{"id":557030,"date":"2026-03-24T07:50:21","date_gmt":"2026-03-24T07:50:21","guid":{"rendered":"https:\/\/www.newsbeep.com\/ca\/557030\/"},"modified":"2026-03-24T07:50:21","modified_gmt":"2026-03-24T07:50:21","slug":"landmark-quebec-ruling-states-no-pet-clause-violates-charter-rights-montreal","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/ca\/557030\/","title":{"rendered":"\u2018Landmark\u2019 Quebec ruling states no-pet clause violates Charter rights &#8211; Montreal"},"content":{"rendered":"<p>No-pet clauses have long been the norm for tenants in Quebec and even considered legal.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2026\/01\/70c8fc80.png\" alt=\"\" style=\"position:absolute;width:1px;height:1px\" referrerpolicy=\"no-referrer-when-downgrade\"\/><\/p>\n<p>But following a new ruling by the province\u2019s housing tribunal, after a challenge by a tenant to a no-pet clause in their lease, the door may soon be open for all pet owners.<\/p>\n<p>\u201cWe were arguing that the no-pet clause that was in their lease was against their fundamental rights, that are in the charter of rights,\u201d said Kimmyanne Brown, the tenant\u2019s lawyer.<\/p>\n<p>In the March 12 ruling, the judge rejected the landlord\u2019s attempt to terminate the lease of the tenant and allowed her to stay in her rental unit with her dog.<\/p>\n<p>\t\t\t\t\t<img decoding=\"async\" width=\"170\" height=\"225\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/ca\/wp-content\/uploads\/2026\/01\/1767930311_275_national.jpg\" alt=\"Get breaking Canada news delivered to your inbox as it happens so you won't miss a trending story.\"\/><\/p>\n<p>\t\t\t\t\tGet breaking National news<\/p>\n<p>Get breaking Canada news delivered to your inbox as it happens so you won&#8217;t miss a trending story.<\/p>\n<p>The tribunal concluded that the clause indeed violates Articles 1 and 5 of the Charter, which guarantees respect for a person\u2019s dignity, freedom and privacy.<\/p>\n<p>Story continues below advertisement<\/p>\n<p>\u201cIt\u2019s only one decision, it\u2019s only regarding a specific case, but we\u2019re hoping it\u2019s going to set an important precedent for tenants rights,\u201d Brown said.<\/p>\n<p>The Montreal SPCA, which has supported the case since 2023, says the implications could reach much further, arguing lease restrictions banning animals in rental units are one of the leading reasons pets end up in shelters.<\/p>\n<p>\u201cEssentially, what the court is saying is that no-pet clauses are archaic and outdated and no longer in sync with how we as a society today relate to animals,\u201d said Sophie Gaillard, director of animal advocacy and legal and government affairs at the Montreal SPCA.<\/p>\n<p>\n\t\t\tMore on Canada<br \/>\n\t\t\tMore videos\n\t\t<\/p>\n<p>The Montreal SPCA has been fighting to ban no-pet clauses in leases for over a decade.<\/p>\n<p>More than half of all Quebec families now include a pet, the organization says, and nearly two animals a day are brought to the shelter because of challenges related to finding a home that allows them.<\/p>\n<p>While the ruling can still be appealed, advocates stress that it could mark an important turning point \u2014 and many hope it will be the key to striking down a province-wide tradition of allowing landlords to ban pets from their tenant\u2019s premises.<\/p>\n<p>\u201cWe have a very clear decision that highlights the fact that these clauses are problematic, not just for animals and shelters, but also from a human rights perspective,\u201d Gaillard said.<\/p>\n<p>\n\t\t&amp;copy 2026 Global News, a division of Corus Entertainment Inc.\t<\/p>\n","protected":false},"excerpt":{"rendered":"No-pet clauses have long been the norm for tenants in Quebec and even considered legal.
