Interior community of Edgewood, about 95 kilometres east of Kelowna.<\/p>\n<p dir=\"ltr\">The court ordered the stay on Wednesday\u00a0as the CFIA\u00a0was\u00a0setting up to carry\u00a0out a cull order, after avian flu was discovered in the flock in December 2024. (CBC News)<\/p>\n<p dir=\"ltr\">The farm&#8217;s website says it moved away from that industry and now focuses on breeding, tourism and research. The timeline of this transition is unclear.<\/p>\n<p dir=\"ltr\">CFIA says the farm has not provided any documentation outlining the research it claims to carry out. It also says the farm lacks facilities &#8220;<a href=\"https:\/\/inspection.canada.ca\/en\/animal-health\/terrestrial-animals\/diseases\/reportable\/avian-influenza\/latest-bird-flu-situation\/investigations-and-orders\/british-columbia-ostrich-farm\/hpai-infected-premise-british-columbia-ostrich-farm#a6\" target=\"_blank\" rel=\"nofollow noopener\">suitable for controlled research activity or trials<\/a>.&#8221;<\/p>\n<p dir=\"ltr\">Dr. Scott Weese, a professor, researcher and veterinarian from the University of Guelph in Ontario, told CBC News he has not found any evidence the farm has received formal research or scientific animal care approval from a recognized regulatory body.<\/p>\n<p>What is avian flu and how did the ostriches become infected?<\/p>\n<p dir=\"ltr\">Avian flu, also known as H5N1, is a respiratory illness that is largely transmitted through wild birds. (CDC\/NIAID\/The Associated Press)<\/p>\n<p dir=\"ltr\">The farm said it had 450 ostriches at the beginning of December 2024.<\/p>\n<p dir=\"ltr\">Weeks later, a flock of wild ducks landed in the ostrich&#8217;s open air enclosure. In the days and weeks that followed, 69 of the farm&#8217;s youngest birds died after contracting a respiratory infection, said the CFIA.<\/p>\n<p dir=\"ltr\">An anonymous source reported the deaths to the CFIA, as the farm did not self-report.\u00a0CFIA then imposed a quarantine order and visited the farm to collect samples from two of the dead birds.<\/p>\n<p dir=\"ltr\">On Dec. 31, Universal was told the tests for avian flu were positive,\u00a0and an order to cull the remaining flock was issued.<\/p>\n<p>What is a cull order and why would the surviving ostriches be killed?<\/p>\n<p dir=\"ltr\">CFIA says it takes the management of avian flu seriously\u00a0in order to keep humans and wild and domestic animals safe \u2014\u00a0as well as the country&#8217;s $6.8-billion poultry industry\u00a0and international trade relations.<\/p>\n<p dir=\"ltr\">CFIA employs the &#8220;<a href=\"https:\/\/www.woah.org\/fileadmin\/Home\/eng\/Health_standards\/tahc\/2018\/en_glossaire.htm\" target=\"_blank\" rel=\"nofollow noopener\">stamping out<\/a>&#8221; policy outlined by the World Organization for Animal Health, which requires all animals in a flock to be killed, even if H5N1 is detected in just one bird.<\/p>\n<p dir=\"ltr\">The killing of a farm&#8217;s livestock in response to a disease is called a cull. In\u00a0<a href=\"https:\/\/inspection.canada.ca\/en\/animal-health\/terrestrial-animals\/diseases\/compensation\" target=\"_blank\" rel=\"nofollow noopener\">commercial operations<\/a>, owners of livestock \u2014 including cattle, swine and poultry \u2014\u00a0are eligible for compensation for the cost of the animal and associated expenses.<\/p>\n<p dir=\"ltr\">Countries that do not comply with internationally recognized biosecurity standards\u00a0may be\u00a0<a href=\"https:\/\/inspection.canada.ca\/en\/animal-health\/terrestrial-animals\/diseases\/reportable\/avian-influenza\/information-travellers\" target=\"_blank\" rel=\"nofollow noopener\">prohibited from engaging in commercial trade<\/a> of animal products.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" alt=\"Chickens are pictured at a large poultry farm, in very close proximity to each other. (Ben Nelms\/CBC)<\/p>\n<p dir=\"ltr\">Countries and provinces <a href=\"https:\/\/inspection.canada.ca\/en\/animal-health\/terrestrial-animals\/diseases\/reportable\/avian-influenza\/latest-bird-flu-situation\/restrictions-poultry-exports#br\" target=\"_blank\" rel=\"nofollow noopener\">regularly ban<\/a> the import of poultry products\u00a0from jurisdictions facing avian flu outbreaks. (Curtis Allen for CBC)How would the ostriches be killed?<\/p>\n<p dir=\"ltr\">CFIA will not provide details of\u00a0how the cull will take place, but has stated it will be &#8220;humane.&#8221;<\/p>\n<p dir=\"ltr\">Typically, on commercial poultry operations where chickens or turkeys are raised, a method of <a href=\"https:\/\/inspection.canada.ca\/en\/inspection-and-enforcement\/guidance-food-inspection-activities\/commodity-inspection\/humane-slaughter-guidelines-avian-food-animals#a6_4\" target=\"_blank\" rel=\"nofollow noopener\">oxygen deprivation is used to kill\u00a0or stun the birds<\/a>. This typically involves the use of carbon dioxide. Most animal respiratory systems do not recognize there is an oxygen shortage when carbon dioxide is present. Eventually, the lack of oxygen causes the animal to become unconscious and eventually die.<\/p>\n<p dir=\"ltr\">Camille Labchuk, a lawyer with Animal Justice, said large birds like ostriches are often killed using <a href=\"https:\/\/inspection.canada.ca\/en\/food-guidance-commodity\/meat-products-and-food-animals\/guidelines-stunning-techniques#a9\" target=\"_blank\" rel=\"nofollow noopener\">captive bolt pistols.<\/a>\u00a0She fears, if this method is used in the cull of the ostriches, it will cause undue stress.<\/p>\n<p dir=\"ltr\">&#8220;When animals are killed off by the CFIA because of disease risks, rules are abridged and the CFIA has very broad discretion,&#8221; said Labchuk.<\/p>\n<p>Why won&#8217;t the government re-test the surviving ostriches?\u00a0<\/p>\n<p dir=\"ltr\">The owners and supporters of the Universal farm have demanded the CFIA re-test the surviving birds for avian flu. The farm asserts the birds have developed &#8220;herd immunity&#8221; and would be resistant to future infections.\u00a0<\/p>\n<p dir=\"ltr\">Assessing a flock for H5N1 infection is done by gathering a sample from a bird&#8217;s mouth, nose or cloaca \u2014 an orifice that acts as a vagina, urethra and anus \u2014\u00a0and analyzing it with polymerase chain reaction\u00a0testing. The samples must be taken to\u00a0a specialized containment laboratory for analysis in order for the results to be reliable, according to the federal government.<\/p>\n<p dir=\"ltr\">Angela Rasmussen, a professor and researcher of virology at the University of Saskatchewan, said even if the farm&#8217;s surviving birds were tested, older ostriches often do not develop antibodies against viruses like avian\u00a0flu, meaning the tests cannot reliably determine whether or not the birds have immunity to H5N1.<\/p>\n<p dir=\"ltr\">&#8220;Simply having antibodies does not guarantee immunity to H5N1,&#8221; Rasmussen told\u00a0CBC\u00a0News.<\/p>\n<p dir=\"ltr\">This means the birds may still be a vector for disease and could transmit\u00a0or contract avian flu\u00a0from wild birds, she said.\u00a0<\/p>\n<p dir=\"ltr\">The CFIA has refused to test the surviving birds, while the farm and its supporters say they have been threatened with fines and jail time if they conduct their own testing.\u00a0<\/p>\n<p dir=\"ltr\">The Health of Animals Act states penalties could apply if a person disobeys CFIA orders, with maximum fines up to $50,000 and six months in jail on a summary conviction, or up to $250,000 and two years in jail on indictment.\u00a0<\/p>\n<p dir=\"ltr\">CFIA&#8217;s biosecurity orders restrict the removal of any ostrich material from the property, including samples for testing, as the farm is currently quarantined in a containment zone.<\/p>\n<p>WATCH | RCMP at the Universal Ostrich Farm: <img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/09\/1758934812_755_default.jpg\"  alt=\"\" class=\"thumbnail\" loading=\"lazy\"\/><\/p>\n<p class=\"video-item-title\">RCMP gather at B.C. ostrich farm facing cull<\/p>\n<p>RCMP have gathered in Edgewood, B.C., to support the Canadian Food Inspection Agency as it executes a search warrant at the Universal Ostrich farm, where approximately 400 birds have been ordered killed due to avian flu concerns.Why is there so much opposition, if culls are not unusual in the poultry industry?<\/p>\n<p dir=\"ltr\">Since last December, the farm and its supporters have been fighting the cull order through the courts, through asocial meida\u00a0awareness campaign and via\u00a0the media. Thousands of people from around the world have donated to their online fundraiser and have called on\u00a0Canadian government officials to save the ostriches.<\/p>\n<p dir=\"ltr\">The\u00a0battle has attracted hundreds of people to\u00a0the farm, with many camping out.\u00a0The issue of the cull has become a vector for those concerned about perceived government overreach, or those who don&#8217;t trust\u00a0government organizations and mandates used to contain viruses.<\/p>\n<p dir=\"ltr\">Notable voices from the U.S. \u2014 including TV host and now administrator\u00a0Dr. Mehmet Oz,\u00a0Health Secretary Robert F.
