Childress, who has owned <a href=\"https:\/\/heavy.com\/sports\/nascar\/richard-childress-racing-nascar-text\/\" rel=\"nofollow noopener\" target=\"_blank\">Richard Childress Racing<\/a> for decades, explained that the financial structure of the sport made the signing decision unavoidable.<\/p>\n<p>His comments came on the same day NASCAR Chairman Jim France and Commissioner Steve Phelps also took the stand. The case, brought by <a href=\"https:\/\/heavy.com\/sports\/nascar\/nascar-antitrust-trial-slows-in-week-2-as-economic-evidence-builds\/\" rel=\"nofollow noopener\" target=\"_blank\">23XI Racing<\/a> and <a href=\"https:\/\/heavy.com\/sports\/nascar\/denny-hamlin-accuses-nascar-and-media-of-brainwashing-fans-ahead-of-antitrust-trial\/\" rel=\"nofollow noopener\" target=\"_blank\">Front Row Motorsports<\/a>, challenges NASCAR\u2019s control over charters and revenue distribution. Childress\u2019s testimony added new details about how teams responded to the deadline and how the charter model affects long-term stability.<\/p>\n<p>Richard Childress Describes Why He Signed the Agreement<\/p>\n<p>Richard Childress told the court that refusing to sign the charter agreement would have meant shutting down his team. In reporting by <a href=\"https:\/\/www.nytimes.com\/athletic\/6876060\/2025\/12\/09\/nascar-trial-steve-phelps-charter-deal-richard-childress-michael-jordan\/\" target=\"_blank\" rel=\"noopener external nofollow\">Jeff Gluck and Jordan Bianchi of The Athletic<\/a>, Childress said, \u201cFinancially, I can\u2019t lose my charters.\u201d He explained that charters guarantee access to races and key revenue streams, making them central to a team\u2019s survival.<\/p>\n<p>Childress said he wants RCR to last for decades, but the current model can\u2019t support that future. He added he signed only after being told to do so before midnight or lose his charters. \u201cI would like for it (Richard Childress Racing) to be running 60 years from now, but with this current business model, we can\u2019t do it.\u201d He also explained that he did not sign willingly, adding, \u201cThey told us we had until midnight or you lose \u2019em.\u201d<\/p>\n<p>Richard Childress said his organization did not have the luxury of refusing the deal. Williams reported him saying, \u201cWe are a blue-collar operation and proud of it. If we didn\u2019t sign the Charter agreement in 2024, we would have lost them.\u201d<\/p>\n<p>He also said he repeatedly asked NASCAR leadership to make charters permanent. <a href=\"https:\/\/www.autoweek.com\/racing\/nascar\/a69679518\/childress-signed-nascar-charter-to-avoid-losing-teams\/\" target=\"_blank\" rel=\"noopener external nofollow\">According to Deb William of Autoweek<\/a>, Childress testified that France told him, \u201cWe don\u2019t know where the sport is going to be in seven years\u201d when discussing future media-rights revenue.<\/p>\n<p>France and Phelps Respond in Court<\/p>\n<p>NASCAR Chairman Jim France addressed the charter structure directly. In <a href=\"https:\/\/www.nytimes.com\/athletic\/6876060\/2025\/12\/09\/nascar-trial-steve-phelps-charter-deal-richard-childress-michael-jordan\/\" target=\"_blank\" rel=\"noopener external nofollow\">The Athletic\u2019s reporting<\/a>, France said, \u201cWe did not do evergreen or permanent charters, no.\u201d He also supported the firm deadline for signing, stating, \u201cI knew we needed to get them signed.\u201d<\/p>\n<p>Phelps gave his own account of the negotiations. <a href=\"https:\/\/www.nytimes.com\/athletic\/6876060\/2025\/12\/09\/nascar-trial-steve-phelps-charter-deal-richard-childress-michael-jordan\/\" target=\"_blank\" rel=\"noopener external nofollow\">According to The Athletic<\/a>, when asked if NASCAR used its authority to push teams into the deal, Phelps responded that it was \u201cabsolutely not\u201d true.<\/p>\n<p>He was also questioned about a past conversation regarding permanent charters. When asked whether he once told Hendrick Motorsports, \u201cWe wish we could give you permanent charters, but Jim doesn\u2019t want that,\u201d Phelps replied, \u201cI don\u2019t deny doing it, but I don\u2019t remember.\u201d<\/p>\n<p>Both France and <a href=\"https:\/\/heavy.com\/sports\/nascar\/nascar-trial-commissioner-steve-phelps\/\" rel=\"nofollow noopener\" target=\"_blank\">Phelps<\/a> stated that the charter system offers stability, even as teams have argued that the terms limit their ability to manage costs and build long-term value.<\/p>\n<p>Teams Describe Financial Pressure<\/p>\n<p>Richard Childress also told the court how financial realities shaped his decision. <a href=\"https:\/\/www.nytimes.com\/athletic\/6876060\/2025\/12\/09\/nascar-trial-steve-phelps-charter-deal-richard-childress-michael-jordan\/\" target=\"_blank\" rel=\"noopener external nofollow\">Gluck and Bianchi reported<\/a> that he said his race team would \u201cgo broke\u201d without support from his other businesses.
