{"id":544639,"date":"2026-03-18T14:14:10","date_gmt":"2026-03-18T14:14:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/544639\/"},"modified":"2026-03-18T14:14:10","modified_gmt":"2026-03-18T14:14:10","slug":"when-the-epa-rolled-back-mercury-regulations-it-left-this-community-in-the-path-of-pollution","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/544639\/","title":{"rendered":"When the EPA rolled back mercury regulations, it left this community in the path of pollution"},"content":{"rendered":"<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuwtm3g001z27nn2ldwcfau@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Rainbow trout is a prized catch for fisherman on the Northern Cheyenne reservation, in the high plains of southeastern Montana.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy4tj700033b6rr5xmqjgn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe men in my family like to go fishing; they cook them right there because it\u2019s fresh,\u201d said Charlene Alden, the tribe\u2019s environmental protection director.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy4tj700043b6rv1wcacxn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But there is an invisible threat in the local waterways. The pollution coming out of the smokestacks at the nearby Colstrip power plant contains mercury and other toxic elements, which can settle in water and be ingested by the fish.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy4tj700053b6r907qduho@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That kind of pollution used to be much more prolific around the country, before Obama-era rules <a href=\"https:\/\/www.catf.us\/work\/power-plants\/obama-regulations\/\" target=\"_blank\" rel=\"nofollow noopener\">cut it dramatically<\/a>, by 90%. But Colstrip is among over 30 power plants nationwide that still burn lignite, a peat-rich coal that contains higher-than-average levels of mercury and other pollutants \u2014 and lignite plants were able to slip through a loophole in the Obama regulations.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy4tj700063b6ryfshobb3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Under former President Joe Biden, the Environmental Protection Agency attempted to crack down on the remainder, <a href=\"https:\/\/www.cnn.com\/2024\/04\/25\/climate\/biden-epa-power-plant-rule-climate\" rel=\"nofollow noopener\" target=\"_blank\">finalizing a regulation<\/a> in 2024 that closed the prior loophole. But the Trump administration recently axed that measure, with EPA Press Secretary Brigit Hirsch calling the original Obama rule \u201chighly effective\u201d and one that has \u201cprotected public health and the environment for years.\u201d In other words, to the current EPA, a 90% reduction is good enough.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy4tj700073b6ri5l2kn7k@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            While it\u2019s true the Trump rollback impacts a relatively small number of power plants, it could have big implications for communities that live near them, like the Northern Cheyenne tribe.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy4tj700083b6r4jtvoiu4@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Alden said she is concerned about what they mean for the health of her community.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy4tj700093b6rnriuwua9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cI think it\u2019s taking a step backwards from making sure our environment is safe and making sure our food sources are safe,\u201d Alden said. \u201cWe try hard to keep our little piece of land that we have left free of pollution. We consider ourselves stewards of the environment.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy58i2000e3b6rhts79f2c@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Colstrip emitted nearly 60 pounds of mercury last year, according to EPA data <a href=\"https:\/\/blogs.edf.org\/climate411\/2026\/03\/06\/new-analysis-shows-a-clear-need-for-stronger-protections-from-coal-plant-mercury-pollution\/#:~:text=Lignite%20coal%20is%20an%20especially,then%20produces%20even%20more%20emissions.\" target=\"_blank\" rel=\"nofollow noopener\">mapped by the nonprofit<\/a> Environmental Defense Fund. That heavy metal gets emitted into the air before bioaccumulating in land and water.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy5k66000g3b6rhcnk04m1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Mercury \u201cis an insidious toxin,\u201d said Joe Goffman, who led EPA\u2019s Office of Air and Radiation under Biden. \u201cIt gets deposited in water, ingested by fish, and then people who eat the fish absorb it into their bloodstream.\u201d\n    <\/p>\n<p>       <img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2026\/03\/c-ap18061792191832.jpg\" alt=\"The Colstrip power plant with ponds used to dispose of coal ash on May 25, 2013.\" class=\"image_large__dam-img image_large__dam-img--loading\" onload=\"this.classList.remove('image_large__dam-img--loading')\" onerror=\"imageLoadError(this)\" height=\"1065\" width=\"1600\" loading=\"lazy\"\/><\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy5k66000h3b6rtylfg0kl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The metal is of particular concern to pregnant women, babies and small children, because it is a neurotoxin that can impact brain development and cause lung disease.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy5k66000i3b6rbrifdkrf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            When the Trump EPA announced its rollback, the agency\u2019s Deputy Administrator David Fotouhi said in a statement that the Trump changes were \u201cfully protective of human health risks.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy5k66000j3b6rucc4g1rw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But <a href=\"https:\/\/seas.harvard.edu\/news\/despite-major-progress-nationally-two-mercury-emissions-hotspots-remain\" target=\"_blank\" rel=\"nofollow noopener\">Harvard University research<\/a> disputes that \u2014\u2013 finding elevated levels of mercury in states such as North Dakota and Texas, where power plants still burn a lot of lignite coal. The paper shows smaller hotspots around the country near other coal-fired power plants that burn lignite, including Colstrip.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy5k66000k3b6rlia7otm5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Trump administration is \u201csaying it\u2019s small and costly, so it\u2019s no big deal. But for those communities, it does matter,\u201d said Elsie Sunderland, a professor of environmental chemistry at Harvard University who oversaw the research.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy5k66000l3b6r1ugbwzgo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In addition, Sunderland and Goffman said, Native American tribes like the Northern Cheyenne are at particular risk because of their traditional diet.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy5k66000m3b6rdc5vpb9a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cPeople who are recreational fishers or subsistence anglers do eat a lot of fish, compared to the national average,\u201d Sunderland said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy5k66000n3b6rr3ydjmrw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Alden, the environmental protection director for the Northern Cheyenne, said mercury pollution has improved in the nearly 20 years she\u2019s held her job. And her community has a complicated relationship with Colstrip. The power plant is a source of local jobs, and the tribe gets funding from the power plant to monitor the air quality in the area. But with cancer cases on the rise, she worries about the myriad health impacts from the smog coming out of Colstrip\u2019s smokestacks.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy5k66000o3b6rhcaht6gs@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe\u2019re losing our people younger and younger due to diseases, different types of illnesses,\u201d Alden said, adding this is compounded by long wait times to see doctors.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy66ev000v3b6r7lw8ulvb@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Colstrip has the unique distinction of being the nation\u2019s <a href=\"https:\/\/www.nytimes.com\/2025\/04\/02\/climate\/coal-plant-colstrip-epa-email-pollution-exemption.html\" target=\"_blank\" rel=\"nofollow noopener\">dirtiest power plant<\/a>; it emits the highest levels of soot in the United States and has not followed other plants in installing basic pollution control technologies on its two operating units, which have been running for the last four decades.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy6rf6000x3b6r45f5fe5g@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Montana plant does emit less mercury pollution than others. The Oak Grove power plant in Texas and Coal Creek plant in North Dakota each emitted around 250 pounds of mercury \u2014 the most in the nation, while several other plants in the two states emitted over 100 pounds. And now, Trump officials have done away with the previous administration\u2019s mercury air toxics rule, altogether. Spokespeople for the electric utility and power generator that own Colstrip didn\u2019t respond to CNN\u2019s requests for comment.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy6rf6000z3b6rfvnysni6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In its final rule rolling back the Biden-era regulation, the Trump EPA said upgrading these pollution controls would pose tremendous costs, saying Colstrip accounted for \u201calmost half\u201d of the overall, nationwide costs of compliance. Given how effective the Obama-era regulations already were, the agency has said it didn\u2019t think this expense was worth the limited risk reduction.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy6rf600103b6ryxmo3dum@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The agency \u201cis committed to ensuring clean air for all Americans regardless of race, gender, creed, or background,\u201d said Hirsch, the EPA press secretary.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy6rf600113b6rpv0i9lzo@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But Goffman, the Biden EPA official, said closing a loophole for lignite plants in 2024 did not seem like much of a stretch, because the technology to cut down on pollution was widely available.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy6rf600123b6rrb5x5xx5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cMore than 90% of the rest of the coal fleet was reducing its mercury emissions by 80 or 90%,\u201d Goffman said, adding the Biden administration determined the carveout for lignite-burning plants was no longer difficult to achieve.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy6rf600133b6ryabe9mnx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            And Goffman argues there are still major health impacts to the local communities.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmmuy6rf600143b6rc59ggg00@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWhen they say, \u2018a small rollback,\u2019 there\u2019s a population of actual communities and actual people who are being erased by that rhetoric,\u201d Goffman said.\n    <\/p>\n","protected":false},"excerpt":{"rendered":"Rainbow trout is a prized catch for fisherman on the Northern Cheyenne reservation, in the high plains of&hellip;\n","protected":false},"author":2,"featured_media":544640,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[22],"tags":[49,48,295,66],"class_list":{"0":"post-544639","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-environment","8":"tag-ca","9":"tag-canada","10":"tag-environment","11":"tag-science"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/ca\/wp-json\/wp\/v2\/posts\/544639","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/ca\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/ca\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ca\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ca\/wp-json\/wp\/v2\/comments?post=544639"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/ca\/wp-json\/wp\/v2\/posts\/544639\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/ca\/wp-json\/wp\/v2\/media\/544640"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/ca\/wp-json\/wp\/v2\/media?parent=544639"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/ca\/wp-json\/wp\/v2\/categories?post=544639"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/ca\/wp-json\/wp\/v2\/tags?post=544639"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
