NASCAR yesterday afternoon hinted that it is working to find a settlement<\/a> with the two teams suing it for alleged antitrust violations<\/a>, a move that would be a welcome relief to the industry before Sunday\u2019s championship race.<\/p>\n

The statement came after Judge Kenneth Bell released a ruling dismissing a countersuit by NASCAR against the two teams, Front Row Motorsports and 23XI Racing, because it had \u201cfailed to establish an agreement to unreasonably restrain trade\u201d by the teams. It also followed a report from The Athletic that NASCAR is working to wrap up a settlement deal before the championship weekend.<\/p>\n

Momentum appeared to begin building toward a deal during last week\u2019s settlement conference<\/a>, SBJ previously reported, although the deal wasn\u2019t clinched during that two-day meeting.<\/p>\n

In the statement, NASCAR indicated that its top priority at the moment is \u201cresolving this matter quickly so all parties can focus on Championship weekend and continuing to grow the sport.\u201d<\/p>\n

The Daytona Beach-based racing sanctioning company added on the dismissal of its counter-claim: \u201cWe respect the Court\u2019s decision, though we respectfully disagree with its legal reasoning. \u2026 Should a resolution not be reached, we intend to appeal the decision at the appropriate time.\u201d<\/p>\n

Finding a middle ground toward the teams\u2019 ask of making the charter system permanent has been seen as an important step toward a settlement, SBJ previously reported. Industry executives have long predicted that a settlement might be reached but only on the eve of key moments, like before discovery started or the trial began.<\/p>\n

As part of a prospective settlement, NASCAR has agreed to making the charter system an \u201cevergreen,\u201d The Athletic reported, a term that teams have been using for what they were seeking as far back as early 2024<\/a>, according to SBJ\u2019s reporting at the time. The other major sticking points include figuring out lawyer fees and whether 23XI and Front Row will receive back payments for league fees they didn\u2019t get after losing the rights to their charters in court, the report said.<\/p>\n

A resolution to the case would be highly welcomed by most of, if not the entire, industry. The case has distracted executives from more typical initiatives meant to grow the sport and at times has led to questions from prospective and current sponsors and other stakeholders about the situation and whether it was bringing negative attention to the sport.<\/p>\n

Earlier this month, several of the competing NASCAR teams not involved in the lawsuit put out statements calling for a resolution<\/a>.
