u201d with the move and predicted it will never work. <\/p>\n<p class=\"c-paragraph\">He also took aim at Canada\u2019s attorney general, <a href=\"https:\/\/www.canada.ca\/en\/department-justice\/news\/2025\/09\/statement-from-minister-fraser-on-canadas-intervention-before-the-supreme-court-of-canada.html\" rel=\"nofollow noopener\" target=\"_blank\">Sean Fraser<\/a>, saying he should be focused instead on bail reform. <\/p>\n<p class=\"c-paragraph\">In a statement last week, Fraser called the charter \u201ca pillar of our democracy\u201d and a guarantee of the rights \u201cat the heart of our democratic society.\u201d<\/p>\n<p class=\"c-paragraph\">\u201cThis case is about more than the immediate issues before the Court.
