{"id":365490,"date":"2025-12-24T07:35:11","date_gmt":"2025-12-24T07:35:11","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/365490\/"},"modified":"2025-12-24T07:35:11","modified_gmt":"2025-12-24T07:35:11","slug":"us-supreme-court-blocks-trump-bid-to-deploy-national-guard-to-chicago-us-supreme-court","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/365490\/","title":{"rendered":"US supreme court blocks Trump bid to deploy national guard to Chicago | US supreme court"},"content":{"rendered":"<p class=\"dcr-130mj7b\">The <a href=\"https:\/\/www.theguardian.com\/law\/us-supreme-court\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">US supreme court<\/a> refused on Tuesday to let Donald Trump send national guard troops to the <a href=\"https:\/\/www.theguardian.com\/us-news\/chicago\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Chicago area<\/a>, in an important reining-in of the US president\u2019s efforts to expand the use of the military for domestic purposes in historic moves against a growing number of Democratic-led jurisdictions.<\/p>\n<p class=\"dcr-130mj7b\">The nation\u2019s highest court denied the US justice department\u2019s request to lift <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/judge-blocks-national-guard-from-chicago-indefinitely-while-awaiting-supreme-court-decision\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">a judge\u2019s order<\/a> in October that has blocked the deployment of hundreds of national guard personnel in a legal challenge brought by Illinois state officials and local leaders, who had opposed any federalization of those troops to offer backup to immigration enforcement.<\/p>\n<p class=\"dcr-130mj7b\">The department had asked to allow the deployment while the litigation plays out. There have been sustained protests outside an Immigration and Customs Enforcement (<a href=\"https:\/\/www.theguardian.com\/us-news\/ice-us-immigration-and-customs-enforcement\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">ICE<\/a>) facility in Broadview, on the outskirts of Chicago, with <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/nov\/28\/chicago-faith-leaders-ice-crackdown\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">aggressive tactics<\/a> used against the resistance by the authorities.<\/p>\n<p class=\"dcr-130mj7b\">Last week, authorities arrested 21 protesters and said four officers were injured outside the Broadview facility. Local authorities made the arrests.<\/p>\n<p class=\"dcr-130mj7b\">The justices decided on a 6-3 vote on Tuesday to back a lower court and rule that the <a href=\"https:\/\/www.theguardian.com\/us-news\/trump-administration\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Trump administration<\/a> had not met the legal burden needed to show that it was not able to execute the laws of the land without federal military intervention.<\/p>\n<p class=\"dcr-130mj7b\">The three justices leaning furthest to the right on the bench, Samuel Alito, Clarence Thomas and Neil Gorsuch, dissented on Tuesday.<\/p>\n<p class=\"dcr-130mj7b\">The decision was a significant defeat for Trump\u2019s efforts to send troops to US cities as part of his immigration crackdown and arguments that some cities and states are doing a bad job of fighting crime.<\/p>\n<p class=\"dcr-130mj7b\">The justices declined the Republican administration\u2019s emergency request to overturn a ruling by US district judge April Perry that had blocked the deployment of troops. An appeals court also had refused to step in. The supreme court took more than two months to act.<\/p>\n<p class=\"dcr-130mj7b\">The high court order is not a final ruling but it could affect other lawsuits challenging Trump\u2019s attempts to deploy the military in other Democratic-led cities.<\/p>\n<p class=\"dcr-130mj7b\">\u201cAt this preliminary stage, the government has failed to identify a source of authority that would allow the military to execute the laws in <a href=\"https:\/\/www.theguardian.com\/us-news\/illinois\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Illinois<\/a>,\u201d the majority on the bench wrote.<\/p>\n<p class=\"dcr-130mj7b\">Justice Brett Kavanaugh said he agreed with the decision to block the <a href=\"https:\/\/www.theguardian.com\/us-news\/chicago\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Chicago<\/a> deployment, but would have left the president more latitude to deploy troops in possible future scenarios.<\/p>\n<p class=\"dcr-130mj7b\">The White House did not immediately respond to an email message seeking comment.<\/p>\n<p class=\"dcr-130mj7b\">In a dissent, Alito and Thomas said the court had no basis to reject Trump\u2019s contention that the administration was unable to enforce immigration laws without troops. Gorsuch said he would have narrowly sided with the government based on the declarations of federal law enforcement officials.<\/p>\n<p class=\"dcr-130mj7b\">The administration had initially sought the order to allow the deployment of troops from Illinois and Texas, but the Texas contingent of about 200 national guard troops was later sent home from Chicago.<\/p>\n<p class=\"dcr-130mj7b\">The Trump administration has argued that the troops are needed \u201cto protect federal personnel and property from violent resistance against the enforcement of federal immigration laws\u201d.<\/p>\n<p class=\"dcr-130mj7b\">But Perry wrote that she found no substantial evidence that a \u201cdanger of rebellion\u201d is brewing in Illinois and no reason to believe the protests there had gotten in the way of Trump\u2019s immigration crackdown.<\/p>\n<p class=\"dcr-130mj7b\">Perry had initially blocked the deployment for two weeks. But in October, she extended the order indefinitely while the supreme court reviewed the case.<\/p>\n<p class=\"dcr-130mj7b\">The Illinois case is just one of several legal battles over national guard deployments.<\/p>\n<p class=\"dcr-130mj7b\">District of Columbia attorney general Brian Schwalb is suing to halt the deployments of more than 2,000 guard troops in the nation\u2019s capital. Forty-five states have entered filings in federal court in that case, with 23 supporting the administration\u2019s actions and 22 supporting the attorney general\u2019s lawsuit.<\/p>\n<p class=\"dcr-130mj7b\">More than 2,200 troops from several Republican-led states remain in Washington DC.<\/p>\n<p class=\"dcr-130mj7b\">A federal judge in Oregon has permanently blocked the deployment of national guard troops there, and all 200 troops from California were being sent home from Oregon, an official said.<\/p>\n<p class=\"dcr-130mj7b\">A state court in Tennessee ruled in favor of Democratic officials who sued to stop the ongoing national guard deployment in Memphis, which Trump has called a replica of his crackdown on DC.<\/p>\n<p class=\"dcr-130mj7b\">In California, a judge in September said deployment in the Los Angeles area was illegal.
