The high seas cover nearly half the planet, but have remained largely unregulated.Annika Hammerschlag\/The Associated Press<\/p>\n<p class=\"c-article-body__text text-pr-5\">A landmark agreement to protect marine biodiversity on the high seas becomes international law on Saturday, but Canada still has not ratified the agreement, a step that would give the country an official role in ocean conservation measures. <\/p>\n<p class=\"c-article-body__text text-pr-5\"><a href=\"https:\/\/treaties.un.org\/Pages\/ViewDetails.aspx?src=TREATY&amp;mtdsg_no=XXI-10&amp;chapter=21&amp;clang=_en\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/treaties.un.org\/Pages\/ViewDetails.aspx?src=TREATY&amp;mtdsg_no=XXI-10&amp;chapter=21&amp;clang=_en\">More than 80 nations<\/a> have ratified the High Seas Treaty, formally known as the Agreement on the Conservation and Sustainable Use of Marine Biological Diversity of Areas Beyond National Jurisdiction (<a href=\"https:\/\/www.un.org\/bbnjagreement\/en\/bbnj-agreement\/text-bbnj-agreement\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.un.org\/bbnjagreement\/en\/bbnj-agreement\/text-bbnj-agreement\">BBNJ<\/a>).<\/p>\n<p class=\"c-article-body__text text-pr-5\">Fisheries and Oceans Canada is leading the domestic treaty adoption process.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cCanada aims to ratify the BBNJ Agreement as soon as possible, and work is ongoing,\u201d DFO spokesperson Jennifer Northcott said Friday in a statement. The department did not provide a timeline or budget for ratification.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The treaty fills a gap in ocean governance that has existed since the adoption of the United Nations Convention on the Law of the Sea more than four decades ago. For the first time, it creates a legal framework to establish marine protected areas (MPAs) in international waters, require environmental impact assessments for activities on the high seas and ensure benefits from marine genetic resources are shared equitably.<\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/canada\/science\/article-wildlife-population-declines-wwf-canada-new-data\/\" rel=\"nofollow noopener\" target=\"_blank\">New data put Canadian wildlife population declines in focus<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">The high seas \u2013 international waters beyond countries\u2019 200-nautical-mile exclusive economic zones \u2013 cover nearly half the planet but have remained largely unregulated. Only 1.5 per cent is currently protected.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The final preparatory meeting ahead of the treaty\u2019s first Conference of Parties takes place in late March in New York. There, delegates will finalize recommendations on the Scientific and Technical Body, the panel that will review proposals for the first high-seas protected areas. Those recommendations will go to the first Conference of Parties, likely in early 2027.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cCanada wants to be at the table to have a say,\u201d says Rebecca Hubbard, director of the High Seas Alliance, a coalition of 70 conservation groups that advocated for the treaty.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Protections realized through the treaty are critical for meeting the Kunming-Montreal commitment to safeguard 30 per cent of the ocean by 2030 \u2013 a deal Canada helped broker.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cIt will also offer a significant contribution to the delivery of the global biodiversity targets and protect Canada\u2019s migratory species who spend parts of their lives in the high seas, such as marine mammals, sharks, and turtles,\u201d Ms. Northcott said.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The American eel is one such species. Every eel harvested in Canadian waters began its life in the <a href=\"https:\/\/mpa.highseasalliance.org\/sargasso-sea\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/mpa.highseasalliance.org\/sargasso-sea\">Sargasso Sea<\/a> \u2013 a five-million-square-kilometre expanse of ocean east of Bermuda bounded by the North Atlantic Gyre. The sea\u2019s floating mats of sargassum seaweed provide habitat for a dizzying range of species, making the area a candidate for designation as one of the treaty\u2019s first high-seas MPAs. Canada signed the <a href=\"https:\/\/www.sargassoseacommission.org\/storage\/Hamilton_Declaration_with_signatures_April_2018.pdf\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.sargassoseacommission.org\/storage\/Hamilton_Declaration_with_signatures_April_2018.pdf\">Hamilton Declaration<\/a>, pledging to protect the Sargasso Sea. But ratifying the treaty grants Canada a formal role in shaping how that protection is designed.<\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/business\/article-manulife-vancouver-veritree-technology-reforestation-program\/\" rel=\"nofollow noopener\" target=\"_blank\">Manulife taps Vancouver-based veritree\u2019s technology for its reforestation program<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">Ratification requires <a href=\"https:\/\/lop.parl.ca\/sites\/PublicWebsite\/default\/en_CA\/ResearchPublications\/200845E#a3-3-1\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/lop.parl.ca\/sites\/PublicWebsite\/default\/en_CA\/ResearchPublications\/200845E#a3-3-1\">tabling the treaty in the House of Commons<\/a> for 21 sitting days before cabinet approval \u2013 a process that requires an approved budget. Prime Minister Mark Carney <a href=\"https:\/\/www.ourcommons.ca\/documentviewer\/en\/45-1\/house\/sitting-54\/hansard\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.ourcommons.ca\/documentviewer\/en\/45-1\/house\/sitting-54\/hansard\">told the House on Nov. 17<\/a> that a new nature strategy would be released \u201cin the coming weeks.\u201d The budget to support Canada\u2019s treaty implementation is expected to be included.<\/p>\n<p class=\"c-article-body__text text-pr-5\">While the European Union, Pacific Island states and countries including China, Denmark, France and Norway <a href=\"https:\/\/treaties.un.org\/Pages\/ViewDetails.aspx?src=TREATY&amp;mtdsg_no=XXI-10&amp;chapter=21&amp;clang=_en\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/treaties.un.org\/Pages\/ViewDetails.aspx?src=TREATY&amp;mtdsg_no=XXI-10&amp;chapter=21&amp;clang=_en\">have all ratified<\/a>, Canada is not alone in finalizing its process \u2013 Germany, the United Kingdom and Australia are also working toward ratification.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cThe high seas can only be managed collectively,\u201d says Susanna Fuller, vice-president of conservation at Oceans North. \u201cCanada is an ocean leader. I think Canada needs to show that multilateralism can still work.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">Canada has a history of ocean leadership, from helping draft the <a href=\"https:\/\/www.un.org\/depts\/los\/convention_agreements\/convention_overview_convention.htm\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.un.org\/depts\/los\/convention_agreements\/convention_overview_convention.htm\">UN Convention on the Law of the Sea<\/a> to negotiating the <a href=\"https:\/\/un.org\/Depts\/los\/convention_agreements\/convention_overview_fish_stocks.htm\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/un.org\/Depts\/los\/convention_agreements\/convention_overview_fish_stocks.htm\">Fish Stocks Agreement<\/a> to the <a href=\"https:\/\/www.dfo-mpo.gc.ca\/international\/arctic-arctique-eng.htm\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.dfo-mpo.gc.ca\/international\/arctic-arctique-eng.htm\">Central Arctic Ocean Fisheries Agreement<\/a>.
