We want the best care possible for the people of the Northwest Territories and this bill offers a practical way forward,\u201d she said. <\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"MTY3OSwxNSw2MA==\" href=\"https:\/\/www.fin.gov.nt.ca\/en\/procurementtraining\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/09\/Digital_600x500_Lvl1_Program-Template.jpg\" width=\"300px\"\/><\/a><\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"MTYwMiwxNSw2MA==\" href=\"https:\/\/www.wamp.ca\/\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/09\/ezgif.com-animated-gif-maker-1.gif\" width=\"300px\"\/><\/a><\/p>\n<p>A committee of MLAs is reviewing the private member\u2019s bill, which proposes amending the NWT\u2019s Public Service Act to allow nurses to form their own bargaining unit.<\/p>\n<p>Yellowknife North MLA Shauna Morgan, who <a href=\"https:\/\/cabinradio.ca\/239214\/news\/politics\/shauna-morgan-introduces-nurses-collective-bargaining-bill\/\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">introduced the bill<\/a> in May, has said it will address the constitutional right of workers to choose who they want to represent them in bargaining.<\/p>\n<p>Currently, the Union of Northern Workers represents nurses and most other unionized NWT government employees in bargaining \u2013 save for teachers, who are represented by the Northwest Territories Teachers\u2019 Association.<\/p>\n<p>At Tuesday\u2019s public meeting, UNW president Gayla Thunstrom repeated the <a href=\"https:\/\/cabinradio.ca\/256764\/news\/politics\/mlas-hear-arguments-for-against-nurses-bargaining-bill\/\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">union\u2019s opposition to Bill 26<\/a>. She argued that changes to the Public Service Act should be made through ongoing discussions between the union and NWT government rather than through a private member\u2019s bill.<\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"NzgxLDE2LDYw\" href=\"https:\/\/ykhemp.ca\/lead-monitoring-update\/\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/07\/ykhemp-lead-monitoring-update.jpg\" width=\"300px\"\/><\/a><\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"MTE1NywxNiw2MA==\" href=\"https:\/\/www.facebook.com\/CaitlinClevelandMLA\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/07\/CAITLIN-CLEVELAND_2025_-CABIN600x500.png\" width=\"300px\"\/><\/a><\/p>\n<p>Thunstrom said the UNW is not against the \u201cpossibility of a made-in-NWT labour board that could appropriately address certification or decertification.\u201d She said the union opposes Bill 26, however, as it contains \u201csignificant errors and omissions in the legal language that present a danger to nurses and democratic rights.\u201d <\/p>\n<p>The Public Service Alliance of Canada \u2013 the UNW\u2019s parent \u2013 and the NWT government have also <a href=\"https:\/\/cabinradio.ca\/239214\/news\/politics\/shauna-morgan-introduces-nurses-collective-bargaining-bill\/\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">advocated for \u201ca collaborative approach\u201d<\/a> to amending the Public Service Act.<\/p>\n<p>Jos\u00e9e-Anne Spirito, PSAC\u2019s regional executive vice-president for the North, has said if nurses were to be represented by another bargaining agent, they would have to fight to retain existing terms and conditions in the current collective agreement alongside any improvements in a new collective agreement, with no guarantee that they would be successful.<\/p>\n<p>Sarah-Jayne Dempster, president of the Northern Territories Federation of Labour, said in a <a href=\"https:\/\/www.youtube.com\/watch?v=UF1UpLxIod8\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">separate briefing<\/a> that allowing a specific group of workers to leave the union would weaken collective bargaining power. She said that would \u201clead to a fragmentation of union strength, ultimately reducing the protections that collectively workers have fought long and hard to establish.\u201d<\/p>\n<p>Dempster advocated instead for the creation of an independent labour board that would \u201coversee the administration of union membership rights, resolve disputes and ensure that collective bargaining continues on fair and impartial terms.\u201d<\/p>\n<p>Nurses speak in favour of bill<\/p>\n<p>Tina Drew, a registered nurse at the Yellowknife hospital, said over the past 43 years she has worked as a nurse in nine countries, one Canadian province and two territories.<\/p>\n<p>\u201cThis is the only place where I\u2019ve not been in a union where nurses have a meaningful voice in their working conditions or in patient advocacy,\u201d she said at Tuesday\u2019s meeting.<\/p>\n<p>Drew said other jurisdictions in Canada that have nurses\u2019 unions have been successful and won safer staffing levels, patient protections and more resilient public healthcare in bargaining.<\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"MTM0MCwxNiw2MA==\" href=\"https:\/\/coach.ca\/programs-and-initiatives\/mentorship-and-apprenticeships\/women-coaching-canada-games-apprenticeship\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/09\/Sport-North-CWG.gif\" width=\"300px\"\/><\/a><\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"MTU0NywxNiw2MA==\" href=\"https:\/\/www.ntlegislativeassembly.ca\/meet-members\/mla\/denny-rodgers\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/07\/Denny-Rodgers-MLA-ad_v3_2.jpg\" width=\"300px\"\/><\/a><\/p>\n<p>\u201cThese are not cautionary tales of fragmentation, they are success stories. So why should the nurses in the NWT with Nunavut be the only ones denied that right?\u201d she questioned.<\/p>\n<p>Drew gave the example that when she raised safety concerns about a nurse working a 22-hour shift in October 2022, she said the UNW told her it was unable to advocate for a change that would allow nurses a day of rest prior to being on call for the emergency room. She said that is because a change to one section of the collective agreement would affect all GNWT employees, not just nurses.<\/p>\n<p>Drew said she previously raised the need for a separate bargaining unit for NWT nurses with the former health minister and the UNW in 2021, during the <a href=\"https:\/\/cabinradio.ca\/79697\/news\/yellowknife\/stanton-with-too-few-staff-sends-families-to-edmonton-for-births\/\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">closure of Stanton\u2019s obstetrics unit<\/a>.<\/p>\n<p>\u201cLet\u2019s be clear, Bill 26 is not about higher pay or special treatment. It\u2019s about voice, fairness and democracy,\u201d Drew said.<\/p>\n<p>\u201cRespect democracy, protect public health and support Bill 26.\u201d<\/p>\n<p>Jacob James Moynes-Keshen, a nursing student at Aurora College, said he was surprised and felt \u201csome shame and embarrassment\u201d when he learned that NWT nurses do not have an independent bargaining unit.<\/p>\n<p>\u201cIt is untenable to continue to suggest that the needs of nurses as a unique labour unit can be met by a union which is fundamentally composed of workers of broad stripes, broad colours, whose needs are entirely different from nurses and will always numerically overshadow them,\u201d he said.<\/p>\n<p>Moynes-Keshen said he believes Bill 26 must be passed, describing it as \u201cessential.\u201d<\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"MTE4MSwxNiw2MA==\" href=\"https:\/\/www.facebook.com\/events\/1537764300726201\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/09\/GNWT_CabinRadio_AdsGNWT_CabinRadio_Ads_ConstituencyMeeting_Fall2025_P3.jpg\" width=\"300px\"\/><\/a><\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"MTc3MSwxNiw2MA==\" href=\"https:\/\/haveyoursay.nwt-tno.ca\/nwt-nominee-program\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/09\/0045_D_600x500_L1_Northwest-Territories-Nominee-Program_Eng.jpg\" width=\"300px\"\/><\/a><\/p>\n<p>Christian Norwick, a registered nurse in Yellowknife and former UNW Local 11 president at Stanton, told Cabin Radio in an email that he also supports Bill 26.<\/p>\n<p>\u201cIt restores our Charter right to self-organize and choose real representation so we can fix problems unique to us \u2013 staffing, safety and retention problems,\u201d he wrote.<\/p>\n<p>\u201cProvinces with nurse-led bargaining deliver safe staffing and stronger public systems and more influence on leadership. Many nurses see this as about defending public healthcare, not pay.\u201d<\/p>\n<p>\u2018This was always going to blow up\u2019<\/p>\n<p>A person with knowledge of the UNW and labour relations, who requested anonymity to discuss the issue due to their employment, told Cabin Radio the union is aware of Charter issues with the NWT Public Service Act.<\/p>\n<p>They said the act violates the Charter by not allowing GNWT employees to choose who represents them in bargaining, adding those employees have little recourse if they feel they have not been fairly represented by the union.<\/p>\n<p>They said nurses in the NWT have long asked for a separate collective agreement.<\/p>\n<p>\u201cThis was always going to blow up,\u201d the person said. \u201cIt just feels like it\u2019s about time that it did.\u201d<\/p>\n<p>By contrast, the person pointed out that smaller groups represented by the UNW who are not covered by the Public Service Act, such as employees at the City of Yellowknife or Salvation Army, do have the right to choose their union. The union added that in several jurisdictions with legislated bargaining agents, constitutional challenges have been unsuccessful.<\/p>\n<p>Skin in the game?<\/p>\n<p>The person with knowledge of labour relations also raised concern that a potential consequence of Bill 26 related to union leadership has not been publicly discussed.<\/p>\n<p>They said Thunstrom and Spirito would be unable to hold positions as elected leaders within the UNW and PSAC if NWT nurses decide to leave the union. That is because leaders must be members of the union, they said, and Spirito currently works as a nurse while Thunstrom was previously employed as a nurse.<\/p>\n<p>\u201cI don\u2019t understand how either of them can be coming out making public statements about this without disclosing that,\u201d the person said. \u201cThey have so much skin in the game.\u201d<\/p>\n<p>They added that nurses leaving the UNW could also result in the loss of significant membership dues for the union.<\/p>\n<p>Last month \u2013 following <a href=\"https:\/\/www.youtube.com\/watch?v=EL30PU2099E\" title=\"\" rel=\"nofollow noopener\" target=\"_blank\">an earlier briefing on Bill 26<\/a> during which Thunstrom spoke about her nursing experience \u2013 the College and Association of Nurses of the NWT and Nunavut said in a statement that Thunstrom is not licensed with the organization and is not entitled to practise as a nurse in the two territories.<\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"MTY5MiwxNiw2MA==\" href=\"https:\/\/www.ourcommons.ca\/members\/en\/rebecca-alty(123675)\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/07\/MP-Rebecca-Alty_June-2025.jpg\" width=\"300px\"\/><\/a><\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"MTc4NywxNiw2MA==\" href=\"https:\/\/haveyoursay.nwt-tno.ca\/atipp-review\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/09\/0049_D_600x500_L1_Public-Engagement-on-ATIPP-Review_Eng.jpg\" width=\"300px\"\/><\/a><\/p>\n<p>PSAC said Spirito \u201chas been clear\u201d about her position as nurse and an elected labour leader, while Spirito said she will still have a job as a nurse whenever her elected mandate is over.<\/p>\n<p>Spirito stated to Cabin Radio that PSAC North does not oppose \u201cthe idea of nurses having their own bargaining unit or collective agreement.\u201d She said the union is opposed to Bill 26 as it \u201cis poorly written and would put nurses at risk.\u201d<\/p>\n<p>\u201cAs a nurse, of course I have a vested interest in this bill because I have a vested interest in the future of nursing in the NWT,\u201d she wrote.<\/p>\n<p>\u201cI am proud to have been elected as the first nurse from the NWT in this position.
