{"id":483624,"date":"2026-02-18T19:13:07","date_gmt":"2026-02-18T19:13:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/483624\/"},"modified":"2026-02-18T19:13:07","modified_gmt":"2026-02-18T19:13:07","slug":"us-mining-company-alcoa-hit-with-unprecedented-55m-penalty-for-illegal-clearing-of-wa-jarrah-forests-environment","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/483624\/","title":{"rendered":"US mining company Alcoa hit with \u2018unprecedented\u2019 $55m penalty for illegal clearing of WA jarrah forests | Environment"},"content":{"rendered":"<p class=\"dcr-130mj7b\">The environment minister, Murray Watt, has handed a $55m penalty to the US mining giant Alcoa for unlawful land clearing for bauxite mining in Western Australia\u2019s northern jarrah forests, south of Perth.<\/p>\n<p class=\"dcr-130mj7b\">As Watt announced the \u201cunprecedented\u201d remediation order, he said he had also granted the company an exemption to clear further habitat for 18 months while the government considered a proposal for an extension of the company\u2019s <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/oct\/05\/western-australia-baudin-black-cockatoo-wont-survive-mining-expansion\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">mining operations to 2045<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">Watt said the penalty \u2013 known as an enforceable undertaking \u2013 was for clearing that occurred from 2019-2025 in known habitat for nationally protected species without an approval under the Environment Protection and Biodiversity Conservation Act.<\/p>\n<p class=\"dcr-130mj7b\">WA\u2019s northern jarrah forests are habitat for species including the endangered carnaby\u2019s and <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/oct\/05\/western-australia-baudin-black-cockatoo-wont-survive-mining-expansion\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">baudin\u2019s black cockatoos<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">The $55m penalty, which relates to more than 2,000 hectares of cleared land, requires Alcoa to fund environmental and research measures, including $40m to secure permanent ecological offsets to compensate for the habitat destruction.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIt\u2019s the largest conservation\u2011focused commitment of its kind,\u201d Watt said.<\/p>\n<p class=\"dcr-130mj7b\">A further $5m will go to the Australian Wildlife Conservancy for conservation programs for affected species, $6m to state government invasive species control projects, and $4m to the University of Western Australia for research into invasive fauna control in the northern jarrah forests.<\/p>\n<p class=\"dcr-130mj7b\">Alcoa said in a statement that while it \u201cmaintains it has operated in accordance with the EPBC Act\u201d it had agreed to pay for the measures.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThe funding supports the health of the Northern Jarrah Forest, including programs and research that improve habitat for threatened species and control invasive flora and fauna,\u201d the company said in a statement.<\/p>\n<p class=\"dcr-130mj7b\"><a href=\"https:\/\/www.theguardian.com\/email-newsletters?CMP=copyembed&amp;CMP=emailbutton\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Sign up: AU Breaking News email<\/a><\/p>\n<p class=\"dcr-130mj7b\">Watt said he had used an existing national interest provision in Australia\u2019s nature laws to allow for further clearing for bauxite mining for 18 months.<\/p>\n<p class=\"dcr-130mj7b\">It would appear that this is the first time <a href=\"https:\/\/www.dcceew.gov.au\/environment\/epbc\/approvals\/register-of-exemptions\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">the exemption<\/a> has been used in a way that benefits the commercial interests of a mine.<\/p>\n<p class=\"dcr-130mj7b\">The exemption is <a href=\"https:\/\/www.theguardian.com\/environment\/2025\/nov\/22\/labor-to-rule-out-national-interest-exemption-for-coal-gas-if-greens-back-nature-laws\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">separate to a new power<\/a> included in last year\u2019s overhaul of the EPBC Act, which allows the minister to approve projects in breach of nature laws.<\/p>\n<p class=\"dcr-130mj7b\">Watt said the \u201ctime limited exemption\u201d would allow Alcoa to continue clearing while the government used a strategic assessment process to consider the company\u2019s proposed expansion of its Huntly and Willowdale mining operations, about 100km south of Perth, until 2045.<\/p>\n<p class=\"dcr-130mj7b\">He said the exemption \u201censures the continued supply of bauxite and supports future gallium production, critical for renewable systems like solar panels and wind turbines\u201d.<\/p>\n<p>Environment minister Murray Watt announced the penalty on Wednesday. Photograph: Jamila Filippone\/The Guardian<\/p>\n<p class=\"dcr-130mj7b\">Watt said it would secure a \u201cstable supply of minerals vital for our net zero transformation and defence industries, while strengthening partnerships with the United States and Japan\u201d, and would allow Alcoa to sustain its operations which employed about 6,000 workers.<\/p>\n<p class=\"dcr-130mj7b\">Alcoa\u2019s spokesperson said the company would limit clearing under the exemption to 800 hectares per year and would \u201cincrease annual rates of new rehabilitation to 1,000 hectares per year by 2027\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The company\u2019s president and chief executive, William Oplinger, said: \u201cWe are committed to responsible operations and welcome this important step in transitioning our approvals to a contemporary assessment process that provides increased certainty for our operations and our people into the future.<\/p>\n<p class=\"dcr-130mj7b\">\u201cWe appreciate the government\u2019s recognition of the important contributions of our operations to the Australian economy.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Matt Roberts, the executive director of the Conservation Council of Western Australia, said while the significant penalty issued to Alcoa was welcome, \u201cwe\u2019re talking about a company that strip-mines the northern jarrah forest\u201d.<\/p>\n<p class=\"dcr-130mj7b\">\u201cIt cannot be rehabilitated to its original state after it\u2019s been strip-mined.
