{"id":488772,"date":"2026-02-21T00:26:29","date_gmt":"2026-02-21T00:26:29","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/488772\/"},"modified":"2026-02-21T00:26:29","modified_gmt":"2026-02-21T00:26:29","slug":"guilty-before-proven-innocent-calgary-distillery-submits-appeal-to-lift-liquor-detention-order","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/488772\/","title":{"rendered":"&#8216;Guilty before proven innocent&#8217;: Calgary distillery submits appeal to lift liquor detention order"},"content":{"rendered":"<p>Award-winning grain spirit makers are calling on public servants to reverse what they consider an ill-informed cessation order issued by the Canadian Food Inspection Agency (CFIA) that affects their top-selling products.\u00a0<\/p>\n<p>Situated at the intersection of Marsh Road NE and Edmonton Trail, the almost eight-year-old Bridgeland Distillery sells everything from single malt whisky to brandy and flavoured liqueurs.\u00a0<\/p>\n<p>What sets them apart, however, are <a href=\"https:\/\/bridgelanddistillery.com\/spirits\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">three key products<\/a> that account for more than half of the distillery\u2019s revenue: their Taber Corn Berbon Corn Mash Spirit, Taber Corn Whisky 101, and Berbon Peach Cocktail.<\/p>\n<p>All of their batches use exclusively Canadian ingredients, especially their \u2018berbon,\u2019 a phonetic play on words for their bourbon-style spirit distilled with corn sourced from Taber, Alta., which was the basis of a complaint filed against the distillery last June.<\/p>\n<p>Bridgeland Distillery\u2019s co-owner, Daniel Plenzik, said that, after receiving an anonymous tip, the CFIA inspected their property on June 27, 2025. He was told to expect an update by September, but said they didn\u2019t hear back from the agency until Feb. 11, by which time the bottles had already been placed in detention.\u00a0<\/p>\n<p>According to an email statement, the CFIA said they are \u201cworking with the company to review the inspection findings and determine next steps.\u201d<\/p>\n<p>However, Plenzik said the decision was made abruptly before the distillery had a chance to meet with one of the agency\u2019s supervisors, who was scheduled to call on Feb. 18.\u00a0<\/p>\n<p>Even after they connected, Plenzik said the distillery still feels left in the dark about when the detention order will be lifted and has since sought help from government leaders to fast-track the process.<\/p>\n<p>\u2018We\u2019re following the rules,\u2019 says co-owner<\/p>\n<p>During the call, all parties reviewed the inspection outcome, and Plenzik and his business partner, Jacques Tremblay, said they were shocked to learn that the inspector\u2019s reasoning had changed from what they had been told initially.\u00a0<\/p>\n<p>Plenzik said that the distillery was put on the CFIA\u2019s radar because of an Instagram post they had made calling their \u2018berbon spirit\u2019 a \u2018Northern whisky,\u2019 something the distillery acknowledged as misleading and deleted immediately.\u00a0<\/p>\n<p>\u201cWe, of course, explained that these kinds of corrections could have been completed prior to placing a product in detention,\u201d he said.\u00a0<\/p>\n<p>\u201cEspecially when this is not a food safety concern.\u201d<\/p>\n<p>In that conversation, Plenzik and Tremblay explained the story behind their spelling of \u2018berbon\u2019 to the agency and said that the phonetic spelling should be accepted when paired with the common name \u2018spirit.\u2019<\/p>\n<p>The <a href=\"https:\/\/inspection.canada.ca\/en\/food-labels\/labelling\/industry\/alcoholic-beverages#s1c2\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Government of Canada<\/a> states that generic terms such as beverage, drink, cooler, spirit, or liquor are acceptable labels for products that do not match the common names outlined by the CFIA, such as bourbon, brandy, or whisky.\u00a0<\/p>\n<p>Although businesses must avoid labelling their products with <a href=\"http:\/\/inspection.canada.ca\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">misleading common names<\/a>, including ones that read similarly to an existing item, Plenzik said that naming their products \u2018berbon spirit\u2019 \u2014 like their Taber Corn Berbon Corn Mash Spirit \u2014 shouldn\u2019t be a problem.\u00a0<\/p>\n<p>In the case of the distillery\u2019s Taber Corn Berbon Whisky 101, Plenzik argued that there is no geographical restriction on the words \u2018berbon,\u2019 bourbon, or whisky, just the term \u2018bourbon whiskey,\u2019 which can only be applied to liquor manufactured in the U.S., according to the <a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/S-15.6\/page-2.html#h-437150\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Spirit Drinks Trade Act<\/a>.\u00a0<\/p>\n<p>Labelling aside, in response to the CFIA\u2019s point that the distillery\u2019s bourbon-style spirit is crafted like a whisky and should be categorized as such, Plenzik said that this conclusion further highlights a lack of consistency in the agency\u2019s mandate.<\/p>\n<p>\u201cThey pick and choose the regulations they read,\u201d said Plenzik.\u00a0<\/p>\n<p>\u201cThey ignore it in the purpose of calling our product a whisky, and then they say you can\u2019t sell it because it\u2019s not a whisky.\u201d<\/p>\n<p>It\u2019s true that both Bridgeland\u2019s Taber Corn Berbon Corn Mash Spirit and Taber Corn Berbon Whisky 101 are closer to bourbon than whisky, as they both have bases made up of <a href=\"https:\/\/bridgelanddistillery.com\/spirits\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">60 per cent corn<\/a>.\u00a0<\/p>\n<p>According to a 2023 scholarly article by the <a href=\"https:\/\/heinonline.org\/hol-cgi-bin\/get_pdf.cgi?handle=hein.journals\/branlaj62&amp;section=16\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">University of Louisville<\/a>, bourbon is a spirit that belongs to the broader category of whisky, differentiated only by containing more than 51 per cent corn, along with other ingredients like rye, wheat, or malted barley.<\/p>\n<p>Since other businesses across the country have phonetically named their products adjacent to bourbon, like \u2018<a href=\"https:\/\/spirit-in-niagara.myshopify.com\/products\/canadian-brrrbon\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Canadian Brrrbon<\/a>,\u2019 a whisky by Ontario company Spirit in Niagara, Plenzik feels that Bridgeland Distillery is being unjustly targeted without proper consultation.<\/p>\n<p>Negotiations a necessary but missing step: Distillery<\/p>\n<p>The distillery said that deliberation between them and the CFIA would have been appreciated before the sales of certain products ceased.\u00a0<\/p>\n<p>\u201cI\u2019ve been getting orders, and we have to tell them we can\u2019t, and that\u2019s first of all, embarrassing, because it doesn\u2019t make any sense,\u201d said Plenzik.\u00a0<\/p>\n<p>\u201cIt\u2019s a big waste of time.\u201d<\/p>\n<p>However, he said that the CFIA stated that placing products in detention is part of its process, and that the distillery\u2019s only option to advocate for itself is to write a corrective action request to the agency.\u00a0<\/p>\n<p>Plenzik said they submitted this on the same day, but since the CFIA was unable to provide a timeline, the distillery has continued to ask members of all levels of government to intervene in their support.\u00a0<\/p>\n<p>Between emails to notable public servants like Premier Danielle Smith, Mayor Jeromy Farkas, the minister of health, Marjorie Michel, and a visit to Calgary Confederation MP Corey Hogan\u2019s office, Plenzik said they have yet to receive a response.\u00a0<\/p>\n<p>For a small business that has had its most popular products \u2014 which make up 50 per cent of the distillery\u2019s revenue \u2014 barred, he said the lack of transparency and opportunity to discuss the issue has felt like a slap in the face.\u00a0<\/p>\n<p>\u201cThere\u2019s a whole bunch of things that we\u2019ve done to elevate Alberta and Calgary and Canada,\u201d said Plenzik.\u00a0<\/p>\n<p>\u201cAnd yet, our own government is not supportive.\u201d<\/p>\n<p><img data-recalc-dims=\"1\" fetchpriority=\"high\" decoding=\"async\" width=\"696\" height=\"696\"
