{"id":437864,"date":"2026-01-28T04:21:07","date_gmt":"2026-01-28T04:21:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/437864\/"},"modified":"2026-01-28T04:21:07","modified_gmt":"2026-01-28T04:21:07","slug":"alberta-justices-emphasize-independence-in-rare-statement-after-remarks-by-danielle-smith","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/437864\/","title":{"rendered":"Alberta justices emphasize independence in rare statement after remarks by Danielle Smith"},"content":{"rendered":"<p><a style=\"display:block\" href=\"https:\/\/www.theglobeandmail.com\/resizer\/v2\/J665EWHCO5ECJKQW2HAXQB6SNI.jpg?auth=ee4402afd5f414ed37ab14cde57e799841aca40a3cbf611b2cf8d33fdf344f53&amp;width=600&amp;height=400&amp;quality=80&amp;smart=true\" aria-haspopup=\"true\" data-photo-viewer-index=\"0\" rel=\"nofollow noopener\" target=\"_blank\">Open this photo in gallery:<\/a><\/p>\n<p class=\"figcap-text\">Alberta Premier Danielle Smith said last weekend to a caller to her radio show that she wishes she could &#8216;direct judges.&#8217;Sean Kilpatrick\/The Canadian Press<\/p>\n<p class=\"c-article-body__text text-pr-5\">Judicial independence is foundational to a properly functioning democracy, <a href=\"https:\/\/www.theglobeandmail.com\/topics\/alberta\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/topics\/alberta\/\">Alberta\u2019s<\/a> chief justices, representing the province\u2019s three judicial branches, wrote in a pointed statement released days after Premier <a href=\"https:\/\/www.theglobeandmail.com\/topics\/danielle-smith\/\" target=\"_blank\" rel=\"noreferrer nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/topics\/danielle-smith\/\">Danielle Smith<\/a> said she wished she could \u201cdirect\u201d judges. <\/p>\n<p class=\"c-article-body__text text-pr-5\">Tuesday\u2019s public statement, a rare step for the province\u2019s top judges, was signed by Acting Chief Justice Dawn Pentelechuk, with the Court of Appeal; Chief Justice Kent Davidson, with the Court of King\u2019s Bench; and Chief Justice James Hunter, with the Alberta Court of Justice.<\/p>\n<p class=\"c-article-body__text text-pr-5\">The independence of each branch of government \u201censures there are checks and balances across the system. It is the foundation of a healthy democracy,\u201d they <a href=\"https:\/\/www.albertacourts.ca\/docs\/default-source\/qb\/statement-from-the-chief-justices.pdf?sfvrsn=5fa5cc82_3\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.albertacourts.ca\/docs\/default-source\/qb\/statement-from-the-chief-justices.pdf?sfvrsn=5fa5cc82_3\">wrote<\/a> in the statement, which a court representative said was developed over several weeks.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cPublic trust and confidence in our institutions \u2013 and all three branches of government \u2013 depend on it. It is equally important that each branch respect and support the independence of the others.&#8221;<\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/opinion\/article-if-nothing-else-danielle-smith-is-a-disruptor\/\" rel=\"nofollow noopener\" target=\"_blank\">Robyn Urback: If nothing else, Danielle Smith is a disruptor<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">The statement doesn\u2019t directly call out Ms. Smith or her ruling United Conservative Party, but was released after a series of public remarks she made that appeared to cast doubt on the integrity of the judicial system.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cI wish I could direct the judges, honestly,\u201d Ms. Smith said last weekend to a caller to her radio show, who complained about Canada\u2019s bail laws.<\/p>\n<p class=\"c-article-body__text text-pr-5\">She added that she recently wrote to Prime Minister Mark Carney proposing more provincial involvement in judicial appointments \u201cso that we start choosing judges in Alberta that reflect the values of how we want them to operate here.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">In recent months, she has also repeatedly referred to judges as activists appointed by former prime minister Justin Trudeau and implied that rulings were being made along partisan lines.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Sam Blackett, spokesperson for Ms. Smith, said that while recent court rulings have led Albertans and Canadians to question aspects of the court system, \u201cour government respects the role of each branch of government and supports their independence.\u201d<\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-notwithstanding-clause-trans-gender-diverse-youth-bill\/\" rel=\"nofollow noopener\" target=\"_blank\">Alberta invokes notwithstanding clause on three bills affecting trans and gender-diverse youth<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">Olav Rokne, spokesperson for Alberta\u2019s Court of Justice, said the judges\u2019 statement was not in response to specific comments or an event. He described it as educational.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Ms. Smith\u2019s comments on the judiciary are similar to those of Ontario Premier Doug Ford, who last April called judicial independence \u201ca joke,\u201d and suggested Canada should switch to U.S.-style elected judges. Mr. Ford referred to \u201cbleeding hearts\u201d on the bench who grant bail to those accused of crimes and make decisions against his government based on \u201cideology.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">His remarks prompted a joint response from Ontario\u2019s top judges at the time who also wrote about judicial independence as \u201ca cornerstone of our constitutional democracy.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">Gerard Kennedy, a constitutional law professor at the University of Alberta, said the implication that judges are deciding matters along partisan lines can seriously undermine faith in the courts. He added it\u2019s not an infraction for governments to criticize court decisions.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cImplying that the judges are making decisions because of partisan affiliation, however, is deeply problematic,\u201d he said.<\/p>\n<p class=\"c-article-body__text text-pr-5\">\u201cWe\u2019ve set up the institution of the judiciary very carefully to ensure that that is not a perception, say nothing about not being a reality.\u201d<\/p>\n<p class=\"c-article-body__text mv-16 l-inset text-pb-8\" data-sophi-feature=\"interstitial\"><a href=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-alberta-premier-danielle-smith-recall-petition\/\" rel=\"nofollow noopener\" target=\"_blank\">Alberta Premier Danielle Smith facing recall petition<\/a><\/p>\n<p class=\"c-article-body__text text-pr-5\">On Tuesday, federal Justice Minister Sean Fraser announced the appointment of two Calgary lawyers, Jason Wilkins and Peter Banks, to the Court of King\u2019s Bench of Alberta. Mr. Fraser wrote in a statement he is \u201cconfident they will serve the people of Alberta.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">Alberta NDP Leader Naheed Nenshi and justice critic Irfan Sabir wrote in a statement that the justices\u2019 letter \u201cshows just how far this irresponsible and anti-democracy premier and her Justice Minister have gone to interfere and create mistrust in our justice system.\u201d<\/p>\n<p class=\"c-article-body__text text-pr-5\">Ms. Smith has come into conflict with the courts in other ways in recent months by using legislative maneuvers \u2013 all of which have been legal \u2013 to discontinue active proceedings or exempt laws suspended by courts.<\/p>\n<p class=\"c-article-body__text text-pr-5\">Most recently, Ms. Smith\u2019s government in December used legislation to <a href=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-alberta-changes-political-parties-election-referendum-laws\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.theglobeandmail.com\/canada\/alberta\/article-alberta-changes-political-parties-election-referendum-laws\/\">end all court proceedings<\/a> brought forward by Alberta\u2019s Chief Electoral Officer. <\/p>\n<p class=\"c-article-body__text text-pr-5\">Earlier in 2025, Alberta Chief Electoral Officer Gordon McClure had asked for a court opinion on the constitutionality a proposed independence referendum question. <\/p>\n<p class=\"c-article-body__text text-pr-5\">In December, however, Alberta Justice Minister Mickey Amery tabled legislation that would end any court proceedings electoral officers had sent for a judicial review. <\/p>\n<p class=\"c-article-body__text text-pr-5\">Before that bill was passed into law, Court of King\u2019s Bench Justice Colin Feasby completed his constitutional review into the independence question.
