U.S. District Court Judge Kenneth D. Bell\u2019s warning this summer about the antitrust trial between NASCAR and the two teams suing the racing body is \u201calready coming true,\u201d according to Jordan Bianchi of THE ATHLETIC. Bell, of the lawsuit between NASCAR, 23XI Racing and Front Row Motorsports, said, \u201cEverybody is going to get hurt.\u201d The initial testimony<\/a> has \u201crevealed a sport full of bitter infighting and financial struggles.\u201d Since Monday, we have seen 23XI Racing co-owner Denny Hamlin \u201cshredding NASCAR\u2019s leadership structure in testimony<\/a>.\u201d We have also seen NASCAR\u2019s lawyers \u201cquestion Hamlin over public comments in support of the same league he\u2019s now suing,\u201d and NASCAR EVP & Chief Strategy Officer Scott Prime \u201canswering for communications<\/a>” with NASCAR Chairman Jim France over the \u201ccontentious charter negotiations.\u201d Almost assuredly, it \u201cwill only get messier.\u201d There is \u201ca bit of a circus atmosphere surrounding the proceedings,\u201d and \u201cnot the good kind of circus.\u201d This ugliness could have \u201cbeen avoided.\u201d In the year-plus since 23XI and Front Row Motorsport filed their lawsuit, both parties had \u201cseveral paths to end the proceedings.\u201d Bianchi writes if NASCAR wins, two teams, who have \u201cpoured millions into the sport, will almost assuredly close their doors,\u201d and if 23XI and Front Row win, the \u201cpotential damages to NASCAR could be vast\u201d (THE ATHLETIC, 12\/4<\/a>).<\/p>\n

APPOINTMENT VIEWING: In Charlotte, Scott Fowler writes we are \u201cstill in the first quarter of what is supposed to be approximately a two-week trial,\u201d one in which 23XI co-owners Michael Jordan<\/a> and Hamlin are \u201cfighting NASCAR about its charter system and the way it runs its business.\u201d The antitrust trial is \u201ca major gamble for all involved.\u201d A settlement would have \u201cmade sense in a lot of ways, but that ship has probably sailed.\u201d Fowler: \u201cYou won\u2019t believe — or maybe you would — how many lawyers are at the tables, for both sides. Somebody is going to be very happy when this is all over, and someone is going to be angry and working on an appeal, but a whopping legal fee will come due.\u201d Random facts have \u201cbounced around the courtroom for three days,\u201d so there are \u201cabout to be significant consequences at this trial.\u201d Plus, after days of watching, Jordan is \u201cabout to come off the bench and get inserted into the game.\u201d Fowler: \u201cAs both fine theater and a harbinger for what stock-car racing will look like in the future, this trial is well worth watching\u201d (CHARLOTTE OBSERVER, 12\/4<\/a>).<\/p>\n","protected":false},"excerpt":{"rendered":"U.S. District Court Judge Kenneth D.
