{"id":197736,"date":"2025-10-08T14:40:17","date_gmt":"2025-10-08T14:40:17","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/197736\/"},"modified":"2025-10-08T14:40:17","modified_gmt":"2025-10-08T14:40:17","slug":"in-unusual-case-nurse-disciplined-for-accessing-own-health-records","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/197736\/","title":{"rendered":"In unusual case, nurse disciplined for accessing own health records"},"content":{"rendered":"<p>A strange case made public by the NWT\u2019s information and privacy commissioner details a nurse first denying they accessed their own medical records, then admitting it and being disciplined.<\/p>\n<p>In a report dated August 15 but only <a href=\"https:\/\/cabinradio.ca\/wp-content\/uploads\/2025\/10\/2025ntipc112.pdf\" rel=\"nofollow noopener\" target=\"_blank\">made more broadly available<\/a> this week, commissioner Andrew Fox described a case involving a nurse in a T\u0142\u0131\u0328ch\u01eb community. The nurse and community are not identified.<\/p>\n<p>On October 28, 2024, Fox stated, the T\u0142\u012fch\u01eb Community Services Agency became aware of evidence that the nurse had viewed their own electronic medical records.<\/p>\n<p>While someone reading their own medical information might not raise some residents\u2019 eyebrows \u2013 certainly <a href=\"https:\/\/cabinradio.ca\/12490\/news\/dehcho\/still-unclear-how-medical-records-reached-fort-simpson-dump\/\" rel=\"nofollow noopener\" target=\"_blank\">compared to other breaches<\/a> \u2013 Fox said an employer banning that kind of action makes sense, even if the legislation doesn\u2019t directly deal with such a scenario.<\/p>\n<p>The end user agreement employees must sign to use the records system states, in part: \u201cI understand that accessing my own health record is inappropriate.\u201d<\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"OTM0LDE1LDYw\" href=\"https:\/\/ykracquetclub.com\/events\/halloween-party-2025\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/10\/Halloween-Party-2025-Cabin-Radio-600x500-1.png\" width=\"300px\"\/><\/a><\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"MTIxMCwxNSw2MA==\" href=\"https:\/\/www.facebook.com\/profile.php?id=581601301\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/07\/image001-1.jpg\" width=\"300px\"\/><\/a><\/p>\n<p>\u201cProhibiting employees from accessing their own personal health information directly helps the health information custodian to protect the security and integrity of the information stored in the EMR,\u201d Fox wrote, using an initialism for electronic medical records, \u201cand to ensure that the legal requirements and exceptions applicable to individuals seeking access to their personal health information are complied with.\u201d<\/p>\n<p>The gap in the legislation wasn\u2019t the only odd circumstance of the case.<\/p>\n<p>According to Fox, the nurse first denied accessing his file and asserted he had been hacked.<\/p>\n<p>TCSA, which appears not to have believed that response, issued two disciplinary \u201cletters of reprimand\u201d for a privacy breach and ordered him to complete privacy training while raising the matter with the nurses\u2019 regulatory body.<\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"MTE0NiwxNiw2MA==\" href=\"https:\/\/www.facebook.com\/cwawzonek\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/07\/CW-Generic-Summer.jpg\" width=\"300px\"\/><\/a><\/p>\n<p style=\"text-align:center\">Advertisement.<br \/><a class=\"gofollow\" data-track=\"MTU0NywxNiw2MA==\" href=\"https:\/\/www.ntlegislativeassembly.ca\/meet-members\/mla\/denny-rodgers\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/07\/Denny-Rodgers-MLA-ad_v3_2.jpg\" width=\"300px\"\/><\/a><\/p>\n<p>Eventually, in March 2025, the nurse received his own copy of an audit of his records and altered his stance, telling TCSA \u2013 in Fox\u2019s words \u2013 that he \u201cdid not recall accessing his own EMR but agreed that the report showed that he had.\u201d<\/p>\n<p>The nurse subsequently wrote directly to Fox to report the breach.<\/p>\n<p>In finding that the nurse had indeed accessed his own records without authorization, Fox criticized TCSA for having left the initial audit that uncovered the incident \u2013 sent by the NWT\u2019s Department of Health and Social Services \u2013 unopened for five months before eventually reading it in October 2024 and taking action.<\/p>\n<p>\u201cI can only observe that TCSA was \u2018lucky\u2019 that the notice of unauthorized use did not involve a more serious matter,\u201d Fox wrote. <\/p>\n<p>Otherwise, he added, TCSA responded appropriately, though he suggested privacy training must be delivered at the earliest possible opportunity. In this instance, the nurse did not receive that training until he had spent nearly two years in the role.<\/p>\n<p>Lastly, Fox enigmatically stated: \u201cI will note that this incident was a small part of a larger set of circumstances that collectively have been a significant drain on TCSA\u2019s resources.
