{"id":485476,"date":"2026-02-19T14:34:13","date_gmt":"2026-02-19T14:34:13","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/485476\/"},"modified":"2026-02-19T14:34:13","modified_gmt":"2026-02-19T14:34:13","slug":"coalition-sues-epa-over-greenhouse-gas-emissions-rule-change","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/485476\/","title":{"rendered":"Coalition sues EPA over greenhouse gas emissions rule change"},"content":{"rendered":"<p>WASHINGTON (AP) \u2014 A coalition of health and environmental groups sued the Environmental Protection Agency on Wednesday, challenging the rescinding of a scientific finding that has been the central basis for U.S. action to regulate greenhouse gas emissions and fight <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/climate-and-environment\" rel=\"nofollow noopener\" target=\"_blank\">climate change<\/a>.<\/p>\n<p>A rule <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-climate-change-epa-clean-air-act-c149d5ea6ec71c862e6c4b578adf92cd\" rel=\"nofollow noopener\" target=\"_blank\">finalized by the EPA<\/a> last week revoked a 2009 government declaration known as <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-epa-endangerment-climate-change-public-health-25764e8298db96c3c189b6833252b7ca\" rel=\"nofollow noopener\" target=\"_blank\">the endangerment finding<\/a> that determined that carbon dioxide and other greenhouse gases <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/climate-change-health-deaths-heat-sickness-scam-5b7492660d7dad1c324f2bbbe6163f1c\" rel=\"nofollow noopener\" target=\"_blank\">threaten public health<\/a> and welfare. The Obama-era finding is the <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/epa-endangerment-finding-zeldin-trump-climate-change-4b34246d5ca798154af08560fd94f7b9\" rel=\"nofollow noopener\" target=\"_blank\">legal underpinning of nearly all climate regulations<\/a> under the Clean Air Act for motor vehicles, power plants and other pollution sources that are heating the planet. <\/p>\n<p>The repeal eliminates all greenhouse gas emissions standards for cars and trucks and could unleash a broader undoing of climate regulations on stationary sources such as power plants and oil and gas facilities, experts say.<\/p>\n<p>The legal challenge, filed in the U.S. Court of Appeals for the District of Columbia Circuit, asserts that the EPA\u2019s rescission of the endangerment finding is unlawful. The 2009 finding supported common sense safeguards to cut climate pollution, including from cars and trucks, the lawsuit says. Clean vehicle standards imposed by the Biden administration were set to \u201cdeliver the single biggest cut to U.S. carbon pollution in history, save lives and save Americans hard-earned money on gas,\u2019&#8217; the coalition said in filing the case.<\/p>\n<p>After nearly two decades of scientific evidence supporting the 2009 finding, \u201cthe agency cannot credibly claim that the body of work is now incorrect,\u2019&#8217; said Brian Lynk, a senior attorney at the Environmental Law &amp; Policy Center.<\/p>\n<p>\u201cThis reckless and legally untenable decision creates immediate uncertainty for businesses, guarantees prolonged legal battles and undermines the stability of federal climate regulations,\u201d Lynk said. <\/p>\n<p>The Supreme Court ruled, in a landmark 2007 case, that carbon dioxide and other greenhouse gases are \u201cair pollutants\u201d under the Clean Air Act. EPA<\/a>, courts have uniformly rejected legal challenges to the endangerment finding, including a 2023 decision by the D.C. appeals court.<\/p>\n<p>EPA spokeswoman Brigit Hirsch said Wednesday that the agency \u201ccarefully considered and reevaluated the legal foundation of the 2009 Endangerment Finding\u201d in light of recent court decisions, including a <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/supreme-court-epa-ruling-2e893673819a1b6c6aa272a5e814f0b0\" rel=\"nofollow noopener\" target=\"_blank\">2022 Supreme Court ruling<\/a> that limited how the clean air law can be used to reduce carbon dioxide emissions from power plants.<\/p>\n<p>\u201cEPA is bound by the laws established by Congress, including under the Clean Air Act,\u2019&#8217; she said. \u201cCongress never intended to give EPA authority to impose (greenhouse gas) regulations for cars and trucks.\u201d<\/p>\n<p>The dispute is likely to end up back before the Supreme Court, which now is far more conservative than in 2007.<\/p>\n<p>Trump administration claims the finding \u2018strangled\u2019 business<\/p>\n<p>The lawsuit was brought by groups including the American Public Health Association, American Lung Association, Alliance of Nurses for a Healthy Environment and Physicians for Social Responsibility, along with environmental groups such as the Center for Biological Diversity, Conservation Law Foundation, Environmental Defense Fund, Natural Resources Defense Council and Sierra Club. <\/p>\n<p>The suit named the EPA and its administrator Lee Zeldin as defendants.<\/p>\n<p>President Donald Trump said in announcing the repeal that it was \u201cthe single largest deregulatory action in American history, by far,\u201d while Zeldin called the endangerment finding \u201cthe Holy Grail of federal regulatory overreach.\u201d<\/p>\n<p>The endangerment finding \u201cled to trillions of dollars in regulations that strangled entire sectors of the United States economy, including the American auto industry,\u201d Zeldin said. \u201cThe Obama and Biden administrations used it to steamroll into existence a left-wing wish list of costly climate policies, electric vehicle mandates and other requirements that assaulted consumer choice and affordability.\u201d<\/p>\n<p>Environmental groups described the move as the single biggest attack in U.S. history against federal authority to address climate change. Evidence backing up the endangerment finding has only grown stronger in the 17 years since it was approved, they said.<\/p>\n<p>Endangerment finding spurred new climate regulations<\/p>\n<p>Under the Clean Air Act, EPA is legally required to limit emissions of any air pollutant that causes or contributes to \u201cair pollution that may reasonably be anticipated to endanger public health or welfare.\u201d <\/p>\n<p>In its 2007 ruling, the Supreme Court told EPA to determine, based on the science, if greenhouse gas pollution endangers human health and welfare. EPA made that determination in 2009, which led to new standards for vehicles. It built on that finding when issuing other standards.<\/p>\n<p>EPA\u2019s repeal of the endangerment finding, along with the elimination of safeguards to limit vehicle emissions, \u201cmarks a complete dereliction of the agency\u2019s mission to protect people\u2019s health and its legal obligations under the Clean Air Act,\u2019&#8217; said Gretchen Goldman, president and CEO at the Union of Concerned Scientists, which is part of the suit.<\/p>\n<p>\u201cThis shameful and dangerous action \u2026 is rooted in falsehoods, not facts, and is at complete odds with the public interest and the best available science,\u201d Goldman said. Heat-trapping emissions and global average temperatures are rising \u2014 primarily due to the burning of fossil fuels \u2014 contributing to a mounting human and economic toll across the world, she said.<\/p>\n<p>The White House and Zeldin said the new rule will save taxpayers $1.3 trillion over the next three decades, mostly from reduced costs for new vehicles. But the <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/www.epa.gov\/system\/files\/documents\/2026-02\/420r26002.pdf\" target=\"_blank\" rel=\"noopener nofollow\">EPA\u2019s own analysis<\/a> found that eliminating the vehicle standards will likely increase gas prices, forcing Americans to spend more on fuel. A chart within the agency\u2019s regulatory analysis predicts $1.4 trillion in additional costs through 2055 from increased fuel purchases, vehicle repair and maintenance and other issues.<\/p>\n<p>Democrats launch inquiry into EPA action<\/p>\n<p>The lawsuit comes as Senate Democrats announced they are <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/nam12.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.epw.senate.gov%2Fpublic%2Findex.cfm%3Fa%3Dfiles.serve%26File_id%3D4D181237-520D-4FF0-B7F5-3E11958EC8C3&amp;data=05%7C02%7Cmdaly%40ap.org%7C4230c9bb1df743e2465f08de6f04d2b8%7Ce442e1abfd6b4ba3abf3b020eb50df37%7C1%7C0%7C639070263811608791%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=51NyBEgJydy4on524vfmOrrjV1WAHSrFNz5WVHYq%2F2o%3D&amp;reserved=0\" target=\"_blank\" rel=\"noopener nofollow\">launching an investigation<\/a> into the decision, saying public comments by Zeldin and other Trump officials over the past year make clear that the administration \u201cregarded repeal of the endangerment finding as a predetermined objective\u201d long before it completed its required regulatory review, including consideration of nearly 600,000 public comments. <\/p>\n<p>Many of the comments submitted to EPA detailed \u201cthe scientific and legal infirmities of repealing the endangerment finding,\u2019&#8217; Rhode Island Sen.
