The policy stresses that confidentiality is \u201cextremely important.\u201d<\/p>\n
The teacher said the provincial policy left her feeling uncomfortable speaking to the parents about their child.<\/p>\n
She also alleges the school\u2019s instructions had violated her freedom of conscience and freedom of expression. <\/p>\n
The court is now reviewing arguments about whether some witnesses providing statements in the case can remain anonymous, testing the limits of what\u2019s in the public interest.<\/p>\n
Two legal clinics, Juritrans and Our Duty Canada, are intervening in the case.<\/p>\n
Our Duty lawyers collected affidavits from parents of transgender children across Canada and two adult women who detransitioned after starting a gender transition in high school. <\/p>\n
The teacher\u2019s lawyer, Olivier S\u00e9guin, argued the identity of all affiants should be withheld from court documents to ensure they do not rescind their testimony. Some also requested their testimony be for lawyers\u2019 eyes only.<\/p>\n
He said their perspectives are vital for the court to hear balanced positions and are of public interest. However, many only agreed to submit their testimony under condition of anonymity and \u201czero risk.\u201d <\/p>\n
According to S\u00e9guin, the affiants worry about their relationships with their children \u2013 whose medical histories and psychosocial information is detailed in the testimonies \u2013 and of negative repercussions given \u201cthe societal context\u201d and sensitivity of the topic.<\/p>\n
Juritrans disagrees with this approach, noting a judge already granted limited confidentiality for all trans minors in the case.<\/p>\n
Juritrans lawyer Lex Gill said she would not be able to properly cross-examine witnesses if the judge approved the anonymity requests, which would extend to her clients.<\/p>\n
Juristrans intervened in the case to represent the interests of transgender youths and students, including a minor who agreed to testify. <\/p>\n
Gill said the clinic is \u201cseeking to protect the constitutional rights of [those] directly affected by the policy\u201d the teacher wants nullified.<\/p>\n
She added there is \u201cno legal standing\u201d to grant anonymity to protect from \u201cpersonal conflict, embarrassment and the usual stress of participating in court procedures\u201d or to \u201cinstrumentalize\u201d the personal information of third parties without their consent.<\/p>\n
She is asking the judge to waive S\u00e9guin and Our Canada\u2019s confidentiality requests, saying it goes against the spirit of public interest and the open court system.<\/p>\n
The judge\u2019s decision is expected to land in a few weeks.<\/p>\n
The court has not yet set a date to hear arguments in the wider case.<\/p>\n
