Sunday, on the eve of 23XI Racing and Front Row Motorsports\u2019 antitrust lawsuit against NASCAR going to trial in Charlotte, <a href=\"https:\/\/x.com\/bobpockrass\/status\/1995204683368169536?s=20\" rel=\"nofollow\">Bob Pockrass of FOX Sports<\/a> obtained a 23XI\/FRM expert report which revealed the sanctioning body\u2019s reaction to Gibbs\u2019 letter. <\/p>\n<p>This, per Pockrass, was the reaction of NASCAR CEO Jim France: \u201cFrance reportedly read the letter \u2018out loud and [was] swearing every other sentence,\u2019 leading other NASCAR executives to conclude that the letter was not helping the teams\u2019 cause.\u201d<\/p>\n<p>The <a href=\"https:\/\/x.com\/bobpockrass\/status\/1983916301191193066\" rel=\"nofollow\">letter <\/a>was first revealed to the public Oct. 30. Gibbs closed the letter with the following:<\/p>\n<p>\u201cWhen all the stakes are on the table, teams need to know their worth is valued and secure,\u201d Gibbs wrote. \u201cNASCAR has the guarantee that teams are \u2018in it\u2019 for the long run, and teams have assurance from the sanctioning body that their charters are secure. If there was anything to decide to move the team forward it will be trust in them, the owners, the legends and leaders of your sport with a permanent spot in your history book.\u201d<\/p>\n<p lang=\"en\" dir=\"ltr\">Of all the exhibits with fiery talk and anger, this one stood out for its approach. Of the 15 Cup Series teams that hold the 36 available charters, 23XI and FRM were the only teams that did not sign the Charter Agreement in August 2024. They filed a joint lawsuit against NASCAR and its CEO\u00a0Jim France\u00a0that October, alleging monopolistic practices.<\/p>\n<p>Multiple attempts at reaching a settlement before trial have failed. Both sides are dug in and believe they have a winning case. Judge\u00a0Kenneth Bell, however, has made it clear he doesn\u2019t see a winner here.<\/p>\n<p>\u201cIt\u2019s hard to picture a winner if this goes to the mat \u2014 or to the flag \u2014 in this case,\u201d Bell said in June. \u201cIt scares me to death to think about what all this is costing.\u201d<\/p>\n<p>Jury selection starts Monday morning (nine jurors, three alternates). The trial is scheduled for 10 days. A settlement can happen any time \u2014 during trial, after trial while judge makes any additional determinations or while case is on appeal,\u00a0<a href=\"https:\/\/x.com\/bobpockrass\/status\/1995182285524725820\" rel=\"nofollow\">according to Pockrass<\/a>.
