Anthropic on Monday sued<\/a> the Defense Department and other federal agencies after the Pentagon announced last week that the AI company would be labeled a threat to national security and its products banned from use for defense purposes. <\/p>\n

In late February, President Donald Trump said he would also ban the use of Anthropic\u2019s products across other federal agencies.<\/p>\n

Filing two lawsuits, one in the U.S. District Court in the Northern District of California and the other in the D.C. Circuit Court of Appeals, Anthropic alleged that the federal government\u2019s moves to cut off the company go beyond a normal contract dispute and instead represent an \u201cunlawful campaign of retaliation.\u201d The company said its \u201creputation and core First Amendment freedoms are under attack\u201d and that it will seek to prevent the Trump administration from implementing the bans.<\/p>\n

Anthropic said the supply-chain risk designation and messaging from the White House was already \u201cjeopardizing hundreds of millions of dollars,\u201d illegally ignored required procedures and overstepped presidential authority.<\/p>\n

\u201cSeeking judicial review does not change our longstanding commitment to harnessing AI to protect our national security,\u201d an Anthropic spokesperson told NBC News, \u201cbut this is a necessary step to protect our business, our customers, and our partners. We will continue to pursue every path toward resolution, including dialogue with the government.\u201d<\/p>\n

In a statement, White House spokesperson Liz Huston said: “The President and Secretary of War are ensuring America\u2019s courageous warfighters have the appropriate tools they need to be successful and will guarantee that they are never held hostage by the ideological whims of any Big Tech leaders. Under the Trump Administration, our military will obey the United States Constitution \u2014 not any woke AI company\u2019s terms of service.”<\/p>\n

In response to a request for comment, the Pentagon said it does not comment on litigation as a matter of policy.<\/p>\n

Anthropic filed lawsuits in two separate jurisdictions due to the Pentagon’s use of multiple legal authorities to invoke the supply-chain risk designation. Anthropic’s filing in the Northern District of California offers a more detailed account of its allegations against the Trump administration.<\/p>\n

The suits come after months of increasingly tense negotiations<\/a> between the company and the Pentagon over how the military should be allowed to use Anthropic\u2019s advanced AI systems. Anthropic and CEO Dario Amodei had wanted stronger guarantees from the Pentagon that its systems would not be used directly in deadly autonomous weapons or for mass domestic surveillance, while the Pentagon sought to use the systems for \u201call lawful use.\u201d <\/p>\n

In addition to the Defense Department, Anthropic is suing several other federal agencies, including the Treasury, State and Commerce Departments, and their top officials. Among others, Anthropic listed Treasury Secretary Scott Bessent, Health and Human Services Secretary Robert F. Kennedy, Jr., and outgoing Secretary of Homeland Security Kristi Noem as defendants. <\/p>\n

Anthropic\u2019s flagship AI system, Claude, has reportedly been used by the Pentagon on classified networks for support in intelligence assessments<\/a>, targeting recommendations and battle simulations<\/a> as part of its partnership with data analytics company Palantir<\/a>. Claude has also been used across federal agencies<\/a> to assist with data analysis and other administrative functions, much like consumer-facing chatbots.<\/p>\n

Amodei has said that the supply-chain risk label, historically reserved for foreign adversaries and associated companies that cannot be trusted in critical industries, has never before been publicly applied to an American company. <\/p>\n

When the two parties could not come to an agreement by a Pentagon-set deadline on Feb. 27, President Donald Trump announced on Truth Social<\/a> that all federal agencies must \u201cIMMEDIATELY CEASE all use of Anthropic\u2019s technology.\u201d <\/p>\n
