Here\u2019s why"},"content":{"rendered":"<p>      Dedham, Massachusetts<br \/>\n        \u00a0\u2014\u00a0<\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s0ju8005o27p9bnjpc2cb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Prosecutors say Brian Walshe planned to kill his wife Ana Walshe before her death on January 1, 2023, then dismembered her body and disposed of her remains in dumpsters in the area near where they lived in Cohasset, Massachusetts.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr00053b6p878qsh9p@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Walshe has been charged with first-degree murder for the alleged killing. The jury started deliberations Friday afternoon after hearing eight days of witness testimony. For the panel to convict him on the most serious homicide charge available in Massachusetts, the jurors must believe the murder was deliberately premeditated.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr00063b6pz1kjfte4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            If the panel doesn\u2019t acquit Walshe, the jurors can also opt to convict Walshe of second-degree murder, a less severe homicide charge, which doesn\u2019t require them to believe he planned to kill his wife.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr00073b6pz7nqcxrn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In Massachusetts when a jury convicts a defendant of murder, the panel is also asked to determine the degree of murder even when someone like Walshe is only charged with murder in the first degree.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr00083b6phh535lwp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A jury is always instructed not to consider possible punishments when they\u2019re deliberating a defendant\u2019s fate, but for Walshe, who is 50 years old, a conviction on first- or second-degree murder could determine whether he dies in prison.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr00093b6pzltvhr8v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The prosecution has not offered the jury a theory of how Walshe killed his wife, Ana, a real estate manager and the mother of his three children, but they\u2019ve said it\u2019s fair to infer she met a violent death in her family home.\n    <\/p>\n<p>       <img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2025\/12\/92940ef6-2861-4bb5-adfd-0fc576c35cd5.jpg\" alt=\"Ana Walshe is seen in an undated photo. When they found the rug, it was cut up in garbage bags and covered in Ana\u2019s blood with a piece of her necklace stuck in the fibers.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000b3b6pvxb01rgt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            According to the commonwealth, Brian Walshe tossed trash bags with Ana\u2019s remains and other evidence in multiple dumpsters in different cities and towns around the local area trying to cover his tracks.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000c3b6puke9tewb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Walshe\u2019s defense team, however, says he did not kill his wife but instead found her inexplicably dead in their bed in the early hours of the New Year and then panicked, thinking no one would believe him.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000d3b6p0e3d53mp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Prosecutors allege Brian Walshe found out about his wife\u2019s monthslong affair with a man she met in Washington, DC, William Fastow.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000e3b6p3cby6ymt@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Yas suggested Walshe feared losing his wife and kids to a new life she\u2019d set up there as he was facing the possibility of prison time and a hefty restitution bill for a federal fraud conviction.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000f3b6p10f0odq7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            He pleaded guilty to selling forged Andy Warhol artwork and was granted home confinement ahead of sentencing because he was the primary caregiver for their three kids.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000g3b6p9wv4ywug@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Walshe\u2019s internet searches before his wife\u2019s death show signs he was thinking of killing his wife, the prosecutor said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000h3b6pu72f204y@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Trial evidence revealed Walshe Googled William Fastow and some commercial buildings his wife managed days before her death. There\u2019s evidence that he searched the internet. There\u2019s evidence that he disposed of a body,\u201d Tipton said during closing arguments. \u201cBut there is no proof in all of the evidence that you have heard or was presented that he ever once thought about harming the woman he loved \u2026 that he ever planned to harm, that he ever intended to harm.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000k3b6pe3rjggou@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            During the commonwealth\u2019s case, the jury saw digital data revealing extensive internet searches on Brian Walshe\u2019s devices about how to dispose of a body and how to clean up blood, which his attorney admitted were \u201cdark\u201d and \u201ctroubling.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4tgv9x00033b6pmzlfzn4x@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n             <br \/>\u201cThey began at 4:52 a.m. on January 1st of 2023, and the first one is, \u2018how do you dispose of a body?\u2019 It causes chills. It causes disgust,\u201d Tipton said Friday.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000l3b6pe5lytcv6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But the defense attorney said there\u2019s no evidence he planned to kill his wife \u2013 only evidence that he reacted after her death.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000m3b6p4sk7qv9w@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cAsk yourself why is a man searching now if he had intended to kill his wife?\u201d Tipton said. \u201cWhy is the man searching now if he had planned to kill his wife? Where is the evidence of premeditation in thousands of pages of records?\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000n3b6pjn7yqs4o@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe defendant was going to lose Ana, and when he lost Ana he would probably lose his freedom,\u201d Yas told the jury Friday. \u201cHe lulled Ana into thinking that everything was OK.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s6pk800173b6pa1wm6nto@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            <br \/>Boston defense attorney J.W. Carney Jr. called the defense strategy \u201cbrilliant.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000p3b6pvn3s16wl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Walshe was planning to take the stand as of Wednesday evening but ultimately changed course, the judge and attorneys discussed in court.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000q3b6p8kfuvpxp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Walshe told the judge, \u201cI will not testify,\u201d and the defense rested its case Thursday morning without presenting any evidence.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000r3b6p5i4e9s2l@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            According to Carney, the defense strategy to admit Walshe disposed of his wife\u2019s body and then lied to police about it could effectively take the sting out of the commonwealth\u2019s strongest evidence for a first-degree murder conviction.\n    <\/p>\n<p>       <img decoding=\"async\" data-article-gutter=\"true\">\n            \u201cThose two lesser charges fit hand in glove with the defense, and if the jury has to believe that the prosecutor has proven beyond a reasonable doubt that the defendant is guilty, there might be a couple of people on the jury who will say it would have been proof beyond a reasonable doubt if he had denied cutting up his wife \u2026 and all of those things, but he hasn\u2019t,\u201d he said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000t3b6p0d94vpxx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            And not letting the jury hear directly from Brian Walshe at trial may have actually given him another advantage, Carney told CNN.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000u3b6p52n2x0e2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIf he had testified, the jurors would have not been looking at the evidence as whether the prosecutor has proved it beyond a reasonable doubt, they\u2019d be looking at the evidence about whether they believe the defendant beyond a reasonable doubt,\u201d Carney said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000v3b6pay8ony18@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The jury, made up of six women and six men, might use second-degree murder as a sort of compromise when they\u2019re considering whether to convict Walshe, Carney explained.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000w3b6ppwive7xm@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThere may be two jurors on the panel who are saying \u2026 \u2018I will concede it is probable that he killed his wife, but the government\u2019s case is not so clear and irrefutable that it reaches the point of proof beyond a reasonable doubt, so I am just going to vote for guilty of second degree,\u2019\u201d Carney said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000x3b6pmmj5tf4v@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The defense has maintained Walshe did not kill his wife, but Carney also said aside from an acquittal, a second-degree murder conviction for Walshe would be a notable success.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr000y3b6pdt9gb7m4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIf the jury comes back guilty of second-degree murder, then that\u2019s going to be one of the most incredible verdicts for the defense in the last 25 years,\u201d Carney said. \u201cNo prosecutor would view that as anything but a failure in the prosecution.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmj4s44gr00103b6pj36z68ug@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            First-degree murder carries a mandatory sentence of life in prison without the possibility of parole. Second-degree murder, however, would give Walshe parole eligibility.
