{"id":418502,"date":"2026-01-19T02:27:13","date_gmt":"2026-01-19T02:27:13","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/418502\/"},"modified":"2026-01-19T02:27:13","modified_gmt":"2026-01-19T02:27:13","slug":"the-wacky-musk-openai-legal-war-now-involves-a-fittingly-insane-amount-of-money","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/418502\/","title":{"rendered":"The Wacky Musk-OpenAI Legal War Now Involves a Fittingly Insane Amount of Money"},"content":{"rendered":"<p>One of many fascinating details in the multi-year legal dispute between Elon Musk and OpenAI is that OpenAI president Greg Brockman saw it coming miles away, writing in what was essentially his diary back in 2017 that he couldn\u2019t \u201csee us turning this into a for-profit without a very nasty fight\u201d with Elon Musk. <a href=\"https:\/\/openai.com\/index\/the-truth-elon-left-out\/\" rel=\"nofollow noopener\" target=\"_blank\">Neither side disputes that Brockman wrote this<\/a>.<\/p>\n<p>And what could be nastier than the richest man in the world suing your company (and also Microsoft) for $134 billion, a sum <a href=\"https:\/\/www.imf.org\/external\/datamapper\/profile\/KEN\" rel=\"nofollow noopener\" target=\"_blank\">roughly the size of the nominal GDP of Kenya<\/a>, and more than <a href=\"https:\/\/www.macrotrends.net\/stocks\/charts\/TSLA\/tesla\/revenue\" rel=\"nofollow noopener\" target=\"_blank\">the revenue Tesla made last year<\/a>?<\/p>\n<p>OpenAI has been consistent in its public statements, saying the suit is both baseless and part of a harassment campaign. Specifically, <a href=\"https:\/\/techcrunch.com\/2026\/01\/08\/elon-musks-lawsuit-against-openai-will-face-a-jury-in-march\/\" rel=\"nofollow noopener\" target=\"_blank\">one on January 8<\/a> called the suit \u201cbaseless and a part of his ongoing pattern of harassment.\u201d On January 16, <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2026-01-17\/musk-seeks-up-to-134-billion-damages-from-openai-microsoft\" rel=\"nofollow noopener\" target=\"_blank\">according to Bloomberg<\/a>, OpenAI said \u201cMr Musk\u2019s lawsuit continues to be baseless and a part of his ongoing pattern of harassment, and we look forward to demonstrating this at trial,\u201d adding \u201cThis latest unserious demand is aimed solely at furthering this harassment campaign.\u201d\u00a0<\/p>\n<p>If there\u2019s a basis for this latest claim,\u00a0<a href=\"https:\/\/fingfx.thomsonreuters.com\/gfx\/legaldocs\/zgpoyexeopd\/Musk%20v%20Altman%20-%20remedies%20-%2020260116.pdf\" rel=\"nofollow noopener\" target=\"_blank\">it\u2019s spelled out in the latest court filing<\/a> from the plaintiff\u2019s side in this suit. The document is brief and pretty lucid, and concerns \u201cwrongful gains,\u201d which should have been the name of <a href=\"https:\/\/www.youtube.com\/watch?v=L8v0FEX3KYs\" rel=\"nofollow noopener\" target=\"_blank\">ESPN\u2019s podcast documentary about Jose Canseco<\/a>. <\/p>\n<p>The \u201cwrongful gains\u201d argument stems from Musk\u2019s claim that he ponied up $38 million or about 60% of the seed funding OpenAI needed to begin operations as a nonprofit, and made \u201cnonmonetary contributions,\u201d such as roping in \u201ckey employees,\u201d putting the founders in touch with people, mentoring them, and \u201clending his prestige and reputation to the venture.\u201d <\/p>\n<p>In early coverage of OpenAI, Musk comes across as a crucial progenitor of OpenAI who later parted with it amicably. The <a href=\"https:\/\/www.nytimes.com\/2018\/04\/19\/technology\/artificial-intelligence-salaries-openai.html\" rel=\"nofollow noopener\" target=\"_blank\">New York Times<\/a>, for instance, wrote in 2018 that \u201cIn 2015, Elon Musk, the chief executive of the electric-car maker Tesla, and other well-known figures in the tech industry created OpenAI and moved it into offices just north of Silicon Valley in San Francisco,\u201d but that, \u201che has stepped down from the OpenAI board, with the lab saying this would allow him to \u2018eliminate a potential future conflict.\u2019\u201d <\/p>\n<p>The core of Musk\u2019s suit is that OpenAI turned against its stated purpose after Musk provided the funding that got it off the ground. It underwent a restructuring that has resulted in the nonprofit turning almost entirely into a for-profit public benefit corporation\u2014though it is still <a href=\"https:\/\/openai.com\/index\/built-to-benefit-everyone\/\" rel=\"nofollow noopener\" target=\"_blank\">controlled to some degree by a separate nonprofit called the OpenAI Foundation<\/a>. <\/p>\n<p>Musk would, <a href=\"https:\/\/gizmodo.com\/grok-would-still-choose-killing-all-jews-over-destroying-elon-musks-brain-2000694802\" rel=\"nofollow noopener\" target=\"_blank\">as you\u2019re no doubt aware<\/a>, go on to found one of OpenAI\u2019s main competitors, xAI, which has an <a href=\"https:\/\/www.nytimes.com\/2026\/01\/06\/technology\/xai-elon-musk-funding.html\" rel=\"nofollow noopener\" target=\"_blank\">estimated valuation of $230 billion<\/a>, a little less than double the sum he\u2019s now demanding in his OpenAI suit. xAI is entirely for-profit, and while it was once a public benefit corporation, that constraint was \u201c<a href=\"https:\/\/www.cnbc.com\/2025\/08\/25\/elon-musk-xai-dropped-public-benefit-corp-status-while-fighting-openai.html\" rel=\"nofollow noopener\" target=\"_blank\">secretly<\/a>\u201d abandoned last year, according to CNBC.\u00a0<\/p>\n<p>The total demand from Musk hasn\u2019t even been tallied yet.
