The antitrust case between 23XI Racing and Front Row Motorsports versus NASCAR continued this week. Each of this week\u2019s filings were either a sealed response to a motion, or an opposition to a motion.<\/p>\n

Here\u2019s a breakdown of what happened this week.<\/p>\n

The first opposition was sent in by 23XI\/FRM on Wednesday (Oct. 15), opposing NASCAR\u2019s motion for summary judgement and asking for the court to deny the motion.<\/p>\n

The teams followed with a defense of their own expert Timothy Frost, after NASCAR motioned to have Frost excluded. The teams believe Frost\u2019s time as a consultant in the motorsports world qualifies him to be an expert.<\/p>\n

The next opposition goes against NASCAR\u2019s motion to exclude testimony from Dr. Daniel A. Rascher. The teams say Rascher \u201cproperly defined the relevant market,\u201d and that NASCAR doesn\u2019t have enough basis for exclusion.<\/p>\n

The teams also go against NASCAR\u2019s motion to exclude Dr. Edward Snyder\u2019s expertise and testimony. Dr. Snyder made comparisons between Formula 1 and NASCAR, and the teams believe that he should be allowed to stay as an expert in the case testimony.<\/p>\n

Finally, NASCAR got in a filing opposing the team\u2019s motion<\/a> for partial summary judgement on the market definition and monopsony power.<\/p>\n

They also filed an opposition to the teams\u2019 desire to have Steve O\u2019Donnell\u2019s expert testimony excluded, also opposing the partial exclusion of Paul Meyer\u2019s testimony.<\/p>\n

The teams believe NASCAR broke the rules with how notice of O\u2019Donnell\u2019s testimony was given. NASCAR argues that they followed the rules.<\/p>\n

NASCAR says Meyer\u2019s testimony is misunderstood, mischaracterized, and his sources, steps, and computations were all disclosed.<\/p>\n
